ORIGINAL: WhoreMods Penalising illegal immigrants working for a fraction of minimum wage accomplishes nothing. Bankrupting an employer or two who pays them peanuts to do so with legal fees and punitive fines, or even confiscating their business as the instrumentality of a crime would have a lot more impact. What happens to a confiscated business? I expect they do the same thing they do now, sell off the assets and/or sell the business as a going concern.. Is that what they do? Who do they sell it to? What happens to all the (legal) people that used to work there? quote:
Of course a well-advised business would put another business in between (such as a labor/employment company that hires/fires employees, etc) and have the assets in yet another company, making sure that the corporate veil can not be said to have been pierced.. its called bulletproofing yer assets.. So, confiscating the business might not actually work? quote:
I read about one business that hired a homeless guy and gave him a job, turns out the docs he was told to sign made him the president of the (shady) company so when the govt came knocking & attempted to hold those in charge accountable, the real principles/scum were apparently not known.. I don't doubt there are shady fuckwits out there that will do whatever they can to lie, cheat, steal, and have a scapegoat. I'm just as sure that there are more legit companies that don't. If the govt seizes the business & sells off the assets then I guess the workers are outta jobs.. you dont really think the govt is gonna care about the workers if they can get their grubby little paws on assets & anything they can get, do you? The govt wanted to seize a hotel from the owners using forfeiture, they didnt give a shite about the owners, the workers or the people living in the hotel, they just wanted the asset/hotel so they could sell it off.. the institute for justice helped the owners fight the govt trying to steal it from them.. I think it depends on how things are set up & what the business can prove vs what the govt can prove.. I recall walmart hired a company that hired 345 illegal janitors in 33 stores & they got in hot water over that.. Originally they lost & they were supposed to be fined 11million but they appealed & it sounds like walmart eventually won, for the most part.. this case went on for 9 years.. http://articles.chicagotribune.com/2012-08-09/business/chi-walmart-wins-appeal-of-immigrant-janitor-case-20120809_1_wal-mart-stores-wal-mart-works-wal-mart-spokesman
