ORIGINAL: NorthernGent quote:
ORIGINAL: Real0ne Gent they were British Esquires whose purpose was to limit the abuses by the monarchy that created the disagreements in the first place. Because you are under the authority of the monarchy you do not have nor can you have "exercisable" unalienable rights as you are the queens chattel. Regardless of the show they put on in parliment etc etc etc. Tough pill to swallow for the educated in todays world. Seems to me you're arguing that unalienable rights can indeed be taken away and resinstated by human power? How do you define unalienable rights'? Well in anglo sax history the "Sovereign", the head of the monarchy, usually titled king/queen, etc. declared their rights were bestowed upon them from God, and therefore the supreme law of the Kingdom. The Sovereigns used to "sojourn" (tour) the country holding court with his courtiers to resolve disputes between whoever. Rights can be given away under contract. So for the right to free speech, if you go to rons house and ron says you can enter my house but you will not utter the evil word "Real0ne" while in my house you just relinquished your right to utter that word by giving power of attorney to ron who upon your violating the contract can kick you out of his house or sue you for injury as a result of your uttering the word "Real0ne". :) So you would go to the law dictionaries as I always do and look up alienable. quote:
ALIENABLE alienable, adj. Capable of being transferred to the ownership of another; transferable <an alienable property interest>. — alienability,n. CONSTITUTIONAL FREEDOM constitutional freedom. A basic liberty guaranteed by the Constitution or Bill of Rights, such as the freedom of speech. — Also termed constitutional protection; constitutional liberty. CONSTITUTIONAL GUARANTEE constitutional guarantee.A promise contained in the United States Constitution that supports or establishes an inalienable right, such as the right to due process. EQUITY equity,n.1. Fairness; impartiality; evenhanded dealing <the company's policies require managers to use equity in dealing with subordinate employees>. 2. The body of principles constituting what is fair and right; natural law <the concept of “inalienable rights” reflects the influence of equity on the Declaration of Independence>. LIEN lien - leen, n. A legal right or interest that a creditor has in another's property, lasting usu. until a debt or duty that it secures is satisfied. • Typically, the creditor does not take possession of the property on which the lien has been obtained. Cf. PLEDGE(3). [Cases: Liens 1.C.J.S. Liens §§ 2–3, 12, 18.] — lien,vb. — lienable, liened, adj. LIENABLE lienable, adj. (Of property) legally amenable to a lien; capable of being subject to a lien. INALIENABLE inalienable, adj. Not transferable or assignable <inalienable property interests>. — Also termed unalienable. inalienable right.A right that cannot be transferred or surrendered; esp., a natural right such as the right to own property. — Also termed inherent right. So there are a few out of the law dictionary. so you can see the problem this creates with monarchies? (constitutional or otherwise?)
