I looked at a number of sources, and they all said the same thing. Green was invited into the home and shot in a domestic dispute.


Green knocked on the door at 2 am.
They opened the door for him.
This could be considered inviting him in.
Pinkerton told him to leave and he pushed on in.
That is not kicking the door in but it is forcing entry.
Green demanded that Pinkerton's wife goes with him.
That idea goes over like a lead balloon.
The dispute escalated Green is shot and staggers onto the porch and dies.
The police never said Green was on the porch when he was shot.
Nobody, not the police, not even the newspaper that printed Pinkerton's home address said that Green was unarmed, don't you find that strange?

As to the Assistant State Prosecutor he was able to get an indictment

I am sure you are aware of the concept that a DA can get an indictment against a ham sandwich.

The assertion I made is that the OP report

created a picture that didn't match up to the more recent reports that the people involved knew each other, and that there was something domestic going on.  Kicking in doors, charging, and advancing don't always match up to being dead on the front porch. 

Feel free to prove me wrong on what I actually said, instead of making up something I didn't say.

Air Force Sgt. Matt Pinkerton Fires 2 Fatal Shots at Home Intruder - Now Faces 2nd Degree Murder Charge



In the wee hours of the morning on September 13th, Air Force Sgt. Matt Pinkerton and his wife were entertaining guests at their home when an acquaintance of Mrs. Pinkerton’s came knocking.
It was 2 AM. After being told to leave by Matt Pinkerton, who closed the door, Kendall Green decided that he’d kick it in and force his way into the home.
Matt Pinkerton, having armed himself with his Glock17 9mm prior to approaching the door, then proceeded to discharge two rounds into Green.
Green was subsequently killed in an obvious act of self defense.
But the story didn’t end there, as it should have.

The district attorney’s office has now filed second degree murder charges against Sgt. Pinkerton.
You may be asking yourself under what pretext?
According to the DA, Pinkerton exhibited “bizarre behavior” by grabbing his weapon when an unexpected knock came to his door at 2AM that morning. And, because he failed to call 9-1-1 between the time Green kicked in his door and rushed him, he has now been charged with murder by the state.
Mike Pinkerton, one of the guests and brother of Matt, recalls the incident via Bullets First:

“He (Green) kept coming forward so Matt fired. He rocked backwards and took another step forward at which time Matt took his second shot. He stumbled backwards and fell out the door onto the porch.”
“When the shots were fired Jessica called 911. Matt spoke to the operator; he removed the clip from his gun and the bullet in the chamber. Police arrived within five minutes.”
So what did Matt do wrong when a crazed man broke in his front door at 2am and was after his wife? To me, nothing.
Yet according to the state of Maryland, Matt should have called 911 first and waited for the police.
That isn’t some glib, pro gun caricature of the how when seconds count cops are minutes away. This is the reason he is being charged with murder. It doesn’t help that on top of the lack of a Castle Doctrine Statute the Assistant State’s Attorney, Glen Neubauer, is an rabid anti gunner himself.
Besides maintaining the ridiculous notion that calling 911 while a crazed intruder just smashed his way into your house is the only legal option, Neubauer also claims that even the act of grabbing the gun in the first place is “bizarre behavior in itself.”

As an important note, Mrs. Pinkerton was in no way involved with Kendall Green and a long list of evidence suggests they were merely friends, until Green decided he wanted more out of the relationship, at which point Mrs. Pinkerton ended their interactions.
Thus, it should be obvious that Kendall Green was likely demonstrating irrational emotional and mental behavior the morning he kicked down her door and entered her home.

The Pinkertons have set up a Facebook page in an effort to bring awareness to Matt’s plight against an overzealous District Attorney, who himself is a staunch supporter of anti-gun laws.
Through no fault of his own, Matt Pinkerton is now facing the real possibility of being imprisoned for doing what any self respecting, individually responsible person would do – defending himself, his wife, his guests and his home.
His legal expenses have already exceeded $25,000, plus an additional $25,000 so that Sgt. Pinkerton could be released on bond while awaiting his trial. The family was forced to take out loans in order to make these payments.
So, not only is the State now threatening the freedom of a man who defended those he loved, they are impoverishing him and his family for no other reason than to make a political statement.

How long would you say Pinkerton should have waited before defending himself?
That's right if a citizen defends himself it strikes at the heart of civilization returning to the wild wst.

The state of Maryland says that Pinkerton should have called 9-11. Pinkerton’s lawyer and supporters argue that if he had done that, he, his wife and friends who were at their home at the time would all be dead.
The Capital Gazette reported that Pinkerton, an Air Force Sergeant, suspected that Green had begun an affair with his wife, Jessica Pinkerton, while Pinkerton was posted in Korea.  
Jessica Pinkerton has made no comment, but O’Neill described the relationship as a “friendship.” Green was interested in pursuing more, even after Jessica Pinkerton tried to end the friendship.
Green showed up on Pinkerton’s porch the night of the shooting and refused to leave, demanding to see Matthew Pinkerton’s wife. Pinkerton brought his Glock 17 9mm handgun with him when he went to the door. The men had words, and Pinkerton closed the door.
The police report that Pinkerton then heard the screen door open. Green broke into the front door, breaking the doorframe.

Forcing a door and breaking the frame paints a picture that would seem like cut and dried presumptive self defense, so I'm still wondering what the DA is basing the charges on.

"A man faced with the danger of an attack upon his dwelling need not retreat from his home to escape the danger, but instead may stand his ground and, if necessary to repel the attack, may kill the attacker." Crawford v. State, Maryland (1963).

Forcing a door and breaking the frame paints a picture that would seem like cut and dried presumptive self defense, so I'm still wondering what the DA is basing the charges on.

"A man faced with the danger of an attack upon his dwelling need not retreat from his home to escape the danger, but instead may stand his ground and, if necessary to repel the attack, may kill the attacker." Crawford v. State, Maryland (1963).


Near as any story tells it because Pinkerton didn't call 911.


There is also this
Assistant State’s Attorney Glen Neubauer said Pinkerton could have called the police, and called his move to grab his gun “bizarre behavior in itself.” 
So it appears that a Nos clone is state's attorney

I don't have either but have seen cases like this and the DA doesn't waste time harassing the homeowner.

Your the one that claims suicide

Guy shows up at 2 AM, demands your wife leaves with him.
He ends up dead on your property.
In Alabama the technical term for this is suicide.

As I pointed out earlier in Al Green's behavior would be considered suicide.

Suicide is a medical condition that is found in the DSM you have made a diagnosis so you would have to have a medical license.

Jessica Pinkerton has made no comment, but O’Neill described the relationship as a “friendship.” Green was interested in pursuing more, even after Jessica Pinkerton tried to end the friendship.
Green showed up on Pinkerton’s porch the night of the shooting and refused to leave, demanding to see Matthew Pinkerton’s wife. Pinkerton brought his Glock 17 9mm handgun with him when he went to the door. The men had words, and Pinkerton closed the door.
The police report that Pinkerton then heard the screen door open. Green broke into the front door, breaking the doorframe.
It is not clear whether Green had a weapon on him. Documents state that Pinkerton didn’t see one in his hands.
Assistant State’s Attorney Glen Neubauer said Pinkerton could have called the police, and called his move to grab his gun “bizarre behavior in itself.”  O’Neill maintains: “He has the right to defend himself against an intruder.”
Matthew Pinkerton’s brother, Michael Pinkerton, was there that night. He described the incident to the Save America Foundation.
“The night in question Matt feared for his safety. After closing the door on the gentleman, he [Mr. Green] chose to barge thru and enter the house. Matt told him several times to get out but he insisted to charge forward. Thus resulting in him getting shot.” Michael Pinkerton wrote.
“The press is making it sound as though Mr. Green and Matt knew each other well but that was not the case.”
The Capital Gazette reported that the men had had at least one previous altercation.
The state of Maryland has some of nation’s the most stringent gun control laws in place. Gun advocates, however, are still expressing shock over Maryland’s “call 911” argument in the Pinkerton case.
Pinkerton awaits trial on Feb. 11, 2014, with a status conference scheduled for Dec. 13, 2013.

I refer you to my post #27 were there are links to other news reports that conflict with reports that also have reported. As to the source they are right wing pro gun with an agenda. What I am saying is that there seems to be a some conflicts in reports as to what happened. I am suggest that rather then jump to conclusion, wait for the trial.
