EXACTLY MY POINT, especially the second case you cited. If sexual activity is not involved, it's not prostitution. Any Pro-Domme with brains should know better than performing sexual services.
If hitting people for fun is a considered a sexual act, then every martial arts dojo and boxing gym would be equally guilty. I know from personal experience training in martial arts the adrenaline and endorphine rush (and pleasure afterward BECAUSE of them) is very similar.

Quoted from your first link: "...in New York, there’s a nifty case, State v. Georgia A., 621 N.Y.S. 2d 779 (1994) which held explicitly that “sado-masochistic acts such as foot licking, spanking, domination and submission do not appear to fit within category of “sexual conduct” referred to in prostitution statute.”

This case got some news coverage:

I'm playing around this morning searching for a state by state list, so far no joy.

A Findomme, by definition in most US states, is a prostitute (specifically if there is money exchanged explicitly for sexually purposed touching of buttocks, breasts, or genitalia).

Given that clear legal definition, you may as well ask the same question of the local prostitutes in almost every mile of every town in the US.

It's pretty clear what they get out of it. But I'll let you figure that out.

In most cases, there is no sexual touching by the findomme. Often, they are never in the same room as their subs/slaves. Therefore it does NOT fall under prostitution.

I'm neither a finsub nor a findomme, so don't have a horse in the race, but prefer truths to fiction.

I personally have always felt that Findomme's were con artists or men pretending to be women to get gullible subs to send them money yet despite the fact that this site has a warning "Don't send anyone money for any reason." people still do it.

ChatteParfaitt -> RE: Why are you a findom or why do you seek one? (2/10/2014 7:23:26 AM)

Since I said this:

In most US states, a pro or fin dom is breaking the prostitution law, it doesn't matter that there is no actual sex involved. It's considered a sex crime. I'm referring to those who meet face to face, I seriously doubt the internet laws have advanced to online fins or pros.

I am confused on what you're arguing about. I never said it was illegal everywhere. It's obvious from a quick perusal of the web that laws vary from state to state, and that some laws have been challenged (my second post).

If the law has been challenged, it was on the books as the law and some police person interpreted what was done as illegal, no?

If you just want to argue with me, alrighty then. I never made any blanket statements to begin with.

There are many online cons, pretending to be a pro or fin domme is just one. There wouldn't be people pretending to be them if there weren't some legitimate pros and fins to begin with.

kalikshama -> RE: Why are you a findom or why do you seek one? (2/10/2014 1:42:42 PM)

K, my recollection is that as a Fin Domme, you do not have physical contact with your clients and that the other Fin Dommes who have participated in threads here are the same - is my memory correct?

ChatteParfaitt -> RE: Why are you a findom or why do you seek one? (2/10/2014 1:49:05 PM)

If there is no physical contact, I can't see how it would be illegal, but a police officer would make a determination according to how they interpreted the law. Here in the Bible Belt an arrest in that instance wouldn't surprise me.

I think it's great people are willing to challenge the law when they are arrested, but how many are willing to do that?

The main purpose of my post was to let people know that just b/c you don't have sex doesn't mean the law doesn't consider what you are doing illegal. Again, in the US it varies by state. I'd love to find a list, but my Googling skills aren't up to that it seems.

kalikshama -> RE: Why are you a findom or why do you seek one? (2/10/2014 5:06:18 PM)

Yes, the woman in your Chicago example was at a tremendous advantage being a former undercover officer herself.

MissImmortalPain -> RE: Why are you a findom or why do you seek one? (2/10/2014 9:51:29 PM)

I am just going to go ahead and quote myself because I said this once but I guess no one read it....
'As to the topic of its legality. Findomming is not considered a form of prostitution. Because it is often coupled with a blackmail fetish. When the two are combined it is considered a from of extortion. Extortion is illegal and carries some rather heavy fines. Findomming that does not involve blackmail is not considered "illegal" as long as it also does not involve sexual contact of any form" I don't know and can not speak for any of the ladies here but I personally have met, and on more than one occasion lived with, the men I have financially dominated. Some of us really do meet them irl.

ThePrincessKali -> RE: Why are you a findom or why do you seek one? (2/11/2014 2:44:46 AM)

Quite a while ago I had a sub whose sole enjoyment was to take me shopping and to get my nails done. His only request was that I demand he buy me things or pay for my manicures and pedicures rather than ask. He never gave me cash he just bought me what I told him to. That is financial domination in it's purest form IMO. So how would anyone charge me for prostitution for doing that?

MissKittyDeVine -> RE: Why are you a findom or why do you seek one? (2/11/2014 2:47:52 AM)

Absolutely no contact. I make it very clear that clients are not to touch me and that there is no sexual activity or contact in sessions. I don't even show my body in cam sessions.

This is correct, as a fin Domme. Now as a pro, I do have physical contact such as paddling, whipping, etc. but no sex. I wouldn't even say "sexual" it's more humiliation and pain lol. I'm married, my hubby would kill me.

I'm the same way as Kitty. I don't show my body like that.

FinSubCA -> RE: Why are you a findom or why do you seek one? (2/13/2014 12:02:59 PM)

For me, FinDomme is just a kink where She dominates and controls your money.

OK, you seem like a nice enough fellow, but excuse me if your profile did made me giggle. You have never verified her identity via webcam, nor heard her voice but you heard the voice of her HUSBAND? (Most likely the fella scamming you out of your cash). May not be the case but sounds like classic catfish and you're easy prey, no offense. :)

I don't mean to talk about me on this thread, but since you did ask me, I'm a church goer and I have faith in people.

Apparently financial domination is what you want, given that your user name is a virtual bull's eye. Just saying, not judging your choice. I didn't peek at your profile, and I don't need to to tell you what I'm going to say.

Being a churchgoer does not mean parking your brain at the door. I was once one for many years. GoddessManko and I are nonfin-Dommes, and she was trying to give you a head's up. Your faith should also tell you that people enter your life to deliver timely messages. Please consider mine a witness to hers.

You can do what you like with your discretionary household income. You are, nevertheless, obliged to be a responsible steward for your family and not to put yourself in a position that will jeopardize this function.

You can also decide to have faith in whatever and whoever you want. There is such a thing as blind faith, and there is only One who deserves it. You know exactly what I'm talking about. Remember the directive that as a believer you are entrusted to exercise the Power of Discernment.

Like I said, I'm not here to judge you or anybody else. That isn't my place. I may not condone what a couple of friends of a friend of mine do, and I say so to their faces (not so much about the money, but as to compromising themselves as being Dominant women by catering to their fin-slaves, instead of the other way around).

Get your money's worth. Don't be foolish. A fool and his money are soon parted. If you don't know who you're dealing with, whether this is even a female and/or whether she is a real Domme, or some unknown entity out to scam you and perhaps ruin you financially, possibly resorting to blackmailing you. You would be participating in a crime as a victim who recklessly assisted in setting himself up, and as such outside the purview of kinkiness. What good are you if you so gullibly let another gain access to your private household information? Get a handle on permitting your carnal desire nature to rule your life to your detriment and to the detriment of others.

It's not my intention to hijack this thread but you did address me directly. First, I don't let anyone have access to my private household information. I deposit money into Her Paypal account (although we pretend it is a joint checking account). Secondly, the emails She writes me is of a different personality than Her husband, who calls me. After reading your post I decided to ask for verification that it is really Her. Thank you. :)

Missokyst -> RE: Why are you a findom or why do you seek one? (2/13/2014 6:03:31 PM)

Ok... let's say that the fin dome is really the so called husband in this case.  Would it really matter?  Does it matter if it is someone catfishing for cash, if the intended victim is getting what they want from the deal?
I don't think so.
People watch reality TV all the time with scripted plots, yet they believe everything they see.
They get the crap they want, even if it is bunk.

Trust God but Tie Up Your Camel...

This means that even if we have a deep-seated faith in a Higher Power, we must also do our part and assume responsibility for our lives and circumstances. While our spirits our nurtured by our faith in divine protection, we must be open and receptive to the earthly guidance it produces while remaining grounded in good old common sense.

We can assume that the ideas and options that are available to us to tie up our camels are provided to us by the Creative Intelligence to protect us. For example:

- Most of us don't anticipate illness or accidents, but we still do our best to have health insurance coverage.

- We don't expect a mishap on the road, but we still buy auto insurance. Yes, it's required by law, but wouldn't we buy it even if it were not mandatory?

- We may live in a wonderfully safe neighborhood, but we lock our doors and secure our windows when we leave. We have home and car alarms.

- When it comes to our physical and mental health, more and more people are tying up their camels with proper nutrition and supplements, the right exercise, eliminating harmful habits like smoking.
