I think part of the process here is forgotten... that of a jury. Hardly a passionless group.. many agonize over their decisions while in the conviction phase as well as the penalty phase. Its not just a Judge deciding... but a pool of citizens making that determination.

Susan Smith is a great example.

Many called for her execution when she killed her sons by drowning them.. drive right into a lake and left them to drown so she could be with her boyfriend. Yet, the jury didnt see it as a death penalty offence.

Many want to preach about how blood thirsty a society the US is. But in terms of history, we are still babes in the woods.

We do have compassion in our courts.... brought in by the jurors who serve those courts.

The difference between execution and murder is legal process. That is what is so disturbing about this case. The process became tainted when witnesses claimed coercion and recanted.
