So you don't meet the qualifications of being in the Federal or your State militia?

FirmKY

michaelofGeorgia,

FirmKY seems to be a bit dense tonight.  He keeps insisting that Monkeyboy has called up a standing militia (by, according to his source material, getting permission from Congress) and we are all part of it.

I keep asking him for source to prove the existence of said militia, but he refuses to provide any evidence to prove the existence of any such thing.

I suspect if we just agree that there is a militia and Paul Revere will come riding into our town screaming "The British Are Coming" he can go beddy bye.

1.  Do you meet the qualifications for one of the militias as defined by 10USC311?

No.  I do not.

The President has not called a standing militia into being.

Next question?

The militia exists.  Always.  Whether or not it is called up for active duty is another issue.

If you meet the requirements: able-bodied, 17 to 45, and aren't one of the exempted classes - you are automatically a member of the unorganized militia.

Again:

Sec. 311. Militia: composition and classes
    (a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
    (b) The classes of the militia are--
        (1) the organized militia, which consists of the National Guard and the Naval Militia; and
        (2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

Let me make clear ... The militia of the United States consists of  all able-bodied males ...

So ... whether or not you wish it to be, and just because you aren't a member of the organized militia ... you ARE a member of the unorganized milita, which is an armed force of the US government.

I will grant you, that I might have been confusing in my first post, when I cited the part about the calling up of the state militia during times of insurrection.  But, regardless, if you meet the qualifications of a member of the unorganized militia otherwise ... he IS your CinC.

I'm guessing that being openly gay disqualifies me.

No.

As far as I can tell, being gay is no disqualification.  As long as you stay a member of the militia, and not a member of the regular Armed Forces of the US.

Your assurances that something is true is really not worth the paper they are printed on.  Please provide the source material stating an unorganized militia exists.

The last one you provided stated that the President had to ask Congress to authorize formation of an organized
militia.  I do not recall the President doing so in over a hundred years.

No hurry.

Simply restating your insistence that if said militia existed, I would be a part of it, is being obtuse.  I will grant that if a militia existed, I would be a part of it.

I mean this in the same sense that if the tooth fairy existed, I would get a quarter for the wisdom tooth I had extracted last year.

This came up in another thread recently, and the rates have rocketed. Kids are getting five bucks a tooth now!

There doesnt even have to be a militia in order for us to be in it, dcnovice.

Sinergy

p.s. When he says disorganized militia, maybe he is referring to the bandana wearing and armed people driving around many cities shooting at people?

Militias

You do know how a url link works ... right?  If so, then you'll notice this is the exact link I gave you in my first post on the subject.

One more time.  Try to keep up.

1)  I agreed that if a militia was called forth, by your link, I would be a part of it.

2)  I pointed out a militia has not been called forth.  Since one has not been called forth, it is not physically
possible for me to be part of it.

"Congress was empowered under the Constitution [Article 1.8.15] to call "forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions." Also, under the Constitution [Article 1.8.16] the Congress shall have the power "to provide for organizing, arming, and disciplining the Militia, and for governing such Part of them a may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress." If this Federal power of organization was used to reduce or disarm the Militia, then the power of the state to furnish security and freedom would be diminished."

2)  A militia has not been called by the appropriate governing body (Congress) which is empowered by the U.S. Constitution to call one.

3)  I agreed that Monkeyboy is the Command In Chief of a well-regulated militia as established by Congress.  Since Congress has not established one for me to be a part of, he is not my Commander In Chief.

Since you refuse to comprehend the Constitutional provisions (Article 1.8.15) I have provided for you several times, I am done discussing this with you until you decide to educate yourself as to Constitutional law in the United States works.

One can lead a person to knowledge, but one cannot make them think.

Enjoy your evening, FirmKY.

Not until the Unorganized Militia is federalized, before that happens, they need to be called up and integrated into the existing organized militas, which for those who agree with the Dick Act, is pretty much the National Guard.

Until then? The Elected Officials of the United States CONTINUE to be Our Bitches.

And they better shape the fuck up.

Perhaps, LD.

I just try not to let 'em get my goat, not get angry, and let them show their own .... inability to face reality and facts.

It's fun to watch them twist and turn, trying to prove that black is white, and day is night.
