The police officer would be fired and be facing charges.
A: failure to identify a person in distress
B: Use of force when it was uncalled for
C: such force resulted in death

What planet is it, where this would happen?

Quit making up nonsense.

Police officer fired for shooting unarmed black man.

http://usnews.nbcnews.com/_news/2014/01/27/22470918-new-grand-jury-indicts-charlotte-police-officer-who-shot-unarmed-man

http://deadspin.com/unarmed-former-florida-a-m-player-shot-dead-by-police-1324208727/1510894381

Ferrell, a former safety at Florida A&M, had recently moved to Charlotte, gotten engaged, and was working two jobs in retail when he drove his car off the road around 2 a.m. After kicking out the rear window and extracting himself from the car, he knocked on the door of the first house he saw—and the woman inside called police, saying a black man was trying to break into her home. Kerrick was one of three officers who responded. A dashboard camera in their patrol car captured what happened next:

What they saw, according to people who have seen the video, was a 24-year-old man who was approaching officers with his hands outstretched. In the confusion, it is difficult to discern whether the bullets or commands from the officers came first. Either way, according to one lawyer who has seen the video, there was little time for Mr. Ferrell to respond.

-----------------

Ferrell's family said they were grateful for the indictment.

"Shooting an unarmed man 10 times can never be justified under these circumstances," the said. "We will persevere in our quest for justice for not just Jonathan, but all law abiding citizens. After all, what happened to him that night could happen to any of us."

Kinda like this message board, one set of jurors did not think the officer committed a crime.

Can you imagine being a young black man in the south knocking on someone's door at night seeking help?

LadyPact... I am doing fine... I am getting younger and better looking what else could I ask for in my imagination.

I think a way for you to look at this is... what would you do... Would you leave the safety of your home knowing the police were minutes away to confront an unknown in the dark?

Butch

Yeah. In most white neighborhoods, somebody would call 911 for you. What I don't have to imagine is what it feels like to be a young white kid all alone at night in the middle of a tough black neighborhood. That by itself constitutes "needing help." But leave it to you to drag race into the thread. I mean seriously, is this kind of shit a hobby of yours?

A lot would depend on demeanor. And which neighborhood.

In my neighborhood:
If the kid was wearing a hoodie, saggies, and attitude the response would be to call law enforcement and stay behind locked doors.
If he looks like a working man; dad would step outside with the cordless phone and let him call for help and render any assistance that he could. Mama would probably offer him something to drink while he waited.

About three miles towards downtown, the kid would get rolled.

If it were the gated community where all the lawyers and doctors congregate, the private security would have the kid face down on the grass and in flex cuffs if he couldn't name who sponsored him into the closed community.

My neighborhood really hasn't hanged demographics a lot since 1969. Most of my neighbors are nurses, police, firefighters, junior tellers at a bank. But most of the residents of the neighborhood sport a congenital suntan these days.

The only thing about the racial mix that galls me is the under 20 crowd that has made it fashionable to speak in ignorant field hand mushmouth dialect. I guess shocking your parents by sounding just like what the stereotypes perpetrated by the racists of yesteryear is the idea. At least that is my hope and the kids aren't really as ignorant as they sound.

In the last three months I have helped 4 people who broke down near my house, three black, one white.

I'd say 4 bullets in the gut told him he was not wanted...but asking what he wanted at the door could have made a difference don't you think?

Turning on a porch light may have helped... don't ya think

Saying he was calling the police may have helped ...don't ya think.

Staying in the house and waiting for the police may have helped... don't ya think

And just in case you missed the following...

I don't care what time of the day or night no one should be killed for knocking on a door

Butch

Did all 4 bullets go into the chest? I only ask because an hour ago you posted that you were not sure if all 4 bullets even hit the guy and now you not only know they did but you know where they hit.

Isn't there some onus in the USA on the defender to acquire a minimal level of knowledge and use some rudimentary reasoning powers before shooting someone? I mean, for instance, having a torch properly to see what's out there in the dark, and possibly intruding into one's home, along with having a gun to shoot at it?

I look at it this way... he must of had plenty of light to have hit his target 4 times... If he didn't hit his target every time... then he is lucky the rounds he missed with did not hit the next door neighbors house and kill another innocent person.

You do realize that Hendrix voluntarily left the safety of his home in order to confront the old man. Literally, the old man would not have been advancing on anyone with his FLASHLIGHT if Hendrix had simply opted to stay inside his house - safe and warm. Hendrix's stupidity has resulted in MANSLAUGHTER. Explain to me why he should not have stayed in his house? Obviously when he confronted the old man, the old man was not at the door (otherwise how did Hendrix even get outside). I suspect the old guy was just wandering about the property - in other words ZERO threat to someone if they just stay indoors and wait patiently for the police.

This shooter was NOT in fear - he was just impatient. And I'm sorry, but our laws should not protect that. He is guilty of MANSLAUGHTER. I hope he can live with his conscience. He takes away an innocent person's life and gets off with NO PENALTY, other than having to give a meek apology to the victim's family. How lame. Hendrix is morally vacuous.

I went back to the links for this.

quote:

At least twice, Mr. Westbrook climbed onto the small porch, tried to open the door and rang the doorbell, Sheriff Wilson said. Dogs were barking. The police were called.

quote:

“Westbrook never verbally responded to Hendrix but began to advance towards Hendrix in what Hendrix described as a quick and aggressive manner,” Mr. Franklin said. “Hendrix could only see a silhouette figure carrying a cylindrical object in his hand but could not make out anything else.”

This is just Me, but a silhouette figure is at least going to show a rough size of a person. Grown man, rather than small child, so the rhetoric about how it could have been a five year old isn't productive.

Knowing how I see in the dark (which isn't great) I doubt I could have determined a man's age or that he had an illness. That's just being honest.

My point was at the time that Hendrix went outside, Westbrook was NOT on the porch. So why does Hendrix need to go outside at the point. If he could have waited 5 minutes, Westbrook probably would have just wandered off. I really feel some patience would have resulted in one less senseless death.

I don't entirely disagree with you, and I'd have stayed inside too under different circumstances, by which I mean if I was alone. But having my wife or child in the house changes the calculation. I don't know who this guy is, I don't know if he's armed, I don't know what his intentions are, but if something's going to happen I damn well want it to happen outside, not inside.

So you step outside thereby running the risk that the other person SHOOTS YOU FIRST, and then goes and attacks your wife and child????? Sure, that makes a lot of sense. The safest place for Hendrix and for you would be TO STAY IN THE HOUSE AND WAIT FOR THE POLICE. I am not oblivious to the risks involved here, but the most prudent thing to do is to stay in the locked house and wait for the police. That is what I would have done. And if I had others with me, it would be what I would encourage everyone else to have done, too. Why would I leave the safety and comfort of my home at 4 a.m. to confront someone who might be armed and if they are a better shot than me, shoots me first. How exactly does that keep me and my family safe. The only way Hendrix could have felt he was safer to go outside leaving his gf alone in the house is probably being aware that the man was old and unarmed. Otherwise, no rational person should leave the safety of the house when they are aware that professional armed help is on the way. Leave the determination of the danger of this individual (and the risk of error) to the police. Why take it on yourself when there is no need and it actually makes things less safe for your family???

In a worst case scenario, nothing could be less safe for my family than him getting inside.

And you underestimate my skills.

You missed my point thishereboi... I don't know where all 4 rounds went...as I said before if he hit this man all four times, we do know 4 shots were reported as fired, then he must have had good light. Remember others were saying how it was dark... he could not tell what was in the mans hand...he couldn't tell he was an old man...etc. If he missed... then where did the missed rounds go? They could have went into a neighbors house and killed another innocent. They didn't of course be he could not know they wouldn't. But it did not stop him from being irresponsible and blasting away.

As I stated before here in St. Louis we hear almost every week where an errant round fired hits an innocent. This mans actions were irresponsible and bordering on criminal and the result is a dead sick innocent confused man. The only thing that gets me are supposedly responsible gun owners supporting his actions as responsible and resonable.

The question is not my estimation of YOUR skills. The question is how can you possibly assess the skills of the person who is outside? All of you claim that Hendrix could not know how old the person was, or if he was armed BUT YOU CAN ASSESS HOW GOOD HIS SHOOTING SKILLS ARE?? Wow that's damned impressive.

With two people on the inside and a gun, I'm sure they could have shot him down cold if he had actually managed to get into the house. Breaking into a house actually takes a little time. And as for your skills, are you seriously saying you are not a good enough shot to shoot him as he gains access to the house? That the only way your shooting skills work is if you go outside in the dark and hunt him down when he isn't actually a threat. Then your skills aren't so great.

Oh my gosh, that made me laugh out loud. Something I didn't think this thread would be able to do!

But yes, that appears to be law we are now enforcing.
