Green showed up on Pinkerton’s porch the night of the shooting and refused to leave, demanding to see Matthew Pinkerton’s wife. Pinkerton brought his Glock 17 9mm handgun with him when he went to the door. The men had words, and Pinkerton closed the door.
The police report that Pinkerton then heard the screen door open. Green broke into the front door, breaking the doorframe.
It is not clear whether Green had a weapon on him. Documents state that Pinkerton didn’t see one in his hands.
Assistant State’s Attorney Glen Neubauer said Pinkerton could have called the police, and called his move to grab his gun “bizarre behavior in itself.”  O’Neill maintains: “He has the right to defend himself against an intruder.”
Matthew Pinkerton’s brother, Michael Pinkerton, was there that night. He described the incident to the Save America Foundation.
“The night in question Matt feared for his safety. After closing the door on the gentleman, he [Mr. Green] chose to barge thru and enter the house. Matt told him several times to get out but he insisted to charge forward. Thus resulting in him getting shot.” Michael Pinkerton wrote.
“The press is making it sound as though Mr. Green and Matt knew each other well but that was not the case.”
The Capital Gazette reported that the men had had at least one previous altercation.
The state of Maryland has some of nation’s the most stringent gun control laws in place. Gun advocates, however, are still expressing shock over Maryland’s “call 911” argument in the Pinkerton case.
Pinkerton awaits trial on Feb. 11, 2014, with a status conference scheduled for Dec. 13, 2013.

I refer you to my post #27 were there are links to other news reports that conflict with reports that also have reported. As to the source they are right wing pro gun with an agenda. What I am saying is that there seems to be a some conflicts in reports as to what happened. I am suggest that rather then jump to conclusion, wait for the trial.


This alone prove how weak the case is against Pinkerton.
You have always before declared the homeowner guilty as sin, but even you can see the case against him has more holes than the Titanic.

Had you paid attention you would have noticed that I pointed out that prior to this you consistently declare the person doing the shooting as guilty and this time you are clearly hoping for something to come out and make Pinkerton guilty.
Don't you remember that it was you who told us that Pinkerton invited Green into the house and then shot him on the porch?
And when you did so it didn't even occur to you that the two half's of your revelation were vitually mutually exclusive.
And didn't that expose your bias that self defense = murder?

At 2am if go to the door unarmed you are asking for trouble.

Does this mean you actually suffer from the delusion that the state's attorney's statements were in anyway not indicative of bias?
And you seem to forget that even the stories that tried to say that Green was shot on the porch quoted him the same way.

Interestingly enough nobody said it was.
Stupid yes.
Asking for trouble, yes.
Creating a good chance of getting you shot, yes.
2 am makes a big difference.

Did I say mental illness? I said he was behaving irrationally. He tried to pursue a relationship with a married woman and was rebuffed. Maybe he misread signals, not irrational in and of itself. I'm guessing that there was probably some escalation, texts, e-mails, calls, that were ignored, although that's only a guess. Then he shows up at her door at 2am, demanding that she leave with him. That's irrational. He was told to leave, instead he breaks in and advances on the husband. That's REALLY irrational.

Under normal circumstances, you don't pound on someone's door at 2am. There are exceptions, car breaks down, accident, need help and don't have access to a phone, but if it were me, I'd expect the homeowner to be wary. If someone is pounding on my door at 2am, I'm going to make damn sure that it's safe before I open up, and I'm also going to be armed.

Showing up at someone's door at 2pm and insisting that their wife has to leave with you is pretty irrational, doing so at 2am just raises it to whole new levels of stupidity.

Now recently there have been many stories of shootings, covered by the media, raising more cries for "gun control" and yet this story was overlooked.

I am sure that the gun control and gun ban supporters will be sure to attack Pinkerton as acting rashly in his attempt to stop the intruder, they might even suggest as the assistant state prosecutor did that instead of grabbing a gun and shooting a man charging him from 15 feet away, he should have called 911.

I am equally sure that someone is going to claim that the deceased's intentions were unknown at the time of the incident.

At this point, the assistant state prosecutor should be removed from office and stripped of his law license for his desire to pursue this case.
