This is a case that was posted over a year ago. Seems buried beneath the elections, this man was convicted.


FAIRFAX, Va. (CBS/AP) In the privacy of his own home, Erick Williamson likes to drink his morning coffee in the buff, a fact that got several of his suburban Virginia neighbors steamed.

Now, a jury of his fully-clothed peers has convicted Williamson of indecent exposure because two women said they saw him naked while walking by the windows of his house in October. He received neither jail time nor a fine, but is appealing anyway, saying a larger principle is at stake.

Birnbaum sought jail time for Williamson, but General District Judge Ian M. O'Flaherty imposed only a suspended sentence, meaning that Williamson will serve no jail time if he keeps out of trouble.

If Williamson follows through on his plans to appeal, though, a circuit court judge could impose a tougher punishment, technically up to a year in jail.

Which side of this would you prefer I take first ? I'll refrain from explaining how the existence of this case at all supports some of my assertions. I guess I will take the side of the fuddy duddies first.

The government (I think ?)

You live in a society. You want to go live in the woods fine, no problem. The law must reflect community standards because if not then we are not a representative government. In matters such as these, community standards vary, but that does not make them irrelevant. This is the same set of community standards that prevents someone from opening a rendering plant or oil refinery next to your house.

The defendant

My house was there before the bus stop, and before the other houses in fact (for arguments sake), at that time I was most of the community. I face the sunlight naked every morning, like a ritual. Someone else came along and effectively took most of my community away, and I have not been compensated. I have always done this, and if they cared to look then, they could simply have put the bus stop elsewhere. Preventing my morning ritual is tantamount to abridging freedom of religion, IN MY OWN HOME THAT I BUILT. (remember it's semi-hypothetical for illustrative purposes)

For the sake of argument, both arguments are good. Face it, you don't know this guy and none of us cares personally about him or the town in which he lives. What has spawned this as the issue de jure, and jure, and.... is that it is a deeper issue.

Now given the enhanced hypothetic I presented, as the judge would have to rule thus :

I am reluctant to jail or fine you under these circumstances. However Michealangelo's Davin is in a room and people have to desire to see it. It is not out on somebody's front lawn. Those who object to your ritual are also part of the community. As such I am issuing a temporary injuction against you practicing your ritual. If you violate the order you will be in contempt of court. However this order will be lifted once you satisfy one requirement. Find a way to make viewing your private parts impossible to the casual observer. You can use any means you like within reason. It doesn't have to be clothing, it could be landscaping or anything you can think up. As long as it is effective. Those who object are not voyeurs, they are members of the community. Cooperate and get along, and feel free to appeal.

Is it who was here first - - - - - - or who was here last ?

I worked for a guy had a sign up for around thirty years, all the sudden one day he has to take it down. I said to tell them to take that idea and make sure it does not get a sunburn. He was there first, that business was there paying taxes since before alot of the city cockroaches were born. Who is right ? That case has nothing to do with porn or anything like that.

I remember reading a story about a Man who had a farmhouse or whatever out in the stix, somebody up and put a billboard across the road (not a street LOL) which blocked his view of the sunset. He went over there with an axe and chopped it down. They threw him in jail and he always said he would do it again. I don't remember the end of the story. But that's a juxtaposition of the.....; whatever. This time he was the community.

They had pics last year- of the lay out of the yard- and view of the big window.

Had he had even a shoddy curtain- up- nothing would have come of this.

I seem to recall that not only was he naked, but he walked from window to window while they went by to make sure they saw him, all of him.

The guy, a renter, not an owner, which doesnt make a difference, has since moved. He is an idiot who got a suspended sentence yet wants to fight this.

Whats wrong with him....he could be making money with a simple video cam.   That would satisfy his need to show off the bod, plus give him a little extra cash for some curtains.

Correct me if I'm wrong but isn't it against the law to be looking *into* people's windows?
Windows are for people to be looking *out of* not for people to be looking *in to.*

Was his windows covered, or did he leave them in a way that you could see right in, is what I want to know, because if he left them where you could see right in, ie no shades, no blinds, no closed curtains, then I feel the claims are just, and should stick. If he had blinds, or drawn curtains, or pulled shades an then through a crack or something he was seen an people fussed, I'd be on his side.

The first woman, school librarian Joyce Giuliani, said she heard some loud singing as she left her home and drove to work. As she drove by Williamson's home, she saw him naked, standing directly behind a large picture window.

A few hours later, Yvette Dean was walking her 7-year-old son to school along a trail that runs by Williamson's home.

She heard a loud rattle, looked to her left and saw Williamson standing naked, full frontal, in a side doorway.

"He gave me eye contact," Dean said, but otherwise made no gestures toward her or her son.

As she turned the corner, she looked back at the home, in disbelief at what she had just seen. Again, she saw Williamson, naked in the same picture window.

One of Williamson's housemates testified that Williamson had been nude well before dawn. Timothy Baclit said that he woke up around 5 a.m. to go to work and saw Williamson walking around "naked ... with a hard hat."

He said he warned Williamson that he would be visible to passersby, but that Williamson did not respond.

Williamson, 29, said the conversation with Baclit never occurred and that he never noticed that two women had seen him. He said "it did not occur to me" that people outside the home might see him naked.

And pops, if you dont want someone seeing what you are doing in your home, you dont leave the windows uncovered. Peeping tom laws would not apply.
