I LOVE how up-to-date the CDC is on their theories. Check that copywrite of July 1999. Meidcal information almost ten years old there. More recent studies are finding that the need for active blood to active (or "live) bloob is required to transmit the virus.

Answer:
Male-to-Male/Female Anal Sex: when a penis gets "hard" blood vessals "pop" and breaks along the uretha, introducing blood into semen. During anal sex there are soft tears and rips along the colon and sphincter. Blood at that point in time can be transmitted and give exposure.

Male-Females Vaginal Sex: Same as the anal...except another hole.

Mother-to-Child Breastfeeding: Often infants and newborns do not have the same anti-body and natural protections built in as adults. During breastfeeding there are trace amounts of blood in the milk that help provide those anti-bodies. In the case of a child becoming infected this way, a child is exposed and does not have the natural protections an adult would in their own saliva and are exposed in to the virus the same way they would be exposed to anti-bodies that are designed to help them survive childhood.

These reasons are why lesbians are not known for transmitting HIV. It's also the same reason that tears, sweat, urine, and saliva don't transmit the virus (no blood presence in the fluids normally) under normal circumstances. Blow jobs are generally considered "safer" than unprotected anal sex with an HIV+ partner. Does this mean go blow the next homeless guy out there cuz you can? No, it means be safe and protect yourself....and remember that bites MAY have the possibility to transmit in extreme circumstances.

Not justtheory, and I'm not sure what the date of the research has to do with anything.. did they discover later that the people diagnosed in 1992 suddenly did not have the infection?

On the OP, as long as medical personnel are wearing protective gear against the threat of blood borne hazards, no matter how miniscule the risk, the courts are bound to consider the spitting assault to be more serious... it isn't the court's place to make new science.

Actually it lists cases of mucotaneous transmission which could include other means than needle sticks, and it lists a case of an unspecified fluid.

None of which has anything to do with the legal aspects... criminal courts are not always the best arena to approve the latest competing scientific theories.

Under the legal standards, this was apparently a harmful or offensive touching with aggravating circumstances that included the risk of more serious harm, by a 2 time offender. End result, 3 strikes.


In the eyes of the court system it was akin to pointing a revolver at the officer with only one bullet in it... all the 'safe' chambers don't mean squat...and in the eyes of the court system, all of the HIV cases that weren't actually airborne saliva don't count either... their focus is the perception that there was in fact an intention to harm and a potentially harmful act.

The ladies auxillary;s first question is "do you have someone to call" and if the answer is no by god they will find you someplace - even if it means putting you up in a hotel overnight at the dept's expense. Thats what they do with all those bakesales etc... Kittin, I realize that we differ politically - but you really need to see both sides of this. Two and a half years of freeloading is enough. If you offer someone a helping hand and a place to stay and 2-1/2 years later they still dont have jobs (Despite the fact that there are jobs ALL OVER HOUSTON. They may not be glorious or glamorous but they are jobs - truck driving, general labor, refinery work, oilfield work etc.Without picking up a newspaper - I cannot drive from my house to the supermarket without seeing at least 20 "now hiring" / "help wanted" signs...) ) and are expecting free rent, medical care, food, a cash benefit etc - its time to get pissed off. Do a little research in the Houston Chronicle (chron.com) and see how much trouble came with the Katrina folks.

        But, DA, you have to understand, those jobs are hard, and they have all sorts of mean expectations that set the poor Katrina victims up to fail.  They want you to be there on time, every day!  They expect you show the native intelligence and initiative to beat a drug test!  They actually expect people to do a fair days work, and sometimes work overtime or weekends!

        Where is your compassion?  Don't you understand that these people are victims?  That they really aren't capable of being self-supporting, productive members of society?  That they must be treated by different standards because of their background?

The hurricane veered away on the weak side and destroyed places a hundred miles away who got none of the massive press attention given the New Orleans residents.
Those houses got wet because the local contractors scammed the system and built substandard levees that gave way in the aftermath of heavy rains... there never was a direct hit, or 300,000 dead, or any of the imaginary Hiroshima level damage the Mayor and the rest of the crooked politicians claimed.

Very well said, Alumbrado. It wasn't the actual harm they convicted him on it was the intent to cause harm, no different than pointing a dangerous weapon and threating the officer. It doesn't matter that the gun is completely empty or the knife is a toy one, the intent and threat were there.

Correct most of the city is there, its just a mess that needs cleaning up. Which isnt happening because 150,000 of the residents who should be there are doing lucrative clean up and rebuilding work are instead here in Houston, sucking the taxpayers tit for 2-1/2 years, saying they cant get jobs, committing felonies to the point where our crime rate doubled. FEMA is wanting to cut off the housing assistance and they are going crazy that the govt would dare say enough after 2-1/2 years. As I said there is PLENTY of work to be had in Houston - but the Katrina refugees dont want to paint pipe in a refinery, or to drive truck (A Class A CDL school is only $300 and a lot of employers will lay it out for you and deduct it from your pay), or to work in the Walmart, or as a sandblaster at rig yard... No as the backwards baseball cap wearing pants halfway around his ass loser who walked into my business said "Yo man, I want to be a motherfuckin airline pilot hook me up!" He didnt even get the "looking for a sign off on his job search card" needed to renew his benefits.
