DALLAS — A homeless man who spit in the mouth and eye of a police officer and then taunted him, saying he was H.I.V. positive, was sentenced to 35 years in prison on Wednesday for harassing a public servant with a deadly weapon: his saliva.

Because of the deadly weapon finding, the man, Willie Campbell, 42, of Dallas, will not be eligible for parole until he has served half his sentence.

In May 2006, a passer-by reported an unconscious man, Mr. Campbell, sprawled outside a downtown Dallas building. Mr. Campbell tried to fight paramedics and kicked the police officer who arrested him for public intoxication, prosecutors said.

Saliva can't transfer HIV if it could you'd never kiss someone with it. What are the chances of the homeless man having a cut in his mouth and a small amount of blood being transferred to the cut in someone else’s?

No psychiatric evaluation? The man's obviously a little doolally - sounds as though he needs medical care more than jail.

And thirty five years?!!! And saliva, a deadly weapon? What's wrong with the law again [:(]?

35 years...  Makes you wonder if the guy would have rather just been beaten and tazed for behaving so stupidly with the cops.  Did the perp know his saliva wasn't the potentially deadly weapon he claimed?  Intent is important, I think.

I’m going to have to kill you with a feather for saying that. Anyone care to charge me with conspiracy to commit homicide with a feather.

(edit: will = with)

That one would call for a psych exam, I think.  [:D]

Indeed one man’s deadly weapon is another mans feather.

This case is tragic and shows society’s failure to help someone out of a dire situation. It makes us all feel better to write him off as a dangerous felon though. Although I have heard that some people on the streets would commit all kinds of crimes if it meant they didn't have to eat out of bins. See there is method to his madness.

With the dental hygeine of most homeless people I have seen - I would say pretty damn good. Cuts, open sores, pus oozing lesions etc... These arent people who brush and floss regularly....

People who brush and floss regularly tend to get cuts hence why you should never share a toothbrush they say.

You are talking about one part of the equation anyway and are clutching at straws.

I have heard that HIV can be transmitted through saliva, but that's more of a theoretical.  HIV can exist in small quantities there, but that it would take like 20 gallons of exposure to trasmit it.  That would be like a small bath tub of saliva. (ew lol).  On top of that, our own saliva has characteristics that protect us from microbes, making it even less likely to be transmitted via mouth-to-mouth.  The eye has some protection as well.

The virus can, however, be transferred via a bite.

We obviously disagree about just who the victim was here.  I would say that giving this dirtbag 35 years is society's success in protecting the public and police from a dangerous parasite.

If the police are so fragile they should really be doing something else maybe. He is a definitely a threat to authority figures but to class him as a threat to the general public, I don't know about that, maybe.

Skip putting him in prison if you feel like that, as my dad would say and I never listen to him 'Take him out the back and shoot him.'

When society has no compassion it shouldn't still be called society.

Level -> RE: HIV positive man gets 35 year sentence for spitting on officer (5/18/2008 12:21:04 PM)

FC, would a better solution be to forcibly place him in a mental institution?

FullCircle -> RE: HIV positive man gets 35 year sentence for spitting on officer (5/18/2008 12:25:15 PM)

Some chance at rehabilitation would be nice and part of that is indeed assessing his mental state, prison isn't going to help him because he probably doesn't care if he ends up there, I'm just speculating though because I don't know the bloke. The judge passed that sentence not to help him but to punish him, it isn't going to work because he doesn't care most likely.

Ill vote for the shoot him thing. I hate driving in areas of houston that have the homeless  dregs washing windshields and begging at the lights etc. I hate when they dare touch my vehicles. I dont want their filthy dirty grubby disease ridden hands anywhere on my $55,000 car. I literally go through a car wash immediately after one of those walking pus bags washes my window with his filthy rag before I can drive through the interesection. Good to know this one is gone for 35 years, hes not "homeless" anymore is he? [:D]
