Gaol seems a little pointless - there are after all ways and means of ensuring he pays the fine which would be much less costly to the taxpayer, and not block a prison place for those who belong there.

The law itself meanwhile is stupid; had it been framed differently, all could have been accomodated with some venues being smoking and others non smoking.

This is what they always had but people have the right to work in a smoke free environment. You can't have smoking venues because then it eliminates a whole set of people from being able to work there unless they want to risk their health.

Some people make the same argument about hearing loss in entertainment venues but that's a load of nonsense because you can protect your hearing to some extent with hearing protectors, you can't stop breathing or wear a gasmask as you work.

Probably how you see this law boils down to if you are a smoker or not.

I don't smoke.   Nor can I breath around it.

His clientele, wanted that.    I detest smoke.   But I also view this as intrusive.

I view the sale of tobacco products as an intrusion... and intrusion into the health of society.

I used to smoke. I smoked for 23 years. Since the vast majority of smokers do not have the couth to only smoke outside away from others they have to be forced by law to have a little class and not blow their toxic garbage on innocent people...If they had more couth, it would not be necessary to legislate it for them.

I see a lot of Americans spouting off about Britain's not being "constitutional".. well folks, big shocker, they do not have our constitution...

I have decided to try and avoid states that allow smoking indoors. This has been my way of keeping my self from getting sick. I have to give up my freedom to go where I like because other people choose to engage in an activity that is the equivalent of doubling up their fist and punching me repeatedly... all because they cannot refrain from sucking on a death stick for a little while...

So sorry for you, that you can never go to a cookout or BBQ, have a bonfire in the backyard, a fireplace or drive behind a deisel truck with misadjusted injector timing, or even one that runs right. Jeeezus, the "NWO" (if they existed) would be happy with people smoking

1) they probably own the tobacco companies
2) more poor people than wealthy smoke
3) its an addiction, and addictions are a useful control method
4) it kills people (from the poorer demographics, and the NWO doesnt like the plebs)

You are missing the point.

The government has no rights.  NONE.   This is a slippery slope.  What is next?   Gum?   Perfume?  how about people who did not get h1n1?

There are alot of things that the government needs to butt out of.

Jail?   ha!   how much of your taxes pays for a 6 month stay?      Someone has to pay it.

All laws go through public scrutiny and are debated; with MP's putting forward concerns from their constituents. The majority of people wanted the ban because the majority of people don't smoke. Sure you have to respect the rights of the minority but the key difference is that nobody is telling them not to smoke in private. If we were in a police state they'd be people knocking on doors with air inspection devices.

Your argument is nonsense, are you allowed to break the speed limit and endangers lives that way? It's accepted that passive smoke endangers lives and it's accepted that if people want to kill themselves they shouldn't be dragging anyone else along for the ride. Do it in private, no problem. Do it in public or facilitate others to do it in public then face the consequences.

I don't care how much it costs to put someone in jail, I think monetary concerns should come secondary to see justice done. Not everything in society is about money, 'stop monetising the problem' as you like to say.

Yep total hypocrisy, I find hypocrisy to be one of the worst human qualities.

I think the other aspect here is that after the smoking ban was imposed a record number of people quit and that means less NHS's resources will be going towards people bringing health problems upon themselves. We could say the same about obesity perhaps, I see this report the other month about how much that is costing in terms of special ambulances, king sized hospital beds etc.

You don't want to be telling people how healthy they should be but on the other hand you want to ensure the care they get is equivalent to everyone else and that never will be the case if they have to wait longer for special facilities because they are the exception to the rule. Prevention is better than cure, when did we stop thinking this?

actually that is what they tried to do with the Copahagen treaty.     the whole global warming thing is to inspect and license homes annually- and if you do not comply jail time.

I'm sure you compete with industry in regards to hot air content.

The way they generally make homes greener is by giving incentives to people to improve U-values. There will be no fines for domestic houses, heating bills alone are prohibitive enough to make people seek a better U-value.

I think that if you are in your own private house on your own private land you should be able to do what you like as long as everyone is consenting (like you aren't murdering someone, etc). I do not think you have the same expectations when you are around other people.. communities set standards for behavior... don't like those standards, well then leave. I am staying in Cali because I do not like the backwards smoking states

So you are saying that the community that this pub owner lives in has no right to make standards for the public health... should he be allowed to keep a nasty kitchen? Should he be allowed to serve steak that is so old it makes someone sick? What should we do with people that flout the public health and will not agree to abide by the law? Just let them?
