Why? This has been semantics from the start. If the bill had said "tax" instead of "mandate," there'd be no legal challenge. It was a fishing expedition, and Roberts stepped in to stop the political spin on this one--he has years ahead, and doesn't want to poison his tenure.

The important thing is that it is not considered legal as part of the Commerce Clause. Had the SC not made that distinction they would have been basically giving a green light too Congress to mandate anything it damned well pleased.

Yes, please, get your news coverage and be told how to think. Dont bother reading the 193 page DOCUMENT. In fact, how many of you can honestly state you have read the Affordable Care Act of 2010? Its when you had the option to do something and failed to do so. You can argue that just about anything affects commerce and that has been the bullshit justification for citing the Commerce Clause in a lot crap Congress has done so I am glad that the Supreme Court has made that distinction. Taxes are another matter. They must be to pay debts, provide for the common defense and the general welfare. "General welfare" is vague enough to allow a lot of bullshit but I think health care falls under that. I don't think "anything" can fall under that.

By Congress calling it a penalty and not a tax SCOTUS avoided the anti-Tax Injunction Act and ruled. Yet SCOTUS stated that the penalty is in effect a tax thus preserving it. All taxes must originate in the House. Obamacare originated in the Senate. Oh, that's right. It's a penalty and not a tax. [8\|]
