This is from NPR this afternoon (Talk of the Nation):

In Georgia, seventeen-year old Genarlow Wilson was sentenced to ten years in a Georgia prison for consensual oral sex with a fifteen-year old girl in 2003. Had they “gone all the way,” he’d only have been sentenced one year for intercourse, instead of “child molestation.” Two years into his sentence, a judge reviewed the case and commuted the sentence, giving Wilson credit for time served. Yet, Attorney General Thurbert Baker has challenged the judge’s authority to do so, taking the course to the Georgia Supreme Court. Wilson remains in prison.

I think the American justice system is skewed...that child never should have been in jail for that long.

He needs to be released and allowed to get on with his life.

First of all, I live in GA, so I would believe the story without hesitation.
 
My other statement is more about the situation itself.  Too many times, many sentences do not make sense to Me.  An example of this are the times I read of situations where someone has received a harsher sentence for killing an animal, rather than killing a person. 
 
Since I'm trying to relax for the evening, I won't go into great detail about the imbalance I think is prevelant in the justice system.

I suppose I should clarify my disgust at the sentence, etc.

I have worked with adolescents since I was 17 and up.  Walking hormones.

The US Puritan antipathy towards a healthy sex life is so psychotic, in my opinion.

This is one healthy adolescent doing/being done by another one.  I dont see the crime.

My thoughts?  He was convicted on an ancient charge: getting a blowjob while being a black man in Georgia.  Don't parents teach their kids anything these days?

In response to the order of Monroe County Superior Court Judge Thomas Wilson granting habeas relief to Genarlow Wilson, A.G. Baker announced that in order to resolve clearly erroneous legal issues created by the order, his office has filed a notice of appeal this afternoon. Baker will also seek expedited treatment of the appeal before the Georgia Supreme Court so that all legal impediments to Wilson's case can be resolved without undue delay. Judge Wilson's order struck Genarlow Wilson's original sentence, and then purportedly went on to sentence Genarlow Wilson to a misdemeanor. The law in Georgia is clear that while a habeas court may grant habeas relief, there is absolutely no authority for a habeas court to reduce or modify the judgment of the trial court, in this case, the Superior Court of Douglas County.
While fulfilling his constitutional obligations to represent the state in this habeas matter, Attorney General Baker has also attempted to bring the defense lawyers and Douglas County prosecuting attorneys together in hopes of reaching a resolution in this case. As recently as this past weekend, the Douglas County District Attorney's office offered Genarlow Wilson's attorneys a plea deal that would have allowed Genarlow Wilson to plead to First Offender Treatment, which would mean that he would not have a criminal record nor would he be subject to registering on the sex-offender registry once his sentence had been completed. The plea deal, if accepted by Genarlow Wilson's lawyers, could also result in Genarlow Wilson receiving a sentence substantially shorter than the 10-year mandatory minimum sentence for which he was originally sentenced, possibly leading to his release based upon time already served. Genarlow Wilson, through his attorneys, rejected all of those offers. The District Attorney's office has indicated that the plea offer will remain available to Genarlow Wilson notwithstanding the appeals process.

Ok, once that is resolved than he can get out. 

I think I read somewhere that a Romeo and Juliet law had been put into place afterwards so that can't work for him.

The AG lobbied the legislature to prevent it from being made retroactive specifically to keep this guy in prison.  The whole case is insanity to me, but there's lots of crazy things going on when it comes to sex offenders.  In California we have a law that essentially states that registered sex offenders are exiled from any significant area of human settlement.  Luckily it's under appeal and will probably be thrown out.

This case has been in the news for a while.  The law that he was convicted under was actually repealed after his conviction.  The Georgia legislature actually had the chance to let him out of prison and clear his record.  They didn't do it and they share the blame along with the attorney general for doing this.  The big controversy surrounding this stems from the fact that his buddies videotaped this.  The girl was intoxicated and that is were the rape allegations come from.  He wasn't actually charged with rape, but the legislators that bulked at his release implied that it was rape. 

This is really a issue for Georgia voters, and it is unfair to apply this to the entire country.  I have seen some post here do that.  My home state would have never done this.  The age of consent in this state is 14.  That doesn't mean that a middle aged man can run around sleeping with 14 year olds.  It just means that a 17 year old kid is not going to get sent to the joint for consensual sex with another teenager.  A parent can still get a restraining order or a no trespass warrant against anyone they don't want around their children.

He most certainly WAS charged with rape, and he was acquitted.  It was at the same trial.

One of these cases that makes me oh so proud to be a fucking American.  States' rights, eh?

I stand corrected.  I should have said that he wasn't convicted of rape.  I went back to the story I read, and saw my error.  It is still deplorable that Georgia legislators are running around calling this a rape.  There was something I overlooked in the story too that is just as ridiculous.  Had he had intercourse rather than oral sex, he would have been sentenced to 5 years instead of the 10 that he got.  Apparently this harkens back to the old sodomy laws that have been thrown out by the Supreme Court.  Essentially this guy got punished for not taking the plea bargain that his buddies took.  He isn't even allowed to return home to his parents, because as a sex offender he is not allowed to be around his 8 year old sister.

I am sorry but i disagree with all yall. he perp'd on a kid.. had it videotaped.. he did the crime... he should do the time. so what if it matters that the state legislature repealed the law. he violated it. heck outside of deleware the age of consent is 16 or better. he did it, he messed up, he should serve the sentence...
he is lucky the lil girl was not my child... woulda been a murder trial not a sex crimes trial

I found information here  http://www.wilsonappeal.com/index.php#information  The link to the Atlanta Journal article talks about the Douglasville Six.  5 of them had a rap sheet.  It also discusses the key players crime stance.  Good ol' boys. 
Also on the more information, there is an article about the specific legislation created in 1994 by Matt Towery and while not mentioning Wilson, it does include his response.

At the risk of getting flamed, I agree with the ruling. I do NOT believe that teenagers are mature enough to have sex, the sentence is a bit extreame [10 years is a bit much, 5 would be more reaslistic in my view], but I do agree with the rulling overall. Does the defendant have to register as a 'sex offender' after he gets out??

You think a 17-year-old who gets a blowjob from a 15-year-old should go to jail for five years?  Not even the Georgia legislature thinks that.
