And your post means what in our discussion? Which do you think it is financial or new boss or unable to handle new work load or just maybe you don't really know and neither do I. You jump around to much when cornered.

Oh well continue your bad bad bad business tirade to people who will listen… I’m off to check on some loafing employees, my grand children, who are supposedly raking the gumballs in my front yard.

damn caught me looking... dag on kids.... playing...I'll bet they will want unemployment after I swat their beehinds… tazzy I'm protecting no one... and the courts did not rule on the reason for the firing only if she should get unemployment.

I'm just being fair and reasonable in wanting more information, which will never come, before I condemn anyone. You seem to have no problem with it however.

considering the first source was yahoo i can definatly see a need for more information! and what the hell is raking up gumballs?

I gave you more. If you want more than that, you need to look up the court case.

"Illinois is an employment-at-will state, which means the employer can fire someone for a good reason, no reason, or a bad reason, as long as it is not discriminatory," he said.

They just need a good reason so that they dont have to pay unemployment benefits. The court disagreed with the employers reason.

lol... I've a sweet gum tree in my front yard... they are dirty and nasty trees with pin pong ball sized seed pods with spikes.

You have never been a supervisor or business owner I see...Just try running a company and keeping good employees if you treat them badly...And many businesses have company policies, even in Illinois, on what is needed in the way of documentation to fire someone... Are you privy to this companies policies?

Now as I've said before you could be right...but just as easily be wrong...you just don't have enough information.

All you have is a court saying the company could not deny unemployment... This says nothing about the reasons, right or wrong, in the first place...and that is where my first and all subsequent post have been directed.

hey, im just stating that yahoo news tends to be a few months behind and very thin on the details and facts, a second source was provided, we now have alot more on the details. im just talking about when the discussion first started and all we had was the yahoo source for refrence that i really understand how people would have their doubts in the blind belief of that story. now that we have that mcall.com refrence we now have quite alot more information to go off of

No reason is needed.

The only need for a reason is to prove misconduct, which is the only way an employer in Illinois can get out of paying unemployment.

They gave a reason for that purpose.

The Court said it wasnt good enough.

End of story.

I’ve had to do the very same thing over the years. Often an employee that is a bad worker will not do something bad enough at any one time to justify firing. So the boss is just waiting for the one mistake to get rid of them.

As we know we all break the rules at our jobs one time or another and if they want to say goodbye they will be watching for you to break the rules.

They can fire her with no reason. This whole thing is about the company trying to prevent her from drawing unemployment.

Trouble is, many of the people in cases like this have just learned how to "work the system". They hire lawyers specializing in these types of cases, and they'll twist information and double-talk till the case is finally ruled in their favor.

Maybe she deserved it, and maybe she didn't. I'd have to hear all of the story to make a decision in this particular case. But I've never seen an employer decide to pick on a good employee and fire them just to amuse themselves. And the ones I've seen in situations like this have all had a history of "working the system".

Apparently it was a new boss she had. Not everyone cares how long you have been with a company if they dont like you personally.

Actually, there was no dispute about her being fired for working.  The dispute arose over whether she could be considered eligible for unemployment after that.

Frankly, I would have, as an employer myself, commended her on her effort, but explained to her that although yes, that extra half hour of work did add a lot, at the same time, it was wearing and tiring on her, leading to an overall lack of productivity in the long run. And although I'm thankful and appreciative of the effort, it is far more effective to take a bit of a break, refresh and come back with more energy. At which point I would likely, unless I was busy as all fuck, offer to help her my own damn self. For me, hard work, or at least an obvious sincere effort, does not go unrewarded.

I think that's part of where we've gone wrong as a productive country in general. But that's another fight for another day.
