You sure remind me of Billy Flynn doing his little dance in the Roxie Hart trial...you can't have it both ways. It may not be your intent but it does incite hatred nonetheless...With the knowledge that it does you break you own rule when using free speech. I am not trying to pen you down only make a point that  inciting hatred is not a valid filter for free speech.

The stance I have portrayed is that given in UK law. Its not a case of having it both ways, it is a case of determining motive and intent in the same way that one does so for other crimes.

Without this determination, then no one may say anything about anyone or anything for fear of causing offence and inciting hatred. I happen to feel that this is one instance where our parliament has got the balance right, between restricting the activities of certain people who would like to incite hatred, and allowing free speech to survive.

What the law here restricts is, in so many words, public solicitation to commit a crime. Promoting gay marriage is clearly not a solicitation to commit a crime, whilst any backlash to that promotion may produce crime in itself or have the intended effect of publicly soliciting the commission of a crime through promoting homophobia.

I see then that we agree... inciting hatred is a silly determination for free speech. Gay marriage was just an example of many. By the way it is a crime in parts of the US... It is a crime in Kansas so by law you are in violation by inciting hatred... or is it just UK law that counts for you.

As you have said yourself “no one may say anything about anyone or anything for fear of causing offence and inciting hatred” so making this a determination for free speech is not valid. At least in my opinion… laws notwithstanding
