NY seals 1st state gun laws since Newtown massacre

Cuomo is going beyond making the manufacture and sale illegal. You have to dump the one(s) you currently own. I couldn't find any reference to this story on CNN. This is usually the kind of thing they have front and center. Glad I don't live in New York. Enjoyed a visit to NYC about six years ago. Always wanted to return for another visit but not now. Can't see spending my leisure dollars in their economy.

I dunno about disarmament, but I wonder about the ex-post facto thing with the magazines......

I am not sure what their constitution says about that in NY.

I'd bet that Remington will sooner than later remove its NY manufacturing to a better climate. NY is just not friendly.

When the smokers of New York get tired of the restrictions put on them, those without guns will use ball bats and the non smokers will still get massacred.

New York (CNN) -- Lawmakers in New York are poised to pass a new set of gun laws intended to fortify the state's assault weapons ban, limit the number of bullets in magazines and strengthen laws that keep the mentally ill from firearms.
If passed, it would be the nation's first gun control bill since last month's massacre in Newtown, Connecticut, where a gunman killed 27 people, including 20 children.
New York's GOP-controlled Senate overwhelmingly approved the measure in a 43-18 vote late Monday night, one week after Gov. Andrew Cuomo spelled out tough new gun control proposals in his annual State of the State address.
Cuomo, a first-term Democratic governor, called for a tightening of the state's assault weapons ban, background checks for people who purchase guns in private transactions and more restrictions on high-capacity magazines.
A Democratic-controlled Assembly, which has been largely in favor of tight gun laws, is expected to pass the measure Tuesday afternoon.The tentative deal would include a statewide gun registry and add a uniform licensing standard across the state, altering the current system, in which each county or municipality sets a standard.
Residents would also be restricted to purchasing ammunition magazines that carry seven bullets, rather than 10. It remains unclear what effect the measure will have on the state's already stringent approach to gun control.
"The changes in New York are largely cosmetic," said CNN Legal Contributor Paul Callan, who described New York's existing firearms regulations as "the toughest gun laws in the United States."
"The one change that arguably will have the greatest impact is the amendment to Kendra's Law, which will permit closer monitoring of the mentally ill," he said.
That 1999 law grants New York judges the authority to require residents to undergo psychiatric treatment if they meet certain criteria.
The proposed measures would extend Kendra's Law through 2017, expand outpatient treatment from six months to one year and require reviews before such treatment is allowed to end. Authorities could suspend or revoke licenses based on those reviews by mental health professionals.
The bill would also create mandatory life sentences for anyone who murders certain first responders, a provision that comes after two firefighters were killed in a shooting ambush as they battled a blaze in the town of Webster in upstate New York.
The vote coincides with a series of recommendations put together by Vice President Joe Biden meant to address the nation's gun violence.
Lawmakers in at least 10 other states are reviewing some form of new gun regulations in the new year.

It doesn't seem to make present possesion of 8+ round magazines illegal. It requires the sale out of state or destruction of said magazines within one year.

NY already limits magazines to 10 rounds so this does strike me as a nuisance change to the law as a 3 round difference in capacity is pretty minimal.

Doesn't matter what their constitution says, it matters what the US Constitutution says about seizure of private property without compensation or due process, and about ex post facto laws.

Folks do realize that there are 8 shot revolvers out there, right?

Naw. Because they make those. This new law. . . you can only have 7 in the magazine and 1 in the chamber. Which means that you have to count the stupid bullets in the 10 round magazine to figure out whether the person is a criminal or not. So, yes, I will mock.

And why they think a nutjob would not just carry seven 5 round magazines is beyond me. Shit, those are even EASIER to conceal.

I believe the law does NOT require you to dump the ones you own but gives you a year to register them and prohibits the sale.. I believe.

As apposed to trying to arm them to the teeth with roto-mags and silencers,to conceal their blood baths better and make them longer/deadlier......like the NRA/nut-jobs are doing....

Why in hell would the NRA be pushing to have silencers legalized?....I meant WTF!?!!

That LEOs have guns..... isn`t a good argument that we should allow 100 round magazines be sold to civilians....


Who the hell do we think is going to have to respond when those hi-cap weapons are breaking another thousand hearts.............like they did at Sandy Hook ?

Actually, is does not. A lot of us that learn to shoot defensively, learn to change out the magazine before it is empty. It is difficult to keep track of shots fired in an intense situation. So you carry extra and change them frequently.

I could understand this if that was how most gun battles these days were "going down." But really. . . these new rules are going to have little to no positive effect on the gun homicides happening.

I am a bit confused on why you think that they shouldn't be. They add nothing to the firearms usefulness (they decrease accuracy and range actually) and yet they do add to the difficulty in concealing it. People can make silencers themselves out of home items. They (silencers) are a great deal safer if they are purchased specially for a weapon. I mean, let's face it, if I want to sneak in somewhere quietly with no sound, I am not going to be using a firearm in the first place for this. There are MUCH better ways. To add to this, our sensor techniques are such that, silencers are just not that. . . really. . . they are not that useful.

Yeah LEOs have guns. How much are LEOs trusted? Not so much. It really does come down to. . . when seconds count the cops are minutes away. SCOTUS has upheld that LEOs are NOT there to protect us and have no duty to do so. So. . . who IS going to protect me if I do not protect myself. I thought about linking some articles of LEOs committing crimes. . . but, that would be petty. After all, they are human as well.

Please, please, PLEASE give them high capacity magazines! PLEASE! Yes, Yes, YES! Do you have ANY idea how often those things jam? Clearing a jam takes longer than seating a new magazine and they are harder to conceal. I will take on the nutjob with the 100 round magazine before the nutjob with the 10 ten round magazines. Please give me the idiot.

It may be different in other countries, but in the US, the police *are* civilians. Was there anything in this law that would exempt off duty cops, or federal agents, etc. from the restrictions? Remember, NY is where they tried to arrest on duty feds for violating NYC's weapons ban.
