" WASHINGTON (Reuters) - Influential U.S. senators vowed on Thursday to restore to foreign terrorism suspects the right to challenge their imprisonment, saying Congress made an historic blunder by stripping them of that right last year.

Hundreds of suspected al Qaeda and Taliban members held at a U.S. military prison in Guantanamo Bay, Cuba, could be affected.

The United States has drawn international criticism over its continued detention of terrorism suspects in Guantanamo, with human rights groups demanding the prison be closed and detainees charged with crimes or released. "

Looks like all that legislation rubber stamped by the Loyal Bushies is going to just get un-done.

I believe that when the 14th Amendment says, "nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." means

ANY PERSON.

The Hamiltonians will disagree, but who really cares what goes through their little toy brains. WE know what "ANY" and "PERSON" means.

i believe that Bush has done a number of things trying to say he can over ride the Constitution.  This was just one of them.

Bush better watch himself, based on what I've seen of the Gonzales investigation AND the new RICE subpoena, it looks like people paid attention to Elizabeth de la Vega's suggested strategy of INDICTMENT FOR CRIMES before impeachment.

So, the Federal Marshals show up at the White House with a Warrant of Arrest for George W. Bush. I wonder what the Secret Service would do?

Eventually, when the Federal Marshals show up to take her into custody, she'll go.

18 USC 371 is a Federal Felony, and she ( as well as the rest of the administration ) has significant exposure.

IF the DOJ wasn't staffed with "Loyal Bushies" it would probably have happened already.

So they will have the right to file criminal and civil charges against members of the current administration?

From what I understand many of those detainees who were previously released are now back fighting the US soldiers.  And we are concerned with their rights?

There may well be a case for internment, I dont know for sure, but there is NO case whatsoever for the conditions that the detainees appear to be held under.
Chained, hooded caged etc this is a propaganda "sauce" for the enemy NO?

The longer you intend to hold someone the more "civilised" should be their treatment. IMO

Anyone who doesn't have a political agenda to continue the torture of people who are likely innocent ( without a Habeas Corpus hearing, they get the benefit of the doubt ), understands that since the Amendment makes the act of depriving due process Unconstitutional, it applies to the ENTIRE NATION.

In simpler terms, under the Law, the United States is a State, also.

Remember, it's:

THE PEOPLE

THE GREAT STATE OF NEW YORK

THE FEDERAL GOVERNMENT

The idea that the Federal Government can enjoy a privilege prohibited to a SUPERIOR ENTITY is laughable.

HA HA!

Again, we run into the basic Hamiltonian Flaw. They just aren't able to clearly read the words carefully selected for their exact meaning.

There IS NO INTERPRETATION OF THE CONSTITUTION NECESSARY. It says EXACTLY what it means.

( in other words, "What part of 'Shall Not Be Infringed' is unclear to your kind of people" )

Let me try another tack....

WHERE IS THE AUTHORITY TO TORTURE PEOPLE DELEGATED BY THE PEOPLE TO THE FEDERAL GOVERNMENT IN ANY CONSTITUTIONAL CLAUSE OR AMENDMENT?

If you cannot point to it, then the privilege does not exist.

Yes, "restore" (give them) their right to challenge. Lets see them charged, put on trial and sentenced/released.
OR
Lets give them their rights as POWs, meaning no criminal charges and they are imprisoned for the duration but without the inhumane treatment et al.

Right now, and for the several years passed since it started, this whole episode has in no small way contributed to the incredibly bad PR the US is enjoying around the world, and has equally contibuted to removing any moral high ground the US might have occupied. As the 51st state, this affects us in the UK too.
