As for her "rights" she speaks of, she has NONE.
the owner or legal tenant of the property is the one who has the "rights"

Among the rights of property owners and/or tenants is "The Right of Exclusion" That means I can tell anyone (with the exception of law enforcement in the pursuit of their duties) that they are excluded from my property.

(Damn kids get out of my yard)

The little bitchlet that made the call seems to think that the theater is a public park or something. She is wrong. A property owner or tenant does not even have to have a reason or give a warning to tell you to leave. Failure to leave when asked is criminal trespass. The warnings she recieved were a courtesy that was not legally necessary.

She seems to be one of those self centered people who thinks their nonexistent "rights" supersede everyone else's wants or needs. If I were the business owner, I would basically say "Good Riddance Bitch" Go someplace else and whine and make people run to My place where they can get some peace and quiet.

How about the right not to have a voice mail used as a PSA. Did she have the right to expect that her complaint wouldn't be used to humiliate and degrade her, in other words, used publicly?

Do I have the right to call and complain to my cable company with the expectation that they will not use it for an ad campaign?

Here's what I'm getting from the "texting in completely inappropriate circumsance" defenders' crowd thusfar:

re the texting and/or 'flashlight' concern: "it's just modern technology, everybody does it, just accept it." Just a 'natural' manefestation of the technology.
That's odd Edwynn, because I just went back through the entire thread and that's not the way I see it. There have been three posters who have not come out completely against cell phone use. Let's go back and see just what it was they said, shall we...

#1 Said that you should just deal with it, and then in a later post said they did it and that they had never been bothered by others doing it. - Bang on, you got this one Edwynn, there's 1/3 saying what you say they say.

#2 Says she has serious vision problems and therefore has to use her phone as a light in dimly lit places, even places where the light would be sufficient for normally sighted people. - This can't be counted as one in your column, sorry. Valid medical reasons trump pretty much anything else, and she didn't say that texting, calling, talking was OK, just that sometimes a person has a valid reason to turn their phone on. So we are still 1/3 for you.

#3 Said as long as the phone was on silent it wouldn't matter, and then later on when somebody pointed out ways it could still be annoying even if it didn't ring, she said she had never noticed that, but agreed how it would be annoying and disruptive. - Started out in your column, but admitted that her previously stated position was wrong, and amended her position, so not in your column either. So we are still at 1/3.

Now regarding the PSA, here we have four posters, lets review their positions shall we.

#1 Yup, bang on. Exactly what she said...and...yup, she's the "crowd" you mentioned. 1/4 for you.

#2 Again, you nailed it, that's what she said about the PSA...but hold on...she's not in favour of inappropriate cell phone use at all. Sorry, still at 1/4.

#3 Same thing as #2. Still 1/4.

#4 Yes she finds the PSA in poor taste as well, but she is #3 from the previous list, so not part of your "crowd". We're still at 1/4.

So the "crowd" you spoke of consists of a single poster. Way to exagerate there, Dude. Since you're going to play fast and loose with the facts to sell your point, maybe you should change your profile name to FastEddy. [;)]

!FR!

What about the rights of the other folks that had paid good money to see the film?  at what point do her rights to text and be an annoyance to other theater goers take precendence?

juliaoceania -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 11:17:45 AM)

For clarification....

I do not think it is appropriate to txt everywhere, and I do not txt in movie theaters. It just hasn't annoyed me when people have done it. I never even said it was wrong that the theater had that policy.

I think talking on the cell in many places is inappropriate.... especially a movie theater.

I do not think that the girl who left the voicemail sounded articulate or intelligent... but that had little to do with her use of "bad" language.

I think that if a customer tells you one thing, and your enployees tell you another, you shouldn't publicly come out in favor of your employees "just because you believe them". In other words, her version of events shouldn't be used as a way of humiliating her just because the company thought it was a "funny" way to get out their message. I think a company that does this is tacky at the very least, and I wouldn't buy a ticket to their theater because of how they handle their customer complaints (whether valid or not).... and I say this as someone who worked with the public for over a decade and dealt with some pretty lame-assed, wrong complaints.

I honestly can not recall ever hearing cursing from peers til junior high school.....I still believe that any child who uses curse words at the age of 6 is only parroting what they ehar at home.  I have seen too many examples that prove this to be true in my 20 years working in elementary schools.

I could not recall saying that the only way kids learn to curse was from home, so I went looking to see if I had said it and forgotten.  The above is the closest I found, and it clearly states that "I have seen too many examples that prove it to be true in MY 20 years working in elementary schools.

You might want to look a little closer at what you said....I've bolded the relevant section for you...

Being disingenuous about what you said in a medium where what you said is permanently preserved is a pretty dubious tactic. Quoting the section where you did say what you claim you didn't say is a...well...lets just say its pretty special...in that short bus kind of way.

GreedyTop -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 11:25:06 AM)

one thing that I see here is .. outrage?... that  the chicks VM was turned into a PSA.

Not once was that cow's name or likeness used.

The PSA, as far as the general public was concerned, it was an anonymous voice.

As far as I can tell, the only way anyone who wasnt familiar with her voice, in it's whiny tones + terminology (or maybe normal? who knows? maybe she ALWAYS sounds like that) WOULD know it was her was if it WAS normal for her.

if it was my daughter/niece/cousin/close friend/etc...   I'd smack her seven ways to sunday for being such an incosiderate/ill-mannered little twat.

juliaoceania -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 11:30:27 AM)

Her voice sounded fairly distinctive to me....

GreedyTop -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 11:40:57 AM)

I can name several folks that wont recognize my voice over the phone, unless I use certain phrases, Julia, including a guy that is a professional sound engineer.

"hey honey!" is one key phrase..

MOST folks are not so keyed into tones/etc that they will automatically tune into those various tones/octaves/etc that make up a persons voice.  MOST folks use visual clues as well.

juliaoceania -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 11:43:03 AM)

What would you think if you wrote an email complaining about your cell phone service and they published it as a way to make fun of "irate customers"... of course they redacted all identifying information.... would you want to do business with a company that did this?

if I was as obnoxious as her?

I'd think "oh wow.. was that how I came across?"

of course, I work in customer service.. I have a REALLY LOW tolerance level for stupid twats.

GreedyTop -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 11:47:10 AM)

ARSY!!!  *tacklehugs*

juliaoceania -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 11:56:17 AM)

I worked in customer service and I had a high tolerance for self absorbed stupid twats. That was what I got paid to put up with...

I just have a different opinion...

About a year ago I got REALLY mad at my cable company, as in seeing red mad. I was mad because they raised my bill by 50 bucks a month. The reason I got mad was because I got a phone call from one of their reps about how to continue to get the same rate on my tv and internet service even though my contract had expired. He told me that if I got a phone bundled on my service then I wouldn't have to pay anymore. I asked him three times to assure me that my bill would remain the same if I added the landline, and he said THREE times that it would. It didn't make sense to me, but hey, if he was promising my bill would remain the same by adding more services, I was in!

I didn't even own a phone at the time. I told the guy i had no interest in a phone, but he said in order to add the service I needed to get a phone. I went to the store and bought a phone for my unwanted and unneeded landline. I figured it was 25 bucks, and it would save me 30 a month....

When I got my bill I called to straighten it out and they repeatedly told me that I agreed to something I had not agreed to I was so pissed, yes, I lost my temper, yes I yelled. Yes, they had to transfer me, and in the end, they not only took off the extra charges, but they credited my account for the phone I bought.

Now, someone listening to portions of that phone call might think I was an out of line customer. I wasn't. I was a pissed off customer. And I was about two seconds away from firing their asses and going without TV ( that was the only service I could get in a historic building)

My point of relating the above is that I know from personal experience how frustrating it can be dealing with people on both sides of the equation. And even though I had never in my life yelled on a phone before, even I had my limits.

Such conversations shouldn't be aired for shits and giggles

igor2003 -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 12:04:20 PM)

The movie theater didn't "humiliate" anybody.  The classless little twit did that all by herself when she left the rude, vulgar voice mail.  Had she simply stated her complaint in a more dignified manner there would have been nothing for the theater to put into their PSA.

There is at least one other thread right now about Congressman Wiener and some photos he sent via the Internet.  I believe the general consensus is that he created his own humiliation by sending  those photos.  How is this any different?

GreedyTop -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 12:08:15 PM)

yeah, but you're not an adult who either was either so busy texting to pay attention to the TOS (which had been graphically demonstrated over several years), or a twat who willfully ignored said TOS.

I am someone that thinks airing such things is tacky, nasty, and perhaps could cause repercussions for the person lodging the complaint. I find the entire matter distasteful. Bad business, because for everyone that thinks it is "cute" there are others who will find it to be tacky...

The theater isn't winning....

LadyPact -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 12:20:19 PM)

I don't know about that last part, julia.  Unfortunately, this wasn't a poll, but more people seem to be on the side of the theater, so they do seem to be winning.

tazzygirl -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 12:27:39 PM)

~FR

How many times a week does anyone suppose this happens, people ignoring the polite requests so that everyone can enjoy the movie experience? After a while.... hmmm.... would anyone care what that tactless customer said on the voice mail, beyond laughter and a possible marketing ploy?

Seems to be working from both ends for the business. Free advertising!

Hillwilliam -> RE: Texter gets kicked out of theater and leaves (profane) VM (6/8/2011 12:29:24 PM)

The little bitchlet KNEW she was being recorded. If you know you are being recorded, you have 2 choices. You can self censor or you can look like an ass and hopefully learn to self censor in the future.

I'd say it was a lesson for her. I sincerely hope she learned something but I have a feeling she didn't.
