The only thing the EEOC would, and DID do, was notate the employer's information as to what they did in my situation so that if it happened again in the future, the information would be there if the NEXT victim wanted to attempt a lawsuit.

Get three victims and it qualifies as class action.

Surprised your attorney did not write them a strongly worded letter on your behalf.  Companies often find it cheaper just to grant a sinecure job than to deal with class action lawsuits.

You're correct, the only problem was, no lawyer wanted to touch the case because of the "agreement" i signed.  Even though it was blatant duress from my point of view, proving it within the courts would be a very difficult task.

That being said, the company is not large enough for them to really ever have to worry about getting 3 complaints.  Of the employees (just under 100), only 4 (including myself) were female and 2 of those 4 were well beyond child bearing years.

my apologies to Stella for the semi-hijack on this thread.  my irritation at the sweeping generalization that accounts for joblessness/homelessness got the better of me.

Yes, i accept and know that there are just "lazy" people out there, but i truly do not see the homeless as "lazy"...they have to be constantly on the lookout for shelter, food, etc...to me, it's more work than getting up at 7am and working an 8 hour day *shrug* but that's just my own opinion *smile*

Then again, raising  baby is a full-time job in itself.

Even if I was paying you minimum wage, I still couldn't afford the $2000+ a week you'd be earning for doing such a great job with her.

I'll just beat your ass when I get home tonight instead... fair enough? ;-)

Wildfleurs is correct, pregnancy is NOT protected under Equal Employment Opportunity laws.

Both of you have been provided with direct links to the EEOC, whch clearly says exactly the opposite... treating an employee differently because they fall into the class of pregnant people, is a violation.

I know that there is a big difference between being the victim of EEOC violations, and prevailing in a lawsuit, but I don't see the point in spreading untrue information that it isn't an EEOC violation to wrongfully terminate someone for being pregnant.

Okay this is what I mean by reading what I said.  I have been continuously talking about the issue of suing, which was what GeekyGirl reccomended.  I never talked about whether something was an EEOC violation, nor did I say that it was not an EEOC violation.

What I have said over and over (which even the person in question has said is true based on the lawyers she talked to) is that she would not be successful in suing the company and ergo I don't believe that SubinMaine is stupid for not suing, because of the issue of fire at will states and protected classes.

Yes, I understand that by virtue of only women being able to get pregnant, they are somewhat protected under the gender portion of protected classes.  But is that enough to successfully win a lawsuit? No, not in my opinion and apparently in the lawyers opinion that they consulted.  Could she file some pointless EEOC claim? sure, because I'm sure she's got tons of time to waste on that.

C~

Wildfleurs, you're 100% correct and that last paragraph is essentially what i got from your original post.

Too many people focus on the written laws and, well, they're not always used for their intended purpose.  my case in point.

While i knew it'd be a pointless, rewardless, long and expensive battle in the courts, i wasn't so complacent that i didn't file with the EEOC, because i *did*...and my former company was notified by the EEOC that the claim was filed and noted on record.  i believe it all worked out for the better for me mentally and physically.  And hind sight is 20/20...had i known the options available to me for HELP when i lost my job, i never would have signed the disclaimer and maybe, just maybe, a lawyer would have taken the case, but that's neither here nor there.

Again, it just bugs me that someone who's so obviously not hit the hard times in their young lives can make such a broad generalization on work, obtaining work, keeping work and so on.  It's laughable that there are some people out their with that viewpoint, even worse, it's downright SCARY that they're out there.

Never hit hard times huh?

Where were you when I was working 2 jobs plus taking 18hrs a semester and dealing with a husband with a severe case of paranoid schizophrenia plus dealing with my own severe depression at the time (including being semi-suicidal?)

Maybe I was only sleeping 3hrs a night but I kept my jobs. PLURAL, as in more than 1.

You just keep hanging your ass out there sunshine...point is, you were able to keep your job.  You didn't lose it through channels beyond your control and get thrown to the dogs while someone 11 years your junior berated you about being stupid and not suing when they hadn't a clue to the intricacies of the matter.  Just their own "broad, sweeping generalizations." (your words, NOT mine)

And, for the record, i did my time, thank you.  i did the school hours, work hours, two jobs, three jobs, side jobs and under the table jobs to get where i was financially all the while dealing with a manic depressive suicidal now ex-husband...only to have everything i worked for ripped from my grasp through no "fault" of my own and, again, have someone whom it NEVER HAPPENED to belittle me.

Don't try playing the one-up game in an attempt to justify your incorrect assumptions.

And don't worry...just as i thought the economy wouldn't ever catch up to me, funny things in life will generally happen that tend to humble you just a bit.

*smile*

No offense GeekyGirl, but you seem to be out of touch with what is happening in the world.
Now what was the OP about?
How we should do more to help the homeless, I agree we should do a lot more.
Many of us are closer to being homeless than we realize.

good grief...........so what? you did what 90% of folks could and would do..........pat your self on the back.................

but do not place your standards of the 10%ish ( i have no stats to back that up so you may consider it complete bullshit if you choose to) of people who do not have the discipline or mental capacity to do the same......

and quit thinking you are some how superior to that 10% that can not make good judgements.

maybe you had a better upbringing.....maybe your mom and dad didnt leave a bottle of liquid acid(the kind you got on cute lil paper squares) so you could drink it and have your mind fucked up forever.......maybe theyre really too lazy to get a job.......maybe they lost everything to a bottle of jack daniels......

maybe the voices in their heads tell them the street is the only place that is safe........it is part of their condition, theyre incapable of knowing any better.....

rather than preaching the things you have, have done, dont apologize for....blah blah blah....try being thankful for what you have......even if you cant wish better for others, with the proper practice, you may be able to realize that none of us is promised a tomorrow as today is......

when you dont have the resources to go back home and have your own house......job security, a mom and dad to fall back on, then come tell me of the great troubles you have had.

lifes a bitch some days for us all........and id bet the barn, in 20 years, if youre not homeless and destitute on the streets with no memory of your prior life, you will remember this forum, or parts of it, and think damn they were right about many things.

If you'd ever like to compare hard times with someone, "SiM" is NOT the girl you want to be comparing cocks with.

She's been through more than half of us on this board put together.

I'll even give you a glimpse.

Physically and emotionally absuive relationships, including some interesting permanent marks.

Live through three miscarriages and tell me how you feel afterwards.

That's all you need know.  You wear your mental diseases like a badge of honor then turn around and bitch because it's so hard.

Some of us, who enjoy life in the real world, are capable of dealing with stress and depression and day to day life.

Semi-suicidal?  It took 4 cops and a police dog to make me drop the gun I was about to swallow.  Am I proud of that moment in time?  No.  I am proud that it took four cops and a police dog to take me down though.

Jobs.  I commute 3 hours a day.  I sit in my office 9 hours a day, that's 12 hours M-F I'm not at home with my family.  I run a website design company opn the side.. that's another 15-20 hours a week.. essentially a second job.

Come to think of it, you don't want to compare cocks with me either, sunshine because I promise you mine will dwarf yours.
