I saw where you brought that up, and I agree... I always suspect a certain percentage of 'feared for my life' claims were more like panic disproportionate to the actual threat. Here, there is so little to go on, that I can plug in either side and guess that the prosecutor will either have a hard time proving what was in the shooter's mind, or will have a slam dunk.
