I don't know anything about New York or New Jersey law, because I have absolutely no interest in ever living or probably even visiting those two places again, but from what I know of California law, there is no duty to retreat, and a homeowner has the right to use whatever force is necessary to neutralize a threat, up to and including deadly force. Considering that my motivation would be a sincere and well-founded concern that my life is in danger, I'd be willing to take my chances.
