Transgender discrimination suit against CO schools - 2/27/2013 2:37:14 PM

It seems that the same battle over which bathrooms transgender students can use has now surfaced in another state.

quote:

(CNN) -- A prominent transgender rights group announced Wednesday that it has filed a discrimination complaint in Colorado on behalf of a first-grader who was born a boy but identifies as a girl.

Last December, school officials at Fountain-Fort Carson School District told Coy Mathis' parents that their child could no longer use the girls' bathroom at Eagleside Elementary.

That shocked her parents, said her mother, Kathryn Mathis.

Coy was born with male sex organs but has, since she could express herself, identified as female. The child had gotten through kindergarten with no problems and no complaints from anyone at the school, Mathis said.

Full story here: http://www.cnn.com/2013/02/27/us/colorado-transgender-girl-school/index.html?hpt=hp_c2

As we've had very interesting debates about such issues in the past, I thought I would post the topic.

Meh I'm surprised that anyone cares about assigned bathrooms at this point, but if we're going to do it I think we need to build one for squirrels as well. I mean we don't want to discriminate against them.

Couldn't the squirrel just use the boy's room. After all, he does have nuts.

It is funny how in this day and age one of the biggest issues trans folks (at least M to F's) face is over restrooms. There is so much hysteria around them, and quite honestly, it is pathetic, because the implication is that if someone with male genitals presenting as female goes into a women's restroom that they are on the prowl for sex. Some of the worst offenders are gay women, I wonder how they would feel if straight women complained if some butch female went into a women's room when they are there, after all, aren't butch women sexual predators, too? (Hopefully people get my point). It is automatically saying that if you happen to unfortunately have male genitals, you are going to be leering at women or worse going to rape them, and that is pathetic. Many women have been so screwed up with they way they perceive sex and sexuality that many of them seem to be walking neuroses.

When I started coming out at work, it was one of the first things HR dealt with (if I had gone FT at work, if the position hadn't of ended, there was an 'executive washroom' with a single toilet in it).I told the woman in HR, who was sympathetic, that you go into the loo to do your business, you wash your hands,, check your hair and clothing and get out.....it isn't exactly a social gathering place. A trans woman was arrested several years ago in NYC for using a woman's room at Grand Central Station (brave person, let me tell ya, those toilets are horrible). some Irish Catholic shithead decided it was illegal and arrested her, even though both NYC and NY State have laws protecting trans people from that kind of discrimination (sad to say, the fucker wasn't thrown off the force). We have such a long way to go when people feel threatened by a 6 year old girl identified trans person. Women's rooms have stalls, and as far as I know, women don't go around naked, so WTF?

The only thing Squirrels need is a shot of rock salt in their ass, they are fresh, and I just won a major battle with them, after they invaded my attic and caused havoc......worse part was, had to use premium peanut butter, they sneered at the discount stuff I used in the humane trap I have.

I'm pretty open to a lot of things, but kids in elementary school? I actually agree with CO Schools - Boys have a Penis and Girls have a Vagina. Use the bathrooms according to those definitions. If you happen to have both - well, then I guess some more thought would have to go into it. But if it's cut and dry - physically you're a boy, then use the boys room.

The problem is that there are two distinctive types of genetic males who present as females:

crossdressers who dress as female for a few hours, get a sexual charge from it, and then go right back to presenting as male, and
transsexuals, who have no desire to present as male and get no sexual charge from presenting as female, and desire nothing other than to become female physically simply because it squares them physically with their own self-image.

The sloppiness of the word Transgender, which awkwardly comprises both types, doesn't help. On Fetlife, I had a spirited discussion with a bunch of transfolks who resented me misusing the terms but could not themselves agree on proper terminology.

Anyway, there is some hysteria from people who think that men will shell out for hormones, makeup, clothing, etc., in a "fake" attempt to appear female, just to get the thrill of being in a women's restroom.

First, I'd like to thank you and the others for their contributions so far.

I admit that I am not the most up to date regarding how these determinations are made. Even in the article two different states (Maine and New York) have two completely different policies.

In this particular situation, currently, this is a six year old. To the best of My knowledge, there are a number of years before surgery is even a possibility. That means that the school district's policy has to look at all of the years until that happens. I can't honestly say that I believe Coy's Mother's statement to the press that there had been no complaints. She may not have been apprised of such complaints, but I don't believe they were non-existent. If there hadn't been, the school wouldn't have changed it's policy regarding Coy.

I have this sneaking suspicion that Mom doesn't want Coy in the boy's restroom because there is a concern of the way the other boy's will treat Coy while using the facilities. (Keep in mind, these kids won't always be in the first grade.) There are a number of schools at the junior high level that don't have doors on stalls to reduce things like smoking and such. A faculty member can't be posted on guard to prevent Coy being picked on by other kids.

When I heard the first blip on this story, My immediate answer was for Coy to use the unisex bathroom or the one in the teacher's lounge. I'm not sure why this isn't an adequate solution.

At the age of 6, I have a feeling that Coy's intentions are not sexual, but gender-related. That is, Coy isn't doing this for a sex reason, but because of the gender. The real issue is the definitions of "gender" and "sex" not being the same. At what point, though, are people going to consider real safety issues? Sure, Coy and those who are truly anatomically of the wrong gender, are not going to be sexual predators in the restrooms of the gender opposite their anatomy. But, is it ridiculous to think that at some point, there is going to be someone claiming to be transgender to gain access to the restroom of the opposite gender? And, forcing a kid to go to the restroom that matches the gender anatomy very easily might end up making that kid a target. I like LadyPact's idea of allowing Coy to use a unisex bathroom, or the one in the teacher's lounge.

I think the idea that at some point someone is going to claim being transgendered just to gain access to the opposite gender's toilet facilities is reaching. A lot. Especially at the elementary, junior high and high school levels. After all, this isn't about a child suddenly showing up one day dressed as the opposite sex saying they are transgendered.

Interesting. I have been going to gay bars since the late 70's and I don't remember a single gay women worrying about the fact that the guys were using the females bathroom. I also seriously doubt this has anything to do with anyone thinking the 6 yr old might be a sexual preditor. Now it might be in other cases, but not this one.

According to the article the school said she could use the boys room, the unisex room or the nurses office, but apparently the parents didn't think that was a good enough solution. I feel sorry for the kid. Before this happened I doubt most of the kids in the school knew she was born male, but after the publicity and interviews they will and I think that will just increase the chance that she will be bullied. And I know I will probably catch flack for this, but I have a problem believing that a 5 year old was really having this kind of gender issue unless the parents had suggested it to her first.

Probably more about bullying and trying to reduce the incidences.I have to agree with those who feel UMs aren`t mature enough to handle this sticky-whicket.

I can see someone in HS doing this. With all those hormones and stuff going on, how is it a stretch to think someone would pull a stunt like that? And, how is it they have to be dressed any differently? Girls wear jeans, sweaters, sweatshirts, etc. I don't see this as an issue at the elementary or jr. high level.

The next thing that is going to pop up are the school dress codes. That isn't going to be a pretty fight, either.

regardless of the child having a penis, using the men's room would probably be uncomfortable for her. and possibly expose her to more teasing/bullying because she is a girl using the boys room. for me the issue would/should be about the child.

Without getting into trying to "type" men who are dressed as women I will add that there have been issues with letting men into the women's room at both of the fetish clubs I've gone to.

My first thought was..... do what a lot of the French do - have unisex toilets.
The French have had them for decades and many places do not have gender-specific toilets.

The next bit I know is going to land me in hot water with many of you.... but here goes -
Along the lines that boi mentioned at the end of their post.... I don't honestly think a child that young would even be having any gender issues unless the parents brought that subject up, and more than once at that.
I have witnessed cross-gender play in many families (including my own two kids) but they have never even hinted at "there's something wrong with my body". Troy loved dolls and My Little Pony and Tanya shunned dolls and preferred to play with toy guns etc. That didn't stop them returning back to "normal" (whatever that is these days) when they started puberty and beyond.
I have also never seen this type of specific gender issue until most kids reach the stage of puberty, or very near, when they are actually old enough and mature enough to express that specific type of concern.
In this case, at the tender age of just 6, I think this boys' parents are putting the words into his mouth. The only time I have ever seen this sort of thing first-hand (as opposed to a red-top snoozepaper or online article) is when the parents were wishing their offspring were of a different gender than they ended up with by natural selection and were imposing their preferences onto the poor kid.
As LP mentioned - there is a reason why psychologists and surgeons wait until a certain age before considering anything along the surgical route.

In this case, if the parents had just accepted for Coy to use the other toilets and hadn't made it public, I doubt much would have been said by anyone at all until it came to the point of the changing rooms for sports activities at a later point in life.
I feel sorry for Coy if it is a genuine case but I strongly suspect that the parents are pushing the female gender thing more than poor Coy is and he is obviously now very confused.
I am also of the opinion that too many "doctors" are using the term 'Gender Identity Disorder' far too flippantly when dealing with someone quite so young because it's convenient.
The same can be said for many other disorders like ADD/HD. Although there definitely are genuine cases (ask any parent who has a child with this), there are are also many that are mis-diagnosed for convenience of unruly kids with lazy parents.
Typical case in point is Jet, son of John Travolta, who had a free choice of gender-specific rooms and toys to play with whilst growing up. By not putting any undue pressure on Jet, he did both, liked the girly stuff for a long while (amidst sneering tabloid press), but eventually ended up very much male.

Before anyone jumps on my case, I have nothing against genuine TG's.
But I do feel quite strongly that using the term "TG" for a very young child is pushing things a bit when the child is probably just following the parents and their wishes rather than it being a genuine TG person.
And that is why I refer to Coy as a 'he' rather than a 'she' at this point.

Coy's a little kid so this seems like it should be a complete non-issue. Furthermore unisex bathrooms seen to work just fine.

That said being a "trans-woman" doesn't mean that the guy isn't sexually interested in women nor does it prevent them from being a predator towards women.

Yeah, only rarely do I get an urge to grab up a girl while she is in full piss spraying and put the stumps to her.

It ain't that sexy.

And never when she is putting her Lincoln logs away.

I read this story a few days ago.I support Equality all the way.The one thing that I don't understand is how did a 4 year old know there was a surgrey out there to make him a girl?I can understand gender identity issues at a younger age but unless the kid overheard the parents talk about surgrey. Now my question is,what is the etihical age for people to have "surgrey"?I ask these questions with an open mind as I am just trying to understand this better?
