Its dead easy for employers to get round employment law if thats how they intend to play it, dont worry.

It was decided by my former employer that they didnt want a TS in the office, even though that person had not only made the company successful but also rescued it from bankruptcy at one point. Dismissal was out of the question - against the sexual discrimination laws. They tried to encourage this person to leave - tried to cut the salary, remove the company car etc so they couldnt afford to work there anymore. Then they reassigned this person's duties to that of clerical support from being general manager of the whole place. None of it worked.

Then they came up with a master stroke - gross misconduct which could neither be proven nor disproven.

Never mind, I got three months' pay whilst suspended and full use of the car and fuel card for that period. Just what I needed for setting up the company that has since fucked these assholes every which way since. Yov gorra loff.

The Pregnancy Discrimination Act is an amendment to Title VII of the Civil Rights Act of 1964. Discrimination on the basis of pregnancy, childbirth, or related medical conditions constitutes unlawful sex discrimination under Title VII, which covers employers with 15 or more employees, including state and local governments. Title VII also applies to employment agencies and to labor organizations, as well as to the federal government. Women who are pregnant or affected by related conditions must be treated in the same manner as other applicants or employees with similar abilities or limitations.

I guess you completely missed the part of my post that stated we did try to go after them, but no lawyer would take on the case because it is difficult, if not IMPOSSIBLE to prove she was fired for her pregnancy, espceially with the company making up boldfaced lies about the reasons she was terminated.

D&td, you are hoist by your own petard...

'Sorry' in that context is clearly a conversational device, a mere figure of speech, not an apology, and certainly nothing approaching an admission of wrongdoing.

Lack of empathy is one of the DSM criteria for Aspergers... so criticisms of someone with Aspergers for lacking empathy are especially ironic.

That is guidance on how pregnant people are handled on the job, not whether they are fired, which again in a fire at will state isn't going to help unless you are a protected class (i.e. if you aren't a protected class, you probably won't be successful in a lawsuit, which is what you said she'd be stupid to not do).

And this is something I touched on in the aspergers thread. We get accused of lack of empathy and when we notify people that there is a REASON (not an excuse but a medical REASON) for that trait, we get blasted for using it as an excuse.

Go figure.

I guess paranoid schizos are just using their illness as an "excuse" to hear voices.It's TOTALLY within their control, right

LOL, my aunt knows exactly what I think of her...remember, I'm blunt...I've told her tons of times. "Gee if you would have gotten an education, you woudn't be a 55yr old waitress would ya?"

But all that aside, a debate is a debate,and though I get involved in them, I don't take them that seriously. I may be arguing with you, but it doesn't mean I have a lot opinion of you and you're still alright in my book :)

Nobody is criticising Geeky for lacking empathy - I just don't see why you need to use aspergers as an explaination/excuse etc when a few posts before and after she was criticising people and saying she lacked empathy for the reason for being unemployed - including syndromes and medical/mental issues.  Its just a double standard.
 
Why not say I just lack empathy?  Why add the caveat of 'because of Aspergers'?
I am a bitch sometimes because I am just a bitch.  I am not going to turn and blame it on anything else, or use something as a caveat, no matter my mental health - which is exactly what Geeky was complaining about in the first place.  Using excuses or explainations as a means to an end.
