You seem to be making a mountain out of a molehill.

I've belonged to many organizations, and I've always had to sign a form.  Usually it was only when I joined.  After that, I never had to sign anything at an individual event.

It may have some "waiver" language, but for the most part, most of the ones that I've seen are primarily verifications that you're of age, you won't violate the group's privacy policies, you'll abide by the house rules and obey the DM's, and that if you get hurt playing with dangerous items, it's your own fault.

I've never seen anyone actually go to court over this stuff.  After all, most people would be embarrassed to do so.  I can just hear it now; "Your Honor, my client is suing because the accused, Mistress XXX, stuck her strap-on too far up his rectum, which resulted in bleeding and discomfort when he tried to take a shit".  Do you really think  somebody's going to stand in court and make that accusation?  [;)]

But if signing makes you feel uncomfortable, just scribble random letters.  They don't usually check anyway.  And they definitely don't ask for a birth certificate or passport, so who cares?

So my question to those of you who have attended play parties is this: Are waivers de rigueur for those who attend play parties?

i've only attended play parties here in Fresno. They are all given by the same group, and yes, there is a waiver. i don't have a problem with that. The play parties are out of someone's home. i would make people sign a waiver too, if they were going to play on my home. The parties seem well organised. There is always a DM present in the dungeon, and i feel confident that it's a safe place to play and there is minimal risk. i'm happy to sign a waiver in exchange for those things.

I'm also wondering what, if any, legitimacy this has as a legal document.

i have no idea.

I'm guessing it varies from one part of the world to another, here in the pacific northwest(USA) I've been to parties in quite a few cities and signing some sort of liability waiver is pretty standard.  Especially with larger parties where the host doesn't know everyone very well.  When it's just half a dozen friends who have known each other for years, then it would be silly to have to sign something to attend.

HeatherMcLeather -> RE: Question for those who go to play parties (10/2/2011 9:28:10 PM)

The linked page isn't really a waiver, because there isn't anything about absolving the club of responsibility and that's what a waiver does, I think. That page is just a list of the rules, they want you to sign it so you can't say you didn't know the rules at some later point would be my guess.

Uhm...that's been covered already.

You're entitled to your opinion.

As I had mentioned before, the play parties on this island are not held at a private home but in a rented space.

Just out of curiosity...these play parties that you have attended at a private home...weren't all individuals invited to the party vetted first?

Thanks for the response. I know that with people here, almost everyone knows everyone else. It's an island, after all. And no one will even get an invite to the party unless they've been "cleared" by a few key people.

I'll have to drag some of the legal types (those who work in the field) into this in order to find an answer to legal aspects of waivers and such.

HeatherMcLeather -> RE: Question for those who go to play parties (10/3/2011 12:29:58 AM)

So what. I clicked the link and saw what it was and posted. There's no need to get bitchy just because you can't tell a waiver from an acknowledgement of house rules.

VaguelyCurious -> RE: Question for those who go to play parties (10/3/2011 1:00:24 AM)

FR

I've never, ever had to sign anything at any BDSM space, but that might just be 'cuz I'm a limey.

Those are pretty standard dungeon rules, though - similar things tend to get printed up and stuck to walls at some UK events, even though people don't actually have to sign them.

I'm with Rochsub et al who think you're making a mountain out of a molehill. Making people sign a sheet of rules makes them more likely to actually read said rules, and makes them feel more obligated to follow them. That's why organisations have codes of conduct, rather than just sheets of rules. I really, really don't see the problem.

SailingBum -> RE: Question for those who go to play parties (10/3/2011 2:35:12 AM)

It's been awhile since I dropped outta law school to grab a MBA, The doc seems pretty straight forward. They seem to want you to know and understand the rules. Kinda like I didn't know I had to clean up my mess... They respond you signed a statement that you get the idea.... I call em moron clauses... If you act like a moron they toss yer dumb ass.

I suggest you re-read the OP.

I asked a couple of questions. Please explain where I'm making a mountain out of a molehill.

As I had asked, I'm just wondering if the house rules has any legal weight. I obviously can't provide the waiver, as it isn't online. But even so, I'm wondering the same thing about a waiver. In the end, if all they want are attendees to read the house rules and acknowledge a few items, they could just have attendees read it at the door and initial it. Or provide it online and have a person make an electronic signature. I tried to suggest this to the guy who organizes these things but he got all bent out of shape over it.

DeviantlyD -> RE: Question for those who go to play parties (10/3/2011 3:35:25 AM)

Aside from not having a solid answer regarding the legalities of any documents involved, my primary question was to ask others if waivers were something they encountered on a regular basis and I got my answer. So thanks. The end. :)

I did, you asked about signing a waiver and linked the acknowledgement of rules. There's nothing in there that I can see about it not being the document in question. And if I missed something, then I guess I'm OK with that since I'm not alone in doing so, Iamsemisweet, DesFIP, LillyBoPeep, Hisprettybaby, LadyPact, DarkSteven, and SailingBum all made the same mistake. Maybe you'd be so kind as to point out just what we missed?

I questioned him about it in a thread on FetLife and he became practically apoplectic over the idea I should challenge him in any way.
Personally I suspect it might have had more to do with the way you challenged him, rather than the fact that you did.

If I did end up going to any of the play parties here, I would definitely not sign my real name.
So you would lie and commit fraud rather than sign a waiver to protect the organizer of the event? I don't think I'd want somebody with your low morals attending a play party I was attending.

quote:

But I don't see myself going to any play parties here anytime soon.
I think I would be glad of that fact were I part of the local scene there, given your apparent lack of morals.

Some of the people in the community* (see above) here get their panties in a twist far too easily.
You mean like somebody who would stoop to deceit and fraud rather than sign a simple waiver? Yeah, I can see how one wouldn't really want to be around somebody like that anywhere, let alone at play party.

There's your answer.

Iamsemisweet -> RE: Question for those who go to play parties (10/3/2011 9:17:26 AM)

The suggestion that you would sign a fake name is pretty disturbing. Doesn't your honor mean anything to you? That kind of thinking may be why you aren't getting such a warm reception at the local play parties.

LinnaeaBorealis -> RE: Question for those who go to play parties (10/3/2011 9:30:35 AM)

When I went to the local dungeon as a guest, I had to sign a waiver each time I went. When I joined, I signed a waiver & now I just walk in. I don't have a problem signing such a thing, even if I'm only there to attend roundtable discussions or educational presentations. I believe it protects the owners & I'm happy to do that. I sign my legal name. The signature is illegible, but they also have me print it. I believe it actually has legality attached to it & that attorney(s) were consulted in the drawing up of such documents.

As an aside, I don't understand why people have gotten so snotty on this thread. If you have an opinion, why not just state it without the snark? And I'm including the OP in this remark.
