I am reporting what I heard at the conference I attended. One panelist reported that there were cases of children being held in social services as a result of their parents being held for things like traffic violations. In other words, they were held for being "illegal", their kids taken because they were put in jail... Once the children are in the system, they are placed in foster care, and the parents are not allowed to collect them before being deported. It is one of the reasons that local and state law enforcement shouldn't get in the business of enforcing immigration law, because bullshit like this happens...

It may make you happy to know that this panelist also reported that the news was out amongst those here illegally... have kids here, send them back to Mexico, so if you are deported your kids won't be stuck here with strangers.

This is not true, they are not a chain for legal immigration. You can have your siblings here, your parents here, your children, and your spouse.... you cannot sponsor your grandparents, your aunts and uncles and cousins. The people you sponsor are not a chain for anyone else because they are not citizens with the ability to sponsor under the law. These are just BLANTANT falsehoods. if you are posting an article with one falsehood, what does that tell you about the reliability of the rest of it? Like I said, it is like the Welfare Queen reporting, an exaggeration and conflagration of issues to make a point based upon racial fears and stereotypes.

Nor did I claim to believe it was a chain for legal migration. Chill out julia. You are way too close emotionally for this discussion. You see boogey men where none exist.

Now...

Who Can Sponsor Who -------------
Who You Are --------------- Immigrants You Can Petition ------- The Immigrant's Category
U.S. citizen ----------------- Parents -------------------------------- Immediate relative
U.S. citizen ----------------- Spouse --------------------------------- Immediate relative
U.S. citizen------------------ Minor, unmarried children ------------Immediate relative
U.S. citizen ------------------Married children or adult children --- Preference relative(1st preference)
U.S. citizen ----------------- Brothers and sisters -------------------Preference relative (4th preference)
U.S. permanent resident --Unmarried children ---------------------Preference relative (2nd preference -- 2A or 2B)
U.S. permanent resident -- Spouse ---------------------------------Preference relative (2nd preference)

However, if allowed to immigrate to the United States, most of the people on the above list will be permitted to bring their own spouses and children with them. And it is true that once someone has a green card, they can sponsor other people on the list.

They were being held for traffic violations. As far as not being allowed to collect them, the Judges I have seen and read about asks the parents, or the child if they are old enough, if they want to stay in the US or leave.

I would be curious to get some literature on the group that gave that lecture you attended, julia.

Once the proceedings are published I will send you a link. I just went last week, and it takes a few months for the proceedings and papers to be published. I will send it to you privately, because I may be on the board by then, and I do not want to publish stuff that can be used to track me on the forum.... deal?

No offence, but that bill is being gutted by cities across the county, such as San Francisco. These cities are not required to act as ICE agents, and they have said they were going to stop.

quote:

San Francisco, one of the first sanctuary cities in the nation, plans to end its cooperation with federal immigration officials and start releasing illegal immigrants arrested for minor offenses before they can be picked up for deportation.

Officials in jurisdictions including Providence, R.I., and Chicago have also challenged the program, which they say undermines trust that it has taken local law enforcement years to build in immigrant communities.

California and Illinois lawmakers are considering measures to let communities retreat from the so-called "Secure Communities" program, which links up the FBI's criminal database and the Department of Homeland Security's records so that every time someone is arrested their immigration status is automatically, electronically checked.

Washington state has deferred to local governments on whether they want to join program overseen by U.S. Immigration and Customs Enforcement (ICE).

http://www.foxnews.com/politics/2011/05/07/san-francisco-stop-detaining-arrested-immigrants-deportation/

quote:

A week after suing Arizona and arguing that the state's immigration law creates a patchwork of rules, the Obama administration said it will not go after so-called sanctuary cities that refuse to cooperate with the federal government on immigration enforcement, on the grounds that they are not as bad as a state that "actively interferes."

"There is a big difference between a state or locality saying they are not going to use their resources to enforce a federal law, as so-called sanctuary cities have done, and a state passing its own immigration policy that actively interferes with federal law," Tracy Schmaler, a spokeswoman for Attorney General Eric H. Holder Jr., told The Washington Times. "That's what Arizona did in this case."

http://www.washingtontimes.com/news/2010/jul/14/justice-sanctuary-cities-are-no-arizona/print/

So the cities and states dont have to follow the law... and the Federal Government wont go after them for not detaining illegals.

Many many cities are pulling out of the program. If a city isn't cooperating with Ice, and the federal government isnt going to do anything about it, it guts the strength of the Arizona law to do anything about the situation. Can a city choose to cooperate? Sure. How many will though since its added expense for the city.

I think we are talking two different sets of laws, I am speaking about SB 1070

As far as ICE, why are states expected to bear the expense of policing our immigration system? I remember proposition 184 in California which sought to make teachers and healthcare providers into INS agents. It was ill-conceived and inappropriate in the same way that taking local law enforcement and making them into INS agents is inappropriate. We hire law enforcement to serve and protect, not to chase down red light runners because they do not have a green card. Our system is already overburdened with the drug war...

And I am pointing out that without the assistance of local law enforcement, how is ICE even arresting illegals unless they are involved in stolen ID's?

You did miss my post about the guy from the Federal Labor Board coming into the place I work and stating that he didnt care who was legal or who wasnt, if you worked, you got paid the proper amount.

Do you also know that many states allow illegals to sue for back wages? There are many advocate agencies willing to fight for them? Not that I begrudge them a single penny, I dont. If someone works, they should get paid every cent. You keep insisting they are paid poorly, and some are, but the majority are not because employers are flying under the radar when it comes to hiring them.

There is only one reason why an employer would hire an illegal and that is to save money by negotiating a low wage and them accepting that low wage.

Yep, and then they complain to the Wage Board, who investigates, and who makes the employer pay back wages. Guess what happens if they cant prove how much they have paid the illegals? They have to pay them all the way back to date of hire, adding to that interest, forcing the employer to pay taxes.

Now, in the case of where I work, illegals are hired for a few reasons. One, because they know Asian food better than american cooks, Two, because they are being brought in by other employees who have worked a long time for the owners. Cant tell you how man have filled out visa forms after being employed (the owner pays for that, btw). Lower wages are not ALWAYS the only reason.

The only way I would hire an illegal is as an independent contractor and abide by the IRS rules regarding qualification as an independent contractor. So their are ways around that.

I wanted to mention that Bloomberg TV is at this moment, having an Intelligence Squared debate regarding "Illegal Immigrants," if anyone wants to watch. M

Apparently, this is not a first airing: http://intelligencesquaredus.org/wp-content/uploads/immigration-press-release.pdf
quote:

“Don’t Give Us Your Tired, Your Poor, Your Huddled Masses”
Says Intelligence Squared US Immigration Debate Audience
Kris Kobach, Arizona Immigration Law Co-Author, & Former Congressman Tom Tancredo, Defeats Mayor Julián Castro of San Antonio & Tamar Jacoby of ImmigrationWorks USA
Key Excerpts for the Motion:
KRIS KOBACH
“Look at the jobs. There are 14 million Americans out of work. A vast majority of the 11.3 million illegal aliens have those jobs, about seven million
are in the workforce. Many states are realizing the simple truth, if you want to create a real job for a U.S. citizen tomorrow, deport an illegal alien
today. It actually works.”
TOM TANCREDO
“What happened in the past is that the numbers allowed for, and also the timeouts that I mentioned earlier, allowed for an assimilation process. Even
if people didn’t want to, they were almost forced into it in order to get ahead in the country. Of course, there was the issue of English. My
grandparents, I can remember so distinctly my grandmother and grandfather in the back seat of the car, Sunday afternoon drive, after a couple of
hours, they had been together for probably long enough in that close a proximity so they started to argue about things. And my grandfather would
lapse into Italian and my grandmother would yell at him, "Speak American, dammit!"
