The term also means to "impair, obstruct, or defeat the lawful function of any department of government" by the use of "false or fraudulent pretenses or representations."

13. A "false" or "fraudulent" representation is one that is: (a) made with knowledge that it is untrue; (b) a half-truth; (c) made without a reasonable basis or with reckless indifference as to whether it is, in fact, true or false; or (d) literally true, but intentionally presented in a manner reasonably calculated to deceive a person of ordinary prudence and intelligence. The knowing concealment or omission of information that a reasonable person would consider important in deciding an issue also constitutes fraud.

14. Congress is a "department of the United States" within the meaning of Section 371. In addition, hearings regarding funding for military action and authorization to use military force are "lawful functions" of Congress.

15. Accordingly, the presentation of information to Congress and the general public through deceit, craft, trickery, dishonest means, and fraudulent representations, including lies, half-truths, material omissions, and statements made with reckless indifference to their truth or falsity, while knowing and intending that such fraudulent representations would influence Congress' decisions regarding authorization to use military force and funding for military action, constitutes interfering with, obstructing, impairing, and defeating a lawful government function of a department of the United States within the meaning of Section 371.

CBS/AP) Rush Limbaugh and prosecutors in the long-running prescription fraud case against him have reached a deal calling for the only charge against the conservative commentator to be dropped without a guilty plea if he continues treatment, his attorney said Friday.

Prosecutors' three-year investigation of Limbaugh began after he publicly acknowledged being addicted to pain medication and entered a rehabilitation program. They accused Limbaugh of "doctor shopping," or illegally deceiving multiple doctors to receive overlapping prescriptions, after learning that he received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach mansion.

As a primary condition of the dismissal, Limbaugh must continue to seek treatment from the doctor he has seen for the past 2½ years, Black said. Among other provisions, he also has agreed to pay the state $30,000 to defray its investigative costs, Black said.

The warrant alleges that sometime between February and August 2003, Limbaugh withheld information from a medical practitioner from whom he sought to obtain a controlled substance or a prescription for a controlled substance.

Prosecutors began investigating Limbaugh in 2003 after the National Enquirer reported his housekeeper's allegations that he had abused OxyContin and other painkillers. He soon took a five-week leave from his radio show to enter a rehabilitation program and acknowledged he had become addicted to pain medication. He blamed it on severe back pain.

Before his own problems became public, Limbaugh had decried drug use and abuse and mocked President Clinton for saying he had not inhaled when he tried marijuana. He often made the case that drug crimes deserve punishment.

"Drug use, some might say, is destroying this country. And we have laws against selling drugs, pushing drugs, using drugs, importing drugs. ... And so if people are violating the law by doing drugs, they ought to be accused and they ought to be convicted and they ought to be sent up," Limbaugh said on his short-lived television show on Oct. 5, 1995.

Prosecutors seized Limbaugh's medical records after learning about the painkillers he had received at the Palm Beach pharmacy. The investigation was held up as the prosecutors and Black battled in court over whether the records were properly seized.

ACLU Comes to Rush Limbaugh's Defense

    WEST PALM BEACH, Fla. —  Talk radio host Rush Limbaugh (search) probably never expected the American Civil Liberties Union (search) to become one of his staunch supporters.
    But the privacy rights group was on his side Monday when its Florida branch filed a "friend-of-court" motion on behalf of Limbaugh arguing state officials were wrong in seizing his medical records for their drug probe.
    "For many people, it may seem odd that the ACLU has come to the defense of Rush Limbaugh," ACLU of Florida Executive Director Howard Simon said in a released statement.
    "But we have always said that the ACLU's real client is the Bill of Rights, and we will continue to safeguard the values of equality, fairness and privacy for everyone, regardless of race, economic status or political point of view," Simon said.
    The ACLU contends that state law enforcement officers violated Limbaugh's privacy rights by taking possession of his medical records as part of their criminal investigation into the commentator's alleged "doctor-shopping" to feed his prescription-drug addiction.

    Now we have Ann Coulter saying that Rush was "buying prescription drugs illegally to treat chronic back pain."

    He was buying drugs to feed an addiction...He was not buying pains fort reatment  HE WAS AN ADDICT!!!!!!This is a huge difference..2,000 pills...Wow and look at the conditions of his "not guilty" plea....$30,000 to pay for the investigative costs...Sounds like he is innocent to me...It seems to me that he got off easy...If this had been one of us, think we would have got such a sweet deal?

    And the only reason it was brought to the attention of officials was due to his housekeepers allegations..

    Huge difference to how she reports a story and the actual "truth."

    I imagine you could google everyone of the subjects listed in her story and you would find that she has no conception of what the "real' facts truly are.

    They normally don't even investigate people who over the course of medical treatment  become addicted to pain medication, much less become obsessed with them. Therefore,  when it comes to who is speaking the truth here, Ann Coulter comes much closer to the mark than you do - so, right back at you, domiguy.

    The amazing thing about this entire thread is that people exist who think that Ann Coulter and Bill O'Reilly and Rush Limbaugh actually bother to check the truth behind their rants.

    On the other hand, people who pay attention to what they say seem similarly unwilling to check the facts
    behind what Coulter and Limbaugh state.

    So I suppose it all balances out in the end.

    He was lying under oath in a sexual harrassment lawsuit, annabelle. The man was forcing himself on women who didn't want him, and he has been accused of rape - so it was never "just" about sex, as you have been misled to believe.
