Governors Highway Safety Association (GHSA) spokesman Jonathan Adkins says 31 of the 34 states with text messaging bans, as well as Washington, D.C., have made texting while driving a primary offense, allowing police to pull drivers over for that specific offense. California and New York are among them, as is Maine, where the law went into effect last month.
Nine states made texting while driving a primary offense in 2010, and four more have done so this year, including Nevada, which will issue warnings until the law is in full-effect Jan. 1, 2012, Adkins said.

Doubting it is a police state, just look at any number of americans getting pepper sprayed by their own police when sitting down. Protesting peacefully
but NO cant do anything to stop morons from killing people with their texting super rights

My point was.... the Feds backed off the speed limits, making their point of the steps towards the feds taking over in that area moot.

I, for one, am getting sick to death of this States Rights bull. This is a single nation, a single economic and social unit, and a theory that was practical necessity back in the 18th century when long distance communication was non-existent is no longer needed. And when you consider how complex modern life has become, then the need for comprehensive solutions is critical. States Rights is simply an excuse for reactionary states to nullify the efforts of the national government. This cell phone thing is an excellent example: there isn't one of us who hasn't seen some godawful stupid behavior on the road, and as one who was raised in St Loser, in the Great State of Misery, I can tell you that Jefferson City will gladly put our lives at risk just to flout them 'Eastern Com-oo-nists'. States Rights died in the Civil War - we need to bury it once and for all before it buries this nation.
