In Rodriguez vs United States, the Supreme Court ruled "The scope of the detention must be carefully tailored to its underlying justification."

This was a minor traffic violation that should have resulted in a warning, or possibly a ticket. That was the extent of the cop's authority. Period. No action by Sandra Bland instigated any legal threat or use of force or further detainment and arrest.

Her words were accurate. "I'm waiting on you. This is your job."

I wish there were a statistic that correlated being a smart mouth to a cop and arrest. I'll bet this would indicate the lip is more of a determine factor than race

LOL I got a ticket once for speeding. The ticket was rightious (sp) and I had no doubt about it. I was going over the crest of a hill when I noted that I was speeding and slowed down. The deputy that stopped me told me what I saw and what I thought and had I not be ill and was running out of time on my way to the dr, I would have called for his sgt or LT to explain to him that he did not have the ability to see thru my eyes or what banged around in my mind. Some cops are idiots. Others are really outstanding at their job.

It's ass hats like this that perpetuate bad blood between the police and citizens, especially black citizens. She was pulled over for changing lanes without signalling. I am in the vast minority in Ohio. I actually DO signal when turning or changing lanes. This guy would have almost the entire state pulled over in no time!

She was arrested for being upset and honest. FFS, she admitted she was upset, and, imo, did a damn nice job of keeping her cool during the whole confrontation.

I truly hope justice is served.

Ken, unless/or until I get irrefutable evidence that Sandra committed suicide, I will not believe it.

What evidence would that be other than what has already been presented? If the second autopsy matches the first within reason then there will be no other evidence.

I think what will happen is there will be a civil suit not because she was abused but because procedures were not followed. If she was checked as mandated she may not have been able to kill herself. AND if it is correct that on the booking file it was marked that she suffered from depression and had suicide thoughts then she should have been on a suicide watch.

What particularly struck me in the dashcam segment (thanks for the link, Kirata!) was that Bland must have asked a dozen times why the cop was detaining her. I never heard an answer, just repeated demands for unquestioning obedience.

'No, no!' said the Queen. 'Sentence first - verdict afterwards.'

'Stuff and nonsense!' said Alice loudly. 'The idea of having the sentence first!'

'Hold your tongue!' said the Queen, turning purple.

The whole thing is disgusting.

I was once driving in Brooklyn and late for a meeting

I was stopped at a light to check my GPS on my phone. I have Bluetooth through speakers so was not on my phone.

Two asshole cops stopped me for talking on a cell while driving. I explained that was not so and I was late for an important meeting.

They took so long giving me this fake ticket, that I got mouthy with them. I never got out of the car though.

The male cop who as black, said " We don't like stuck up NJ white bitches in Brooklyn, so shut the fuck up." He gave me an additional ticket for public loudness or something.

I missed my meeting and was so infuriated, I got their badge numbers and precinct and drove directly there and demanded to see their Lt.

You could tell no one gave a shit about my story.

I dated a NYC cop and my female cousin was a NYC detective, so I know too much about how cops are.

I ended up filing citizen complaint affidavits that went on their records and went to court where my tickets were dropped because this asshole never showed up.

starting at the 8 mark forward, special attention to the 10.25 mark, and the 15 mark!

Here is a woman who just got a new job and had everything in the world to look forward to mysteriously commits suicide with a plastic bag. bullshit

the conclusion is that because she had no struggle marks elsewhere on her body that it was suicide, which tells me that several people were involved in this murder.

The coroner made the 'presumption' she was in a condition to struggle and therefore cause would have had to damage elsewhere to her body. This is a false and insufficient conclusion since all it would take is a few cops to hold her which would have prevented her from struggling.

where did the plastic bag come from, what cell in todays jails has anything to hang themselves from, and what cell has anything to stand on that can be kicked out, since people dont simply hold their feet off the ground. Furthermore what plastic bag is strong enough to stop a body from falling and so forth and so on.

Telling her to put out her cigarette in her private space (the inside of her car) before informing she was going to be placed under arrest is an invasion and violation of her private rights, failing to tell her WHY she was being placed under arrest despite her demands to know is another violation of her due process rights, compiling several more violations thereafter by reaching into her car, and pulling out a lethal weapon etc etc etc.

This whole thing stinks, its clearly a murder just have to prove it.

The cop was polite until Sandra got belligerent, so he escalated the threat level accordingly.

He had a right, as any person has a right, to ask someone to put their cigarette out. She had a right, as any person had a right, to decline his request.

The problem here is that the cop began to use his 'authority' as a cop to demand something that is beyond legitimate police authority to demand, and to use his position as a cop to punish her for her exercise of her rights. Whether other cops do this as a matter of routine is irrelevant - she had a right to smoke inside her own car if she so chose, and is free to exercise that right until she is arrested. The cop was abusing the power invested in him as a cop.

That makes the cop the instigator.

LOL... finally had time to watch that dash cam video all the way through.

Belligerent running the mouth and refusal to comply with queries. Frankly, the first impression is that the woman was tweaking. No matter what color or where you are stopped ranting at a police officer will bring you nothing but trouble. The video sounds as if she were daring the officer to arrest her right from the beginning.

Now, at the jail, there is a huge problem there. The ONLY time a police officer is required by law to ensure the safety of an individual is when they are in custody. After arrest, the term "special relationship" becomes relevant in law. There is even a class on how to put people into and out of a vehicle while they are in handcuffs as the arrested person can press charges if they bump their head while in custody. There was a huge fail if she was able to commit suicide while in custody.

Frankly, the first impression was that the man was abusing his power over an unarmed black woman to compensate for anatomical deficiencies.
