Part of the reason I am not involved with the local "community"* is due to this idea of signing a waiver to attend a play party. I readily admit I am not the most experienced in the whole kinky scene, etc., etc., but the group I was involved with prior to moving here was fairly small and tight-knit and didn't have anything as ridiculous as signing a waiver to attend their play parties. So my question to those of you who have attended play parties is this: Are waivers de rigueur for those who attend play parties?

I'm also wondering what, if any, legitimacy this has as a legal document.



* Let's not get caught up in semantics. I'm using the word "community" to describe kinky folk who get together every so often at social gatherings and know each other (some better than others) outside of these social events.

both of the groups i've gone to have you sign some kinda little thing.
one of them has you sign one at every single party, and the other has you sign one once a year.
i have no idea what weight it would hold, if any, as a legal document.

I have been to a lot of parties and I have never had to sign a waiver. I have signed one at events that I have attended, but not at someones house. Not sure about the legitimacy part. I guess it would depend on what actually went wrong.

That's what I'd like to know...the legality of it. 'Cause if it doesn't hold any legal weight, what's the point?

I could see it at an event like DomCon, but a local play party? This one isn't being held at anyone's home. They rent the space. If I had the $$'s, I'd buy a space and invite everyone except the turkey-waddle who organizes the aforementioned play parties.

I've attended about two dozen parties, at about half a dozen venues, and have almost always had to sign a waiver. That includes parties held at private residences.

Even if waivers don't hold legal water, I guess they could help to impart a higher general regard for the rules. But if someone's mentality is such that having to sign a waiver makes a difference in his behavior, I don't want him being kinky anywhere near me.

I read the document, and it doesn't look like a waiver to me, it just looks like you are signing the house rules. I doubt requiring "fluid bonded " players to wear a condom is legally enforceable, although they can certainly ask the offenders to leave.
A waiver might say something like you waive all legal claims and hold the organizer harmless. That sort of thing. I didn't see any language like that on this document.

I used to attend and run play parties when I was younger. I've been to tons of them in the past and never once was offered or told I had to sign a waiver and I never had one available at our play parties.

The only "waiver" I had to sign was when I signed up for a membership which was required at a lot of parties and it just basically said that I agree to abide by the rules of no pictures, no cell phones, no bloodplay, no sexual penetration, blah blah blah".

You aren't waiving any rights. You're accepting their rules, no drinking, no weapons, no messing up the space. About the only waiver sort of language is that you accept they can kick you out if you break a rule. Nothing that would concern me.

I think that if it is in a private space, and sets out rules for the space (as in: affirming one is of age of consent and DOES consent to be in the presence of/party to the activities that may happen in said space, etc.....) it MIGHT afford some kind of 'protection' to the owner of the space, even if not in a strictly legal sense... depending on judge/jury, it may mitigate culpability...

yep yep -- it's really not that big of a deal. i guess it's for them to be able to take recourse against you if you do any of those things, since you signed it.
that way they can say "see, we know you knew!" before they boot you out for burning the place down. =p

The host of that event used to bea frequent poster here and that is a pretty standard set of rules. Like most legal.stuff its only as good as your lawyer and how deep.your pockets are.

I don't know about the legality of it, but it just looks like the House Rules and, by signing it, you are agreeing to the House Rules. I regularly go to a play party on private property and I did sign an agreement a lot like that. There is another place I go to also and, by going to their Orientation and paying my annual dues, I also agreed to abide by their rules. If nothing else, it makes one aware of the rules and lets them know they'll get booted for disregarding them.

ok to my knowledge based upon the play parties that i have attended it is for the factor of liability of damages to the dungons equipment that could happen during any one particular persons scene and also for the safety of the fact of say someone has a mental break and a sever injury occurs due to a scene going wrong just stating that the D/s couple or group that was doing the scene is responsible for what happens and not the dungon. it also is that if someone sees a scene that they think is going wrong and say something to the DM that if interfered with and asked to stop a scene that you would listen to the DM and do what is asked. the last scenario rarely happens but the first 2 could happen more than you would expect.

I have signed papers whether it is a public dungeon or a party in a private home. By signing you show that you have read and know the rules. Also, you are required to show a certain committee member legal ID when you return the signed papers. That verifies that you are who you say you are and are at least 18. I have never attended an event where legal ID was not required to be shown before you could attend.

What you seem to have their is an acknowledgement of the rules of the play party, which is a bit different than a waiver.  Giving it a quick scan (I just woke up) is that nice little phrase that says 'release of liability'.  That's the part that helps the property owner/event organizer should anybody get the idea to try to hold a third party responsible for any damages/injuries that occur during the event. 

Yes, it may seem like overkill, but you really have to look at it from the homeowner's side.  It's for their protection should anything happen that is a result of your play, which is different than you tripping on a step that needed fixing at their place which would be covered by their homeowners insurance.

I've never had to sign anything like that.  It seems to be a written form of a dungeon orientation.  I've heard them verbally, but that's it.

Thanks to everyone who responded. I appreciate it. :)

It may very well be that the waiver is in addition to the house rules that I had linked. Now that I search in the dusty corners of my memory, I seem to recall him (the organizer) telling me that there was a separate paper one signs at the door. I questioned him about it in a thread on FetLife and he became practically apoplectic over the idea I should challenge him in any way.

I have thought of doing what Kana has suggested. If I did end up going to any of the play parties here, I would definitely not sign my real name. I don't even like to sign the documents I do at work! Unfortunately I can't get away with a pseudonym there. ;)

But I don't see myself going to any play parties here anytime soon. Some of the people in the community* (see above) here get their panties in a twist far too easily. There's more too it, of course, but for now, that's how it is.
