~FR Apparently the second suspect is no longer a suspect. Here is more on the person of interest, who according to NBC News has been ruled out: "Authorities tell NBC News they have interviewed the 'person of interest' in the Arizona shooting [and] are now satisfied he was merely at the Safeway store and not connected to the shooting or the suspect in any way." The New York Times notes: "Investigators said that the second man was a taxi driver who drove the suspected gunman to the scene. Upon arriving there, the passenger said he did not have change and he and the taxi driver went into the supermarket for change and the two then walked out together and separated." Current charges... WASHINGTON - The United States Attorney for the District of Arizona, Dennis K. Burke, announced today that his office filed a federal complaint against Jared Lee Loughner. The complaint was signed by Magistrate Judge Michelle Burns in Phoenix. Loughner is suspected of shooting U.S. Representative Gabrielle Giffords, Chief Judge John Roll, Giffords' staff member Gabriel Zimmerman and approximately 16 others Saturday in Tucson, Ariz. The federal complaint alleges five counts against Loughner: COUNT 1 On or about Jan. 8, 2011, at or near Tucson, in the District of Arizona, the defendant, Jared Lee Loughner, did attempt to kill Gabrielle Giffords, a Member of Congress; in violation of Title 18, United States Code Section 351(c). COUNT 2 On or about Jan. 8, 2011, at or near Tucson, in the District of Arizona, the defendant, Jared Lee Loughner, did unlawfully kill Gabriel Zimmerman, an employee of the United States who was engaged in performance of official duties and who was assisting Member of Congress Gabrielle Giffords while she was engaged in performance of official duties; in violation of Title 18, United States Code, Sections 1114 and 1111. COUNT 3 On or about Jan. 8, 2011, at or near Tucson, in the District of Arizona, the defendant, Jared Lee Loughner, did unlawfully kill John M. Roll, a U. S. District Court Judge for the District of Arizona, an employee of the United States who was engaged in performance of official duties; in violation of Title 18, United States Code, Sections 1114 and 1111. COUNT 4 On or about Jan. 8, 2011, at or near Tucson, in the District of Arizona, the defendant, Jared Lee Loughner, did, with intent to kill, attempt to kill Pamela Simon, an employee of the United States who was engaged in performance of official duties and who was assisting Member of Congress Gabrielle Giffords while she was engaged in performance of official duties; in violation of Title 18, United States Code, Sections 1114 and 1113. COUNT 5 On or about Jan. 8, 2011, at or near Tucson, in the District of Arizona, the defendant, Jared Lee Loughner, did, with intent to kill, attempt to kill Ron Barber, an employee of the United States who was engaged in performance of official duties and who was assisting Member of Congress Gabrielle Giffords while she was engaged in performance of official duties; in violation of Title 18, United States Code, Sections 1114 and 1113. Loughner will make an initial appearance on the complaint at 2 p.m. Mountain time Monday, Jan. 10, 2011, in front of U.S. Magistrate Judge Lawrence Anderson at the Sandra Day O’Connor Courthouse in Phoenix in courtroom 302. He is entitled to a preliminary hearing and a detention hearing. The court will set a date for both hearings. Loughner remains in federal custody. The Rules of Criminal Procedure require that a grand jury review the evidence and issue an indictment within 30 days of the defendant's initial appearance. The U.S. Attorney's Office for the District of Arizona is in the process of drafting an indictment against Loughner for presentation to the grand jury. The Lawyer.... and its really no surprise... who else would have any experience at all in defending this type of case? A federal public defender known for handling high-profile cases, Judy Clarke, has been appointed to represent him, a federal judicial source told CNN. Clarke previously defended the "Unabomber," Ted Kaczynski, and assisted in the case of confessed al Qaeda operative Zacarias Moussaoui. Could more be coming? NBC Chicago is reporting that Illinois Congressman Danny Davis received an email threat on Sunday. It effectively said, "Danny Davis is next." There is no indication that the message directly referenced Saturday's attack on Rep. Giffords, but NBC says the note was "presumably referring to Saturday's shooting in Tucson, Ariz." Davis' office has notified authorities. UPDATE: Davis tells Chicago Breaking News that the threat might have usually been ignored, but in light of Saturday's shooting it was reported. "In this climate, it pays to be as cautionary as one can be," he said. Davis also added that the emailer is somebody who has been known in the Chicago community to "do this before." This is indeed a scary thought... regardless of his political affiliation. I have heard that Gifford was a follower of the shooters youtube account... here is what is being reported... Ben Smith at Politico makes an interesting catch: Giffords' YouTube account subscribes to her alleged shooter's. The only other account Giffords subscribes to is former Representative Ike Skelton's. A cached version of Giffords' profile shows that she didn't follow Loughner as of December 26, indicating that the subscription may have been done by a staffer after the shooting to keep an eye on any developments with the account. http://www.huffingtonpost.com/2011/01/08/sarah-palin-statement-shooting_n_806224.html I do not want it believed i blame Palin for anything at this point. Im waiting to see what comes from the grand jury as well as what the shooters computer may reveal before passing any judgement upon anyone.
