SilverWulf -> VT victims families should sue state of VA (4/21/2007 6:03:27 PM)

The legislature in VA stopped a bill last year that would have allowed qualified persons to be armed on college campuses.

Many of the victims at VT could well have been saved if just one person had been able to stop the rampage.

But, nobody could, since the State disarmed the honest and law abiding people and took away their right to self defense.

Would certainly be an interesting law suit if anyone has the balls to do it.

i totally agree with this!

It would be, but I can see already, rather than that, more gun control laws being proposed. Not to mention I have a feeling that some of the victims families will more than likely attempt to sue the gun manufacturers. Misplaced blame...

I'm afraid you are right.

I am fairly confident that any proposed bans that make it out of congress would get a veto.

We shall see.

I would be really grateful if people on both sides of the gun-control debate would refrain from using a still-raw tragedy as an opportunity to score political points.

The constant blathering of gun control/ban supporters is already all over the news and has been since the event was still unfolding.

Whether you like it or not, the debate will be carried out and opinions will be expressed.  There is a little red X in the upper right corner of your browser window if you don't want to participate.

The gun industry gained immunity from any product liability resulting from the criminal actions of gun users in 2005 with the Protection of Lawful Commerce In Arms Act.

selfbnd, thank you for pointing that out.

Actually, they should sue shit like no child left behind and the laws that allowed insane and profoundly retarded folk to mainstream----------

that is what is criminal.

i am sure they will sue based on the fact that after the first killing that the student population wasn't notified immediately.

Ok....I don't post much on here.  First of all, I live in VA and I have a concealed carry permit.  Why exactly couldn't the students or faculty of VT do so as well?  Maybe I'm missing something.

SilverWulf -> RE: VT victims families should sue state of VA (4/21/2007 7:06:49 PM)

Originally it was against school policy to be armed on campus, even with a valid CCW permit.  That rule was challenged and upheld by a VA court.  Shortly after, a bill was introduced in the legislature that would have over-ruled the school rules, but it was never allowed to come to a vote.

DragonXPhoenix -> RE: VT victims families should sue state of VA (4/21/2007 7:14:43 PM)

Hmmm....ok.  Yes, I was missing something.  I didn't realize this.  Perhaps you are right.  I have a few further questions though.  Is VT a private institution?  Meaning, if they are, shouldn't they be allowed to write this into their policies?  I realy don't know, perhaps they are a public entity?

DragonXPhoenix -> RE: VT victims families should sue state of VA (4/21/2007 7:23:34 PM)

Ok....I thought about this some more.  First of all, the 2nd Amendment has been so deluded that it is no longer a federal issue....meaning, that it's really interpretted state by state.  For example, NJ vs MT.  As much as I may not agree with this reality, the bottom line is, if it was such a show stopper for the student or staff of VT, they should have went somewhere else.  Sorry, it sucks...but that's just how I feel about it.

SilverWulf -> RE: VT victims families should sue state of VA (4/21/2007 7:24:30 PM)

Private institutions are, and should be, allowed to institute their own rules of course.  As to VT being private, I do not know if it is or not.

The sticky part arises out of the VA State legislature not allowing a bill that would have allowed concealed carry on campus to come to a vote.  The State injected themselves into the situation and removed the right of self defense, in my opinion.

IF the rules had never been challenged in court.  IF the bill would have never been introduced, and IF VT is a private institution, the State would have no liability.

Since the rules were challenged in court and the State legislature did not allow the bill to come to a vote, the State does hold part of the liability bag, regardless of if VT is a private institution or not.

kittensmailbox -> RE: VT victims families should sue state of VA (4/21/2007 7:25:16 PM)

The state can not be held responsible for what one person did.... How is suing going to bring back the love ones they lost... The laws need to  be adjusted for the times... Sadly maybe now ppl will listen...

SilverWulf -> RE: VT victims families should sue state of VA (4/21/2007 7:28:56 PM)

I am not saying the State should be sued because of what the shooter did.  I am not trying to take any of the blame away from the shooter, he is fully responsible for his heinious actions.

What the State is responsible for, is taking away the right of the students and faculty to defend themselves effectively.

DragonXPhoenix -> RE: VT victims families should sue state of VA (4/21/2007 7:29:52 PM)

Wow...I was just about to back out of this, but...hmm.  True, lawsuits will not bring anyone back, but you are right....the laws should be adjusted.  The current laws keep the honest citizen honest and the criminals are enabled to do what they must.  This is unfortunate.  We should repeal many of the laws concerning gun control, because the evidence shows that they are ultimately useless in preventing violent crime.  So...in a sense we are in agreement.  Yes...sadly...maybe now people will listen.....

dcnovice -> RE: VT victims families should sue state of VA (4/21/2007 7:30:09 PM)

According to the VT website, "Virginia Polytechnic Institute and State University is a public land-grant university serving the Commonwealth of Virginia, the nation, and the world community." The governor appoints the board of visitors (directors?).

kittensmailbox -> RE: VT victims families should sue state of VA (4/21/2007 7:35:47 PM)

OK, so you are saying that things would be so much better if EVERYone had guns????  again, this makes no sense at all....
