Free speech is grand. There is also an obligation when speaking freely. Slander suits come to mind quickly.

All i said was Fox won the right to lie. The successfully won that right in court. They are under no obligation to report the truth because it isnt a "law, rule or regulation" that they do so.

Thats exactly what they ruled upon.


You are correct, I misread your last response to be your original claim..that they said that the media has a "right to lie", which is not what the ruling said. They merely said that Akre's argument was legally incorrect, because the rule they cited was not an ADOPTED RULE, which is a requirement under Fla law for a whistleblower.

"As noted above, the legislature’s use of the word “adopted” in the whistle-blower's statute
was deliberate and was intended to limit the scope of conduct that will subject an
employer to liability. This limitation is consistent with the legislature’s requirement that
agency statements that fit the definition of a “rule” be formally adopted. Recognizing an
uncodified agency policy developed through the adjudicative process as the equivalent
of a formally adopted rule is not consistent with this policy, and it would expand the
scope of conduct that could subject an employer to liability beyond what Florida’s
Legislature could have contemplated when it enacted the whistle-blower's statute."

That pretty much states that the FCC does not have a rule or regulation to force the truth in a news report.

Ugh.  Time to inject some intelligence into this.

Jane Akre was fired from her job with WTVT, a Fox affiliate, after one of her stories did not run.  She claimed this was wrongful termination and sued under Florida's whistleblower law.  The argument was that by not running the story, they were effectively in violation of FCC policy against falsifying or distorting the news.  The state appeals court determined that the FCC policy was not a "law, rule, or regulation" as determined under the wistleblower statute.  Therefore, the court disallowed wisteblower protection in this case.

The result:  Under Florida law, there is no wistleblower protection for journalists who say that their employer has violated FCC policy.

A news organization can still be sued for libel or other damages that result from any false information that is given.  And the FCC can still take action against them.

So what is the average Joe to do?  If you don't find a news outlet trustworthy, don't read, watch, or listen to them.

And, as such, the decision does not in any way say that the media has a right to lie....the claim that started this hijack.

WHAT the ruling says is that the media is under no "law, rule or regulation" to report the truth.

In this particular case, the reporters discovered BGH, a hormone, was being fed to dairy cattle in Florida. The same hormone banned in many countries. Akre won a judgement based upon whistleblowing... no other finding, everything else dismissed. It was during the appeal for the whistleblowing that Fox stated the Court ruling was wrong because there was no rule or law against falsification.

Now, maybe that means one thing to you. To me, if you tell me you arent held to a standard of not falsifying ...........

again, what they said, and its plain English:

That doesnt say there are no laws rules or regulations against the media lying, it says that FCC policy isnt. If you didnt let your ideology blind you like it so often does, you would see the huge difference.

And its interesting that Akre never pursued remedy under any other law.

Best comedy in a long while watching clips of them from yesterday valiantly pretending like they didn't do or say anything the day before. Maddow put the clips together last night. I almost busted a gut laughing at the clowns of FNC.
