 I have this exact issue with getting genuine ceasar salad dressing.  I've only known one place that actually knows how to make it from scratch.  And it's divine.

Speaking from experience as a Judge at the Old Bailey I can only say bring that plaintiff before me and not only will he get a good earwigging I will award McDonalds costs.

In the UK (Bristol, Hengrove Park) there was a case of someone catching HERPES from the mayo at Mc Donald’s!  I dont know if she did get anything, except a cold sore...

No idea how they figured it out, I believe it to be true (in local paper)  Now what where the workers doing with that food!!!  Yet people still go there and eat!!!!  Not only that, they let their children eat there too!!!

I don't see where it mentions what his two companions ordered. Wouldn't it be a hoot if they both ordered cheeseburgers, and when he grabbed a burger from the bag in a dark room, he grabbed the wrong one? Not saying he did, just thinking that is one of those bone headed things that people are known for doing.

While I find that anybody who doesn't have the foresight to check their food at the drive through window doesn't use the brains god gave them at birth, I do know for a fact that severe allergies can kill in one bite.  My um has severe food allergies, some so severe that the actual particles of the food on the air can make her sick and in one instance an accidental bite of one of those foods nearly killed her within 2 minutes.  (throat closed up, face and neck and tongue swelled) The paramedics almost lost her twice on the way to the hospital.  But, I am incredibly conciencious and I check everything before giving it to her. 

So while I am very easily able to believe that one bite of an allergen can nearly kill, I find it hard to believe that someone THAT allergic wouldn't check what they're eating first.  And $700 for allergy treatment?  Uh...  One Er bill for one incident for us was nearly $1500 and that was WITH insurance!  what did they do - give him a $300 benedryl and a $400 tylenol and send him home?

Jeez, people - take it at face value. The best case scenario is that the story has been slightly embellished to make the political point favored by the original source. After that, who knows...

I can say this though:

If my slave brought me a cheese sandwich after I specifically asked that it not contain cheese, some kind of punishment would be in the offing.

How is a corporate restaurant any different? Why should my expectations be less with a commercial enterprise?

Well; considering that these people are from West Virginia. How can I take it serious? Have you ever been to West Virginia?
Neither the suers or the workers can be held accountable for this.
It is West Virginia. Let's get real here people. Report some real news, like the deaths of American soldiers by the hand of this oil-monger president.
Do they even have lawyers in West Virginia that know what a bar exam is?

oh, come on now...whatever happened to actually "looking" at the food to be sure it's right?

i am highly allergic to mushrooms and, even though i make every effort to make sure that no mushrooms have even been near my food (to the point of watching from the counter as the food is prepped) i "still" visually check the food before stupidly and blindly taking one single bite of it. also, i never go through the drive-thru, regardless of how much of a hurry i might be in. it's only common sense to do this.

Why take it at face value, when it sounds ludicrous? Someone with a deadly allergy, buys a burger, goes into a dark room, then opens up the burger, doesn't look at it, and proceeds to chow down?
 
Either he isn't very bright, or he's sneaky.
 
Now, if he did ask for no cheese, yes, McDonalds should have given him that, but neither they, nor a slave, should be owing anyone in that scenario ten million dollars.

Many Macdonalds are independant franchises, not part of the Corparation.  Comparing this to a slave making an error?  In that case the commercial enterprises would simply say the safe word, and if you call her(him) again call the cops for stalking and harrassment.  Glad I am not one of your slaves.  I do sadism because I enjoy it.

I think he has very reasonable case for around 10,000$ tops, but I consider the 10 million to be a baseless crapshoot, and hence frivolous.  If I were the judge I would award the guy nothing and fine the lawyer.

i am severely allergic to pickles (or anything with a similar preservative) and if it even touched my plate, they have to remake my whole order.  My throat closes up instantly.  The sensation is quite alarming.

i am also allergic to aspartame, and while my reaction is not as severe, i cannot tell you how many times i order a regular coke (and mention i am allergic to diet) and am given diet regardless because i am plus sized.

I think the fact that he says he said no cheese four extra times, that HE knew it was that important, and then didn't check, should (should, not will, LOL) hurt his case instead of help it. Talk about putting all the responsibility on others. I bet they offered half the bills as a way of saying "Let's share responsibility in this."

Kinda like that having a "Beware of Dog" sign on your property is a liability nightmare if anyone gets bitten, because your sign admits that you knew your dog was dangerous.

That's what that one lady did with Wendy's when she put a finger in the Chili. I think it was really her brother in law's finger that got chopped off in an accident so she went to Wendy's, put it into the chili, and then started screaming in the restaurant.

She got in trouble for doing that....I think they charged her with fraud and a couple other things.

Some people really do have the nerve to pull that kind of fraud.
