Rainey, an employee of Blue Ribbon Steak and Seafood, had just knocked on Roop’s door at 1815 SW 30th Terrace and gotten no response when Roop pulled into the driveway, driving a pickup, according to an arrest report released Thursday.

Explaining his actions to police after the shooting, Roop said he became “more than a little nervous” as Rainey walked down the driveway toward his truck and appeared to have something in his hand.

As Rainey drew within 4 feet, Roop grabbed his 9mm Glock from his pocket and fired once, striking Rainey in the shoulder, he told police. Rainey fell to the ground, screaming, ‘You shot me,’ in what Roop described as an “antagonistic” manner, according to the report.

Roop said he was still in fear and thought Rainey was reaching for something, so he shot Rainey once more in the back of the head, “for effect,” the report said. A company order brochure and cell phone were found near Rainey’s body.

Roop told detectives Rainey should have respected his three “No Trespassing” signs and explained he didn’t warn Rainey after pulling his weapon because, “I’m not going to give him the chance to do something to me; I was in fear.” ...

Seven years ago, Roop pulled a weapon and threatened a power company meter reader who had walked onto his property in Wildwood, south of Ocala, Florida...

Donna Perillo, who lived two doors down from Roop for about a year, said he was known as “the nut job from the block” and had called police several times on neighborhood children playing in the street near his home.

Perillo said the children, between the ages of 4 and 8, would ride their bikes up and down the street.

“He kept saying if they step foot on my property, they’re trespassing,” she said.

Each time, officers came and talked to the man and told him the kids were allowed to play in the street, she said.

What happened next, he said, was horrifying.

“I went to bend over to help the guy on the ground, the victim, and out of the garage I heard something: ‘I’ll kill everybody or shoot everybody,’ Snyder said. "And he cocked his gun and thank God for the Collier County sheriff’s (deputy), she probably saved my life and everybody else’s life that was in the area,” Snyder said.

He said the deputy pulled her service weapon on Roop and ordered him twice to place his gun on the ground before he complied...

He said Roop told the off-duty deputy, as well as the Cape officer who arrested him, the shooting was justified.

“He was telling the officer, ‘he stepped on my property, he trespassed, I’ll kill anybody that steps on my property,’ somewhere along those lines. It was just unbelievable,” Snyder said.


But we must have the "right" to use our guns to protect our property - from door-to-door salemen, meter readers and kids on bicycles riding in front of our house - right?

And if you shoot a door-to-door salesman and he falls on your driveway, don't you have the "right" to shoot someone who tries to administer first aid to the salesman? After all, the person giving first aid is trepassing on your driveway!

I recall a kid from Japan getting shot to death when he mistook the killer`s home for one where a Halloween costume party was being held.

The youngster didn`t speak English and didn`t understand the guy was about to shoot him.

The killer walked.....because he "thought" or "felt" he was in danger.


When I hear the NRA types spout about their rights and how no one can challenge them and they alone know best.......I think about the thousands of Roops out there.......and the hundreds of thousand potential Roops out there.....who`re just a trigger pull away from an archetypal/mythical NRA good-guy to being another criminal, who used a firearm to kill.......like George Zimmerman.


These SYG laws are being abused and are causing innocent people to get shot.


We have 2nd Amendment rights here in Jersey also.......but we don`t get very many cases like the Martin killing.....

What do the people who feel in danger from trigger happy morons do?

Carry guns and shoot any homeowner they see, because they might decide to feel afraid and shoot us?

At what point do these guys get the insanity?

Ok, so he was a nut-job. According to this article, he was a well known nut-job. If he was willing to threaten someone giving aid to the shot salesman, it sounds like he'd been crazy for years and finally snapped. Hell that follow-up shot to the back of the head "for effect" shows he'd clearly lost it. So why is it reasonable to use the actions of a clearly disturbed individual to attack gun ownership and a person's right to protect their property?

My question is, why didn't someone do something before this? He brandished a gun at a meter reader 7 years ago, that's a felony. It sounds as if he's been making threats towards children for years as well. Saying that he has the right to shot trespassers, and further stating that if a child puts one foot on his property they're trespassing. Those threats were also a felony, and/or should have gotten him involuntarily committed for observation. Felons can't own guns, neither can those who've been involuntarily institutionalized. So if he'd been arrested and charged back then, he wouldn't have had a gun to shot this gentleman. Or at least he couldn't have legally owned one.

That being said, I own guns. If I have to use one to protect myself or my family from intruders, I will. That doesn't mean I'm a nut. It doesn't mean I'd threaten kids in front of my home, or meter readers. Door to door salesmen, well.... [8|] (Just in case, that's sarcasm and humor folks. Dark humor perhaps, but humor none the less.)

Maybe he wasn't committed because he shot at the ambulance? He might have thought it was a refrigerated delivery van full of lobster or something...

Ummm, no. I used to live in NJ. They only barely pay lip-service to the 2nd Amendment there.


Regarding the comment about Banning vs. Regulating, guns are already regulated. I can't get a machine gun without going through a massive amount of paperwork and background checks, and even then you can't in many areas. Depending on where you live, you can't get weapons that hold too many rounds of ammo, or are over a certain caliber. Some states you can't carry at all. Others only with a permit that's almost impossible to get unless you know the right people. You can't own a gun if you're a felon, or are crazy. There are any number of restrictions and regulations already in place.

This nut shouldn't have had a weapon to begin with, but he fell through the cracks. He only fired two shots, so no high capacity magazine restriction would have been a problem for him. It wasn't an "assault weapon" or a machine gun. So disregarding the fact that he shouldn't have had one because he was nuts, all guns would have had to be banned to keep a 2 shot weapon out of his hands.


And guns have more then one function as well. I carry a gun for protection, but have never had to use it. I've never even had to draw one in anger. Mostly, my guns get used for target practice.

Besides: people make people fat, not spoons. If spoons were banned, people who want to get fat will just finds another way to get fat. They'll use a fork or improvise a fattening device with some chopsticks instead. A lot of fat people are very clever and will get fat no matter what. Spoon control won't make any difference to that...

I remember reading once about a man in Tokyo, who beat his neighbor to death with a typwriter.  A nutcase killed somebody, and was arrested and charged in the death.  In a related story, I saw a man out walking his dog, draw a gun, and kill a rattlesnake, the other day.

Guns solve every problem and make everyone safe......and if they don`t.....add more guns.....and while you`re at it.....relax or illuminate laws that discourage these types of tragedies.

Right, people are very clever. Even if you managed to get every gun out of the country, people would still find a way to injure and kill each other. They'll just use another device instead.
