If Brian Harrison and W. G. Stover, the two Solyndra executives who took the Fifth Amendment at a Congressional hearing on Friday, ever spend a day in jail, I’ll stand on my head in Times Square.

It’s not going to happen, for one simple reason: neither they, nor anyone else connected with Solyndra, have done anything remotely criminal. The company’s recent bankruptcy — which the Republicans are now rabidly “investigating” because Solyndra had the misfortune to receive a $535 million federally guaranteed loan from the Obama administration — was largely brought on by a stunning collapse in the price of solar panels over the past year or so.

Harrison and Stover are on the hot seat. Anything they say in their defense — even an off-hand remark — can and will be used against them. Their lawyers would be fools if they didn’t insist that their clients take the Fifth Amendment.

Do the Republicans know this? Of course. Do they care? Of course not. For an hour and a half on Friday morning, they peppered the two men with questions about this “taxpayer ripoff,” as Representative Fred Upton, a Michigan Republican, described it, knowing full well that Harrison and Stover would invoke their constitutional right to remain silent. Joe McCarthy would have been proud.

The purpose of the hearing — indeed, the point of manufacturing a Solyndra investigation in the first place — is to embarrass the president. That’s how Washington works in the modern age: the party out of power gins up phony scandals aimed at hurting the party in power.

Undoubtedly, the Solyndra “scandal” will draw a little blood: there are some embarrassing e-mails showing the White House pushing to get the deal done quickly so it could tout Solyndra’s green jobs as part of the stimulus package.

But if we could just stop playing gotcha for a second, we might realize that federal loan programs — especially loans for innovative energy technologies — virtually require the government to take risks the private sector won’t take. Indeed, risk-taking is what these programs are all about. Sometimes, the risks pay off. Other times, they don’t. It’s not a taxpayer ripoff if you don’t bat 1.000; on the contrary, a zero failure rate likely means that the program is too risk-averse. Thus, the real question the Solyndra case poses is this: Are the potential successes significant enough to negate the inevitable failures?

actually, the Obama administration pressured them to delay announcing layoffs till after the 2010 mid-term elections.....

You and the NYT seem to be leaving that part out.



It is a standard partisan Democrat trick to try to misdefine what the scandal is so you can argue it is not a scandal.

Rather intellectually dishonest though.

Facts eclipse Solyndra excuses

On Friday, Solyndra execs Brian Harrison and Bill Stover invoked their Fifth Amendment right against self-incrimination. They refused to answer questions at a hearing of the House Energy and Commerce Committee's Subcommittee on Oversight and Investigations, which is investigating a $528 million federal loan guarantee that the Obama administration granted to their solar manufacturing company in 2009. On Aug. 31, the company filed for bankruptcy and laid off most of its 1,100 workers. A week later, the FBI raided the company's Fremont, Calif., headquarters and Harrison's home.

Rep. Cliff Stearns, R-Fla., the chairman of the subcommittee, said the hearing wanted to discern, "What did they know (about their financial situation), and when did they know it?"

Though some committee members urged the two suits to ignore their lawyers' advice and answer questions -- one Republican even suggested that their failure to talk suggested guilt -- I thought the execs did the smart thing. Harrison and Stover have nothing to gain by talking, because there's no good way to explain how they blew close to a half-billion in taxpayer money.

Besides, they didn't need to talk when committee Democrats were so willing to toss around a few mitigating factors, such as:


* Excuse No. 1: New technology startups, by definition, are risky ventures.

Problem: Solyndra engaged in profligate behavior. A Washington Post story describes the spending spree that followed the Department of Energy loan guarantee -- new factory, state-of-the-art conference room, lobbying bills that grew from $160,000 in 2008 to $550,000 last year. Within a week of winning the first loan guarantee, Solyndra went back to the Department of Energy for another $400 million (which never was approved).


* Excuse No. 2: Rep. Diana DeGette, D-Colo., claimed that both the George W. Bush and Obama administrations "supported Solyndra's loan guarantee application."

Problem: In its final month, the Bush Department of Energy credit committee voted against a loan guarantee for Solyndra.

It was the Obama White House that pushed for early conditional approval of a Solyndra deal, despite an Office of Management and Budget staffer's warning that "this deal is not ready for prime time." Also, the Obama White House embraced Solyndra with unprecedented support so that the company, which never had turned a profit, had a U.S. president, vice president and energy secretary at its high-publicity events.


* Excuse No. 3: Private investors sank $1 billion into Solyndra, more than taxpayers. They must have had good reason.

Problem: Venture capitalists gambled with money from willing investors, not taxpayers. And when Solyndra was in desperate need of cash, the administration agreed to a deal that, in the event of default, put the private investors ahead of taxpayers for a $75 million loan.


* Excuse No. 4: Blame China, which heavily subsidizes the solar industry.


Problem: Do Democrats think that Americans want to compete with China and bankroll more Solyndras?


* Excuse No. 5: Claim the administration embraced Solyndra for science. Rep. Henry Waxman, D-Calif., railed at Friday's hearing, "We need to face reality and stop denying science."


Problem: Democrats can't escape the math.

Perhaps instead of assuming, you could ask why I posted it.

But, thats ok, I will tell ya.

2 reasons

I do believe the article is right... and there is nothing the GOP can do besides smear Obama with it. Did the Administration tell them not to announce the lay offs? Would not surprise me in the least. But, where is that illegal?

I knew it would drive the conservative members on these boards nuts.

That was the best part.

I just didnt realize the rush to whine would be so immediate
