Hillwilliam -> Going after criminals. (6/29/2012 8:03:29 AM)

Cops would rather do this: http://gma.yahoo.com/texas-woman-arrested-warning-drivers-speed-trap-160551293--abc-news-topstories.html
than go after people who sayyyyyyyyyyyyy clean out your bank account fraudulently.

ED to fix the link.

I love the use of the i-Pad with the old photo look......[:D]

Marc2b -> RE: Going after criminals. (6/29/2012 8:09:03 AM)

Did you post the right link?

'Cause I don't really understand your point.

GreedyTop -> RE: Going after criminals. (6/29/2012 8:09:35 AM)

edited because it made no sense with the fixed link... LOL

Hillwilliam -> RE: Going after criminals. (6/29/2012 8:11:07 AM)

I fixed the link
It's a bit more sensible now

Owner59 -> RE: Going after criminals. (6/29/2012 8:13:47 AM)

If the point is to slow people down.....what`s the harm?

Is it actually illegal to warn people of a speed trap?

Hillwilliam -> RE: Going after criminals. (6/29/2012 8:17:59 AM)

They couldn't arrest her for that, they arrested her for "standing in the street where a sidewalk was available."

Years ago, a similar case went all the way to the TN state supreme court for blinking lights to warn of a trap.
The justices said that the person shouldn't have been arrested for 3 reasons.

1. Free speech.

2. No police dept has as their purpose "collecting fines" as the person was only interfering with their ability to levy fines, he wasn't interfering with the police.

3. As the police CLAIM they are only interested in safety and when the lights blinked, people who saw it immediately started paying attention and driving in a more safe manner, he wasn't interfering. If fact, he was actually assisting.

Marc2b -> RE: Going after criminals. (6/29/2012 8:23:56 AM)

Okay, that makes more sense.

I like that chick.

As for legal aspect of what she did, I don't know if you can make a case for obstructing justice because the speeders haven't been caught yet. I 'spose you could make a case for aiding and abetting since she is helping people conceal "criminal" activity.

Of course, what the police are actually upset about is that she is interfering with them making their quota.

The local police have no jurisdiction when it comes to bank fraud, it is the FBI who does.

They have jurisdiction when someone steals your checks and forges your signature at the bank to clean out your account.

For someone who has supposedly studied criminal justice or whatever, you're way the fuck off a lot.

tj444 -> RE: Going after criminals. (6/29/2012 8:31:52 AM)

I wonder if in the end, after the courts are done with her, if she will think it was worth it.. personally, i think there are better causes to fight the cops on but not at that level (laws need to be changed instead).. learn to pick your battles..

if a person is speeding, then why should i be their saviour when they made a concious decision to speed knowing the possible consequences? I am not pro-cop, i am actually quite anti-cop, but I also believe that if ya piss into the wind, ya gonna get some on ya.. (that goes for speeders and this chick)..

Lucylastic -> RE: Going after criminals. (6/29/2012 8:33:23 AM)

I would love for Canada to deny any political refugees, or make them get private health insurance. Why should we pay for people who havent paid into the system???

kdsub -> RE: Going after criminals. (6/29/2012 9:17:40 AM)

OK… speeder is stopped and given ticket…whole in bank account is a strong reminder to follow the law…less speeding in the future and just maybe a life saved.

Warning given for no good reason by woman….speeder slows down until past radar trap then speeds up again. Lessen not learned and in the future may cause an accident that kills or injures.

Moral… let the damn speeders get a ticket they deserve and mind your own damn business.

Ok, I agree that arresting her was a shitty thing to do. But seriously, she was pretty stupid to stand out there in the first place. Obviously she knew there were cops around. What did she think they were going to do? She might as well have drawn up another sign saying "please come and fuck with me"

Hillwilliam -> RE: Going after criminals. (6/29/2012 10:39:10 AM)

One of the reasons I posted this is that one of our members (who I usually disagree with btw) is having a hell of a time. Some chick stole his checks and cleaned out his bank account. He knows where she lives and has pointed this out to the cops and 2 weeks later, "they're looking into it".

Forgery of bank notes like check goes under the FBI. It is true the local police may get the intital report, but the FBI takes the case. And your opinion of me...effects me.......How?[sm=biggrin.gif]

Dude, do you want me to scan the police reports where LOCAL PD investigates and makes arrests for check fraud and the LOCAL judge (not the federal in Greeneville) sentences them to the county lockup?

Maybe they do things different in Cali but in the rest of the world, the locals (sherriff and city PD) takes care of such things.

Here's California statute 470PC concerning just the subject.

http://www.shouselaw.com/forgery.html#1

Note, it's not a federal crime and therefore the FBI wouldn't be the investigative agency unless it involves interstate commerce. Now, go back to your circlejerk on the Zimmerman thread like a good little boy.

First off banks are under the FDIC, a Federal agency, and that places them under Federal law. Oh by the way, did you know the checks the bank gives you are not yours, their the banks. You getting like Raiikun looking up things to justify his postion, mostly comments from someone. And we now know who took a grouch pill to day.
PS My Grandmother had her checks stolen, so I do have some knowledge of what you are trying to talk about.

http://www.justice.gov/oig/reports/FBI/a0537/chapter8.htm

And you still did not answer my question, no surprise.[&:]

Google is your friend "police arrest check forger" came up with 2.5 million results.

When you do the same thing with FBI, you find a lot of information but very few arrests and all of those for forgery or fraud regarding checks drawn on the US treasury. (which is very understandable)

Bottom line, personal checks are stolen or forged, it is handled by the local police unless it is a large organized thing (RICOH for example).

Your link told how the FBI investigates bank robberies. when someone forges a check, they are stealing from an individual, not a bank.

In most states yes it is
