Please be fair: your interpretation is mostly whole cloth, as that just doesn't give users much to go on. Shouldn't sanctioned users (not just their recipients) receive some sort of warning? Why should one have to be a detective to figure out why one is being punished? That simply isn't effective. Don't assume that users read banner ads; they are notoriously invisible on the Internet. I haven't paid any attention to the one about scammers in years.

While annoying I really get that is it listed in the TOS that they are not allowed to send 1-2 word, 1liners or form letters? If it is then fine but if it isn't if they are going to penalize people that should be specifically identified in the TOS. If it's not revoking mailing privileges because of PREFERENCE is wrong. I mean this website is based on personal expression and preferences yet it is going to penalize people for their preferred messages to send as an initiating email. What's next?

Actually, having considered it, I think it important to note that such a warning would be impossible, sincesanctions are applied based on user responses rather than on user actions. There is a real problem there from a programmatic standpoint--not just a moral one.

The site has a spam policy. It's published in the same way that TOS is listed.
