FatDomDaddy -> MD Court of Appeals: Pitbulls Inherently Dangerous (4/27/2012 4:08:52 PM)

No more free passes for pittbull owners. They bite and not only is the owner liable, but the property owner too.

There have been several attempts to legislate similar actions against pittbulls in local jurisdictions but they continued to get defeated. The Maryland Court singled out pitbulls and pitbulls only...

"Because of its aggressive and vicious nature and its capability to inflict serious and sometimes fatal injuries, pit bulls and cross-bred pit bulls are inherently dangerous."

"The law now says: “When an attack involves pit bulls, it is no longer necessary to prove that the particular pit bull or pit bulls are dangerous.” It applies not only to the dogs’ owners, but to any person who “had the right to control the pit bull’s presence”—i.e., the land lord.

This could have profound implications not just for slumlords, but also for animal shelters, rescue volunteers (and their landlords), animal hospitals and veterinarians."

For Pit Bulls, No More Freebies

What a crock of shit.  People in this country are so dog dumb, it is unbelievable.

I am not a fan of the breed, but the idea of singling out a breed is crap.

Not the people sweet...

The Judiciary did this

FatDomDaddy -> RE: MD Court of Appeals: Pitbulls Inherently Dangerous (4/27/2012 4:32:42 PM)

bad edit...

Judges are people too, FatDom.  People who know nothing about dogs, apparently

DarkSteven -> RE: MD Court of Appeals: Pitbulls Inherently Dangerous (4/27/2012 4:38:45 PM)

This is gonna piss off landlords no end.

Renters generally have no serious assets, so making the landlord share liability in essence gives the landlord full liability.

The law is written so that the landlord either knows of the dog or should have known. That "should have known" implies that a landlord is required to know the presence of a pit, even if the lease is written so that they're illegal.

Placing the burden of knowledge on the landlord, even when the tenant has not informed him/her is just plain wrong.

DomKen -> RE: MD Court of Appeals: Pitbulls Inherently Dangerous (4/27/2012 4:40:48 PM)

The fact is that Pits are unpredictable if not trained properly but that is true for all terrier breeds and more generally for all dogs.

Keep in mind that at the beginning of the 20th century Pit Bulls were considered the best possible family dog, literally nicknamed nanny dogs.

In this issue, sweet, the People's or morse so the People's Representatives have debated pitbull issues in several local Maryland jurisdictions. Pet owners and property owners fought back and defeated several attempts.

Iamsemisweet -> RE: MD Court of Appeals: Pitbulls Inherently Dangerous (4/27/2012 4:49:27 PM)

It is pointless to get involved in these debates about pitbulls, people either believe they are inherently dangerous, or they don't.

You are right on the landlord situation, though, DS.  That is a very heavy burden, and I am so happy that is not the law in my state, based on much court precedent.  The idea, of course, being the elimination of the breed.

TNDommeK -> RE: MD Court of Appeals: Pitbulls Inherently Dangerous (4/27/2012 4:57:15 PM)

But yet German shepherds who ARE trained to attack people are ok. Chows, dogs that constantly are turning on owners and biting the shit out of people are ok. I love all dogs, ALL of them. But to think that the whole breed is dangerous just reinstates stupidity in these people. Also lets not forget the media, they have a great part in this whole thing; hyping up the bad stories of pit bulls who attack. They never highlight stories of pit bull heros. I have pit bulls and have bred them for a long time. None of My dogs have ever been human aggressive. I have said this a million times..IT'S THE OWNER THAT TRAINS THEM TO BE WHAT THEY ARE.

Clearly this is not an issue I can keep calm about, lol.

Ok, just to play devil's advocate:

http://en.wikipedia.org/wiki/List_of_fatal_dog_attacks_in_the_United_States

The Centers for Disease Control and Prevention (CDC) published in 2000 a study on dog bite-related fatalities (DBRF) that covered the years 1979-1998. The study found reports of 327 people killed by dogs over the 20-year period. Using newspaper articles, the CDC was able to obtain breed "identifications" for 238 of the 327 cases of fatal dog attacks; of which "pit bull terrier" or mixes thereof were reportedly involved in 76 cases.

The Government of the Sate of Maryland says they are, no matter what one believes. The ruling will be wide ranging.

That's because they are so fiercely loyal.... and by that I mean fiercely loyal to a fault. They are also highly intelligent and can be trained quite easily and have a calm nature....up until they perceive a threat, to themselves or their pack, and they believe the families and people they live with are members of the pack. But there is a reason, the breed fell out of favor in the latter half of the 20th century.

It fell out of favor because of bad breeding practices and abusive owners.

If we as a society would crack down on dog fighting the financial incentive to recklessly breed Pits and the other fighting breeds would disappear and responsible breeders would continue breeding calm, smart animals that if properly trained are a threat to no one.

yep that is the gubafia MO.

they circumvent DUE PROCESS by making a 3rd party, usually a corporation but now private parties responsible for someone elses actions.

welcome to corruption at its finest. Its been done this way for years all those mutha fuckers sitting on the benches nationwide need to be fucking fired from the supreme court right on down.

They have no authority to demand a corporation POLICE others much less private parties.

SoftBonds -> RE: MD Court of Appeals: Pitbulls Inherently Dangerous (4/27/2012 6:21:26 PM)

Wasn't it pit bulls that the AKC said if you can prove that no violent attacks involved your pit bull, it's parents, grandparents, or great-grandparents you can call it a St. something terrier?
If that is the case, couldn't a lot of pit bull owners who have purebred and gentle dogs get that change and be just fine in MD?
I could be wrong though, maybe it was Rotts.

The thug element and bad breeding were late in the century, the breed's numbers fell considerably after WWII and didn't pick back up until the mid 80's

And those that believe "they are inherently dangerous" are complete fucking idiots -- and likely have never owned, or even been around a Pit Bull for any length of time.

I have TWO, and have had them for over 10 years... smartest, most loving, playful, loyal, and wonderful dogs I've EVER had -- and I've had a German Shepherd, Collie, Chow, Poodle, Lab, and a host of other mutts, as well as a couple cats over the years.  Hands down... Pit Bulls are my absolute favorite breed of dog and would actively seek out a Pitty rescue over any other breed.  Labs would be second on my list... as a breed, they're great dogs as well.

And this new law targets the owner and the person who rents to the owner. It addresses the problem. I applaud it. I'm sick of seeing those damn dogs. Saw one this morning hanging its head out the back window of an SUV that had the most God awful ugliest rims on it I have ever seen.
