He creates a hazardous or physically offensive condition by any act which serves no legitimate purpose. Disorderly conduct is a violation. And Im sure they are being very careful with this one.... on both sides. I can't speak for NYC. Simply because I am not down there. I did however spend the entire day down at Dewey Sq today and spoke for quite a while to the NLG and ACLU interns and attorneys working on strategy for pushing the censorship issue going on in the national mainstream media. Folks are volunteering away from the site to stay on the media with several techniques to get them to realize just how much people want to hear this event covered. And I did hear a fella discussing the arrests so far. What the Boston folk will likely face is a felony trespass I heard the guy say that because they put up no resistance and merely were in the way of the entrance, they cannot be convicted of disorderly because they did not act as a threat, nuisance, or obstacle. 'Loud' falls under in most circumstances under disturbing the piece. And there are other criteria like time of day and locational issues that will make that unlikely. And there's another thing. By the time I left (I'm doing stuff but not actually camping due to the fact I'm a single Dad,the kids have school, and the ex wants to sue for custody if the wind blows wrong) ... But what someone was saying is that they were almost at 48 hours for the first batch and that if they made it past that number, the charge would likely be dismissed... guess we'll see tomorrow. I can't say enough good about the character and the intelligence of the folks involved. And their sincerity is amazing. Nobody is playing Little Cesare... in fact they very much want everybody who walks up to feel an integral part of this. And I gotta tell ya... this people's mic thing ... Well it's a riot... especially, when you throw an occasional laugher line. My son even met his constitutional requiremt for the rank of first class by discussing the constitution with recently graduated law student whom I woulda like to have patted down for weapons Seriously though this young woman was really kind to spend a whole hour helping the Jman cross that milestone. And my 'dear conservative' friends will be happy to know this woman was an intern for their idol, Professor Chomsky. All in all it was an extraordinary day!
