Prenuptials - Anticipating failure or good idea?

Alright. I've had this argument a few times now, and I can't quite get over it.

I say that obtaining a prenup is a good idea in any marriage, because going through a divorce is a stressful enough process without arguing (and by arguing, I probably mean suing) over who gets what.

My family (who, incidentally, is very religious) says that getting a prenup means you expect your marriage will fail, so you should not get one at all. They also argue that unless you are very wealthy, getting a prenup is pointless.

What are your opinions on this?

Having been through one divorce I would never marry again without a pre-nup.

the title is a false dichotomy. It is a good idea BECAUSE it anticipates failure.

It is a good idea, especially if you have assets and want to safeguard your assets for yourself and/or children.  I would not consider marriage without a prenup,

I guess it depends on what is being brought in to the marriage. Two people who come together with pretty much nothing are going to have a hard time figuring out how to divvy it up.

Seriously, I think it depends...


If you are both young, starting out together, making a life together, well it would be fair to split assets equally in the event of a divorce.... if that is not the case, think about one, but prenups are not set in stone anyways

I personally wouldn't have one because I stayed single for many many many years because I wanted to be sure of the man I wanted to be with, a man I could trust completely and would do so with every fiber of my being.

Besides what's he going to take? half of nothing? LOL

My opinion is find out or learn what your prenup (divorce law) agreement is where you live in your state and if you guys like it, use it; but if either of you have a problem with the divorce laws in your state write your own agreement. Each of you will need to get a lawyer (you each need your own lawyer for the prenup to be valid or more concrete so no one can break it later) otherwise someone can say I didn’t have a lawyer and didn’t know my rights, which may be a reason for a judge to intervene and break the prenup.

when I got divorced, there was NO battle over anything.  we agreed that we were ill-suited, and that we would leave the marriage with what we had come into it with. .All else was to be sold/divided equitably, proceeds split.

It really does depend on the people and what they have before entering the marriage.  I do not see the point of one if everything is earnt equally.  I don't believe that wealth is a factor though because something does not have to cost much to be of value.

When you say this are you being specific?  What I mean is are you talking about children concieved during the marriage, or those that are already there? Or both?
