tazzygirl you go on fixing on small details in someone's post to invalidate the whole valid argumentation, that's some kind of red herring.
She called 911 and when told they were real officers she stopped and apoligized just outside the parking lot, now why the f..k someone should call more cops to flee from cops? And that's what makes ABC story not compatible with facts.
Then after 2 monts investigation charges were dropped with a formal agreement, so if there is something more in the story and something needs to be reviewd can only aggravate officers' position.

I didnt claim anyone on these boards did. However, you cannot ignore the way people jumped to the belief that these officers need to be fired, ect.

Are you aware she was arrested 2 months ago and didnt say anything until charges were dropped? April 11th is when this all occurred.

Excuse me for having an opinion and voicing it. Do you realize your last 24 posts have been almost exclusively towards me and all on this thread? You dont have other interests in posting? Or is someone's laundry missing an item?

There are many reasons why a DA would drop a case. Why dont you go find them.

Intent (the "red fallacy" opinion, as you claim it to be and wish to disregard) goes towards motive.

Dropping charges doesnt mean they cannot be charged again. Do I think that will happen? Nope.

You and I are seeing this from two different angels, from two different countries with two very different sets of laws.

Lets agree to disagree and we can end our discussion between us on this thread.

I am sure you have far better things to do. I know I prefer to debate with people who can actually see both sides of a coin.

what are you implying with this? I think it's common sense to do that. But again you just put this question that shows you have a personal opinion but don't tell anything, so for you what does it mean that she waited? what does make you think you that she was 20 years old? you have your opinions you are not spokesman for the state's attorney so just tell it!

LOL.. no, you are far from what I would ever describe as dense. The cops handled it badly, even I can see that. But saying they did something wrong.. I cant go that far.

quote:

Felony charges were dropped on Thursday against a 20-year-old University of Virginia student who says she panicked when undercover agents from the state's Alcohol Beverage Control division mistook her water purchase for beer.

According to Charlottesville (Va.) Daily Progress, the student, Elizabeth Daly, was walking to her car on April 11 at approximately 10:15 p.m. with a box of sparkling water, cookie dough and ice cream she had just bought from a local supermarket when the agents—six men and one woman, all in plainclothes—approached suspecting the box, a blue carton of LaCroix sparkling water, to be a 12-pack of beer. One jumped on the hood of her SUV; another pulled out a gun

Their "probable cause" was their "mistaken" opinion that the blue box was booze. That seven morons chose to act out a fantasy is not any sort of legal police work.
What justifies jumping on the hood of the car and pulling a gun when the suspected crime is an underage girl buying beer? These fucking morons are lucky they did not wind up full of bullet holes.
If it were up to me I would fire that whole pile of shit, all seven of them, after I had them spend a few years in jail.

another fallacy, it's an extremization, teling law enforcement has a duty to not create danger where it's not necessary has nothing related with allowing to evade an arrest, and for sure doesn't mean anyone.

link to hear audio.

The audio of the call is shocking. The women on the call begin crying “oh my God” and “what should we do,” asking for help from the 911 dispatcher. Daly later said that she feared the ABC officers wanted to break the windows of the car, and Daly left the scene of the incident at the behest of the 911 operator. She stopped once the 911 operator told her to do so after ascertaining the identity of the people surrounding the car.

911 never said that on the audio.

Nice red herring. That has absolutely nothing to do with this case and if her charges had gone to trial, the DA would have acknowledged as much.

ETA, you're starting to sound like the "Trayvon was a thug" gang.

Simple mistake of fact situations would generally not warrant attempting to elude law enforcement. However, there are some that would, such as:

the person making the arrest never identifying themselves, causing the defendant to believe they are the target of kidnapping or robbery.

the reasonable belief that the person making the arrest is an impersonator with the intent of victimizing the defendant.

the reasonable belief that the defendant would be the victim of police brutality if taken into custody by that individual.[citation needed]

Many courts generally will not condone violence used in resisting an unlawful arrest, or "deadly force," unless it's proven the police began to use violence upon the defendant.

They identified themselves... they attempted to show badges which they didnt bother to look at and they had no reason to believe the girls knew any of the officers or that they would be the target of police brutality.

Not a red herring... it goes directly to your comment about speed...

2 months isnt "speedy".
