DarlingSavage -> TOS (3/26/2010 2:19:35 PM)

I was told to refer to the TOS about what was and was not allowed in the way of images on CM. I was told that there was some reference to image size and file types that were allowed. Alas, no such list of allowable items in this regard could be found. This is what the TOS says:

Services provided and not provided

3.1. The Website provides a forum through which adults may seek and establish personal contact with one another through the use of the Website's capabilities for displaying photographs and written materials provided by its members. The Website contains images and content, including but not limited to text, images, messages, and other information. All Materials displayed on the Website are protected by the First Amendment rights to Free Speech, Free Expression, Freedom of Association and Freedom of the Press, and parallel provisions of state constitutions. The Website is dedicated to assisting like-minded individuals locate, and communicate with, each other. We are not responsible for the content of communications, statements, opinions, posting or other information placed on the Website by third parties, via any discussion board, forum, or public area of the Website. Such information is intended to be protected by the immunity provided by Section 230 of the Communications Decency Act ("CDA") which immunizes this Website, and its agents and employees, from any claims relating to the content of information posted by third parties. We do not act as a censor of such material. You acknowledge that the Website may offer online content that could be deemed "adult," "offensive," or "erotic" in nature. While We may choose to remove content that is identified as illegal, is stolen, or which violates Our policies, We do not edit, review, or change posts made by third parties prior to the information appearing online.

6. Images and Content

6.1. Our Website contains images and content, including but not limited to text, software, images, graphics, data, messages, and other information (collectively, "Materials").

6.2. You acknowledge and stipulate that all of the Materials are expressive content that is fully protected by the First Amendment to the United States Constitution.

6.3. You acknowledge and understand that some of the Materials contain graphic visual depictions of sexual activity and nudity, graphic audio portions of the same kind of content, and descriptions of sexually oriented and sexually explicit activities. You acknowledge that You are aware of the nature of the Materials provided by Our Website and that You are not offended by such Materials, and to the contrary, that You are accessing this Website specifically because You enjoy such expressive content and You wish to view such Materials. You stipulate that you access this Website freely, voluntarily, and willingly, and for Your own personal enjoyment.

6.4. You agree not to use or access the Website if doing so would violate the laws of Your state, province, or country.

6.5. In the event that any court finds that any third party communication or third party content on Our Website falls outside of the realm of Section 230 of the Communications Decency Act ("CDA"), this shall not be deemed to be a waiver of any legal protections provided by CDA 230 for any and all other content posted on Our Website.

Throughout the TOS, which is quite lengthy, I might add, this is the only bit that can be found regarding images. That and that CM reserves the right to remove anything for any reason. Aside from that, though, there is no list of file types or file sizes that are allowed or disallowed. Nothing is mentioned in regards to what anyone may post image wise as far as gifs, videos, or pictures other than they be legal and not be stolen.

If I missed something somewhere, please don't hesitate to point me in the right direction, I won't be offended.

Jeffff -> RE: TOS (3/26/2010 2:21:53 PM)

CM reserves the right to remove anything at anytime.

It's their sandbox, what are ya gonna do?

DarlingSavage -> RE: TOS (3/26/2010 2:23:33 PM)

Nothing, it's just that they said there was a list in the TOS about what types of files could be posted. And that I should check it out and check it out I did. I responded to this in private, but my last message was ignored, so, here I am.

pahunkboy -> RE: TOS (3/26/2010 2:42:05 PM)

The EFF is a good site.

ModTwentyOne -> RE: TOS (3/26/2010 2:59:32 PM)

Just so we are clear here... we did not respond to you as quickly as you wished, so you started yet another thread about the problems your actions were causing to vast numbers of users on the site.  Is that really your defense on taking this to the forums?

Again, just so we are clear here... your animated gifs, videos, whatever you would like to call them AND the huge pics you were posting, including the one you put into your other whining thread that we have, at this point, allowed to remain, are causing THOUSANDS of users to have problems with the site.  The speed of the site loading for THOUSANDS of users has dropped to a crawl.

We simply cannot do such a disservice to so many members as to allow you to continue in this manner.  We really do not understand what part of that is so unclear.  We tried to keep this private, we informed you as to why we were removing the material, and you, for whatever reason, just couldn't accept that or even apologize for causing so much extra work for the staff and for causing so many problems for so many other users.

When you were told to consult the TOS, it was not necessarily to find a listing of what file size is allowed.

Since you seem to be unable to determine what is appropriate and what is not, we can certainly make a special rule just for you that says you are not allowed to post animated objects of any kind, and still objects no larger than two inches wide by three inches high.

If you have any further questions on this matter, feel free to write to SUPPORT or to me, and then kindly offer us the courtesy of waiting for a response.  We expect to see no further threads on this issue.

DarlingSavage -> RE: TOS (3/26/2010 3:34:31 PM)

I don't think you understand at all. I've said several times over that I don't mind stopping and that I don't want to cause problems for other users. I've even said so in this thread.

Y'all told me to refer to the TOS about the types of images I could post and I did only to find that there is no such list there. Do I need to go back through the correspondence to show you what all has been said to me and why? Because what is there is a continual refusal from y'all to comprehend anything I'm saying. It's like I'm speaking anothe language.

You made up excuses for deleting the first post I made which was strictly an announcement about being asked not to post the gifs anymore. It was lighthearted and in NO WAY whiney! I don't appreciate being censored. And that's exactly what it was, censorship. That's what this is about. Not about being able to post gifs. It's about the fact that I was censored because somebody couldn't tell that I was kidding or took it too personally when I said that I was slowing down mod computers, which was just a joke. I didn't say anything wrong in there. And I don't appreciate the fact that y'all keep trying to insinuate that I'm insisting on doing something I've been asked not to do when that is clearly NOT what is going on here.

ModTwentyOne -> RE: TOS (3/26/2010 3:39:24 PM)

Let me repeat:  If you have any further questions on this matter, feel free to write to SUPPORT or to me, and then kindly offer us the courtesy of waiting for a response.

Nope, still not clear enough.

:)

Yeah - details, we want details - lots of details.

DomImus -> RE: TOS (3/26/2010 3:51:46 PM)

I figured this would happen once they started allowing people to post pictures. One bad apple would turn it into a urinating competition. I love the tactic of quoting the TOS like it's the Constitution or something. Grow the fuck up already.

Mods, wouldn't it just be easier to remove the ability to post images and such in the forums and clearly outlaw animated gifs as avatars? It hasn't really enhanced the forum experience all that much. It is handy to be able to upload a pic to illustrate a post but if it's going to be abused and people are going to stomp their feet and demand their rights in this fashion is it really worth it?

ModTwentyOne -> RE: TOS (3/26/2010 3:55:20 PM)

We would be loathe to punish everyone for the actions of one.

NathaninTexas -> RE: TOS (3/26/2010 3:58:57 PM)

is this a SMQ forum or a Phpbb ... in either case both should have the option to limit the file size of any uploads... and I think 50kb is more than fair.

I *like* punishing people.  I'd be happy to do it for you.

and and i'd be the witness - to make sure it was done right. Yeah, thats the ticket! Done right!

I was never whining to begin with. I was never insisting that I should be allowed to continue to use gifs. I was only saying that I didn't appreciate being censored when I

You know what? I think y'all are just deliberately hateful. And that's why you refuse to see anything I've said other than what you want to make it out to be.

RCdc -> RE: TOS (3/26/2010 4:40:29 PM)

No.  You have just whined.  That's not hateful, that's the truth.
Hateful would be "fuck off then".  But as a gentleman, I would never say that to a lady.  But then one has to act like a lady to deserve gentlemanly attention.

Not only that, but we'd need photos, too.  Just remember:  no more than two inches wide and three inches high.

DarlingSavage,

It seems as though you have an issue with perception: this is not the only place where you have thought that people were against you... when they weren't.

Now you have forced an answer to a question and because you did not like it, you see it as 'we' are being "deliberately hateful".

I am feeling concerned for you.
Seriously.
