I am unsure as to whether the volstead act repealed the tax...interesting avenue though. Cannibis is illegal and there is a tax on it, failure to pay that tax is one of the crimes that one may be charged with for possession or sales.

Of course, pot is still illegal under Federal law. Something to think about before you start toking up.
WA also legalized, and turned distribution over to the state. My prediction is the state will milk this enormous cash cow, and prices will sky rocket because of the taxes.

Well, there will have to be some tailoring by states to keep within federal law, but I guess I would call it a under what authority is it a federal law when these hit scotus.   These are not among the several, it is in stte only, no difference I see than there not being a federal poll tax, but state poll taxes are fine.  That's how there is a voter ID  law in a state at all, n-est ce pas, Iam?

Find a way to make growing it legal and you wont have to pay taxes. If its sold it will be taxed.
