Since no one is beyond being an asshole, this would be rather self-defeating.

Back in the 'old days' of theater there existed a cloak room. Visiting guests to the theater would give their coats and such to a nice man or women in that area and be given a ticket with a number on it. After the show, they would hand this ticket to nice person to obtain their valuables.

Maybe the answer is to use something from history that was once done away with for being 'old fashion'. Instead, swipe the dust off the idea and place it back within the theater. A room that every guest must pass before being allowed into the theater (tickets, lobby, vending machines, counter, actual theater). They must surrender their cellphones, smartphones and arms, and given a 'ticket'. After the show, they can have their valuables back. If a person doesn't want to give up their prized pistol, they don't need to see the movie with their friends. Exceptions for those in the medical or law enforcement fields might be added. It would be a good idea for a medical doctor to know when he needs to beat feet to the hospital for an emergency, right?

Right, because Dr's are the only people who need to be contacted for emergencies. It's a good thing there aren't any emergencies anyone else can get into while going to see a movie. [8|]

Aren't theaters "Gun-Free Zones?" Could this case hinge on the definition of "excessive force" (which you would think a police officer, retired or not, would understand)?

The jury will figure it out. I'm going to hope the old coot gets a jury that likes going out to movies, but still has more decency in them than the ones that let the killers of Kelly Thomas walk away.

I dunno, the arrest record I posted is legit , or at least it seems to be as many other sites have shown it....
No rebuttals as being false, there are links to local papers. mI know there is more to come out, and a trial.
Lets keep to this topic, youhad your chance at Kelly Thomas, and Manuel.

I doubt the jury will be filled with people who go to a movie and wanna shoot people cos they are being noisy( not what happened I know, I wasnt talking about Reeves.)

If not stand your ground, a defense attorney alternatively could use a straight self-defense argument, Rose said.

Although popcorn doesn’t seem like a serious weapon, throwing it at someone could be considered an assault, Rose said. If a defense attorney could show that the popcorn incident was part of a series of escalating events that caused Reeves to fear more was coming, then there is “a good self-defense argument and potentially a stand-your-ground argument,” Rose said.

On the other hand, Rose said, if evidence shows that Reeves egged on Oulson and was abusive toward him, and that Oulson responded to that abuse, then it’s more difficult to argue self defense.

“It’s a tragedy,” Rose said. “But like most Shakespearean tragedies, we can’t not watch it so there is going to be a lot of talk about it.”

Nocco said the sheriff’s office is looking into the report from the woman who said Reeves confronted her about texting at the theater in December.

“What we’re doing is going back now, our detectives are investigating it and seeing if we can pull video and see is it the same person,” Nocco said. “We’re going to look into this matter.”

Whether it applies in this case or not remains to be seen, but a young adult male hitting a seventy something person in general could certainly fall well within the definition covered by reasonable use of force.

And nothing that a Circuit Court Judge says during intake proceedings is allowed to have any bearing on guilt or innocence. As I'm sure you are well aware.

Sometimes I think you really, really don't get people born and brought up outside of the USA, TH. My overriding thought about this incident is 'Somebody got shot in a cinema, and just for being a pain in the arse.' The secondary thought is 'What kind of insanity led to a situation where someone shoots and kills someone else over a minor annoyance?'

The third thought is, 'Fuck it, this is a mostly American forum and talking about the lunacy of a society in which people legally take guns into cinemas will be a waste of my life. I can't be bothered.'

Absent fear for his life - the 71 will go to jail.

Throwing popcorn would count. Spitting would count. Sucker punching an old man in the head with the hand holding a bag of popcorn would count.
