If a company requires someone to be competent with the English language, they have to apply it across the board. I suspect those white folks didn't have a problem passing those level 400 English courses in college, right? Or of management taking the same tests to show leadership; lead by example. To me, it sounds like a company that had an opportunity to make some real gains, and it went with the same path that has not worked for other companies in the past.

Nah... this is not how it works...HR could easily just screen through applications or interviews... and be perfectly within the law. I know...I've done it and so does every company... It is not illegal or immoral... You hire the best employee for the job. I've had as many as 150 people apply for a job and I've never had a problem legally picking someone that could communicate properly. I believe they made a calculated decision to hire these workers in good faith and it just did not work out. Now I could be wrong but so could you...at least until more of the story comes out... But you know what... this story will not be in the news again because if the truth came out it would not be sensational news. Butch

Butch It's also, though, unlikely the feds would undertake a case without merit -- they cost money. So...the courts will decide whether this is veiled discrimination or the administration missed the mark. I agree something isn't adding up. Probably why it's in court.

Ok, something I heard from a professor but can't find online documentation for. But, this thread reminded me.... Back int he 60s, some exec at GM wanted to try and peg what made for a successful businessman. So, a program was started to give IQ tests to all employees and interpret the results. Oddly enough, the bell curve fit both the execs and the lowliest janitorial staff. There was no intelligence marker for success. Back to the testing board. Comprehensive testing at all levels of the company came back with only one difference between the lowest levels of employees and the highest levels of management. The difference? The ability to communicate in the English language which was the majority language where they did business back then. (These days I guess they should be proficient in Chinese) Just tossing out what this thread brought to mind.

In Pathfinder (i.e. Dungeons and Dragons 3.75 edition really), they have a language called 'Common'. "What is 'Common', Mr. GM" (the GM is the Game Master, whom brings the story to the players). "Its the most common language known throughout all the lands." "So if I'm in one land, the people there speak the same 'Common' as they do an ocean and lands away?" "yes" says the GM. "But here in the real world, English is spoken in America, but not that 'common' in Europe." "That is reality, this is a fantasy." "So if everyone speaks 'Common', why would anyone want to speak, 'Elvish'? (the player is playing a halfing) The Elf in the party chimes in, "Because we are snobs!" After a brief chuckle.... "So why would I want to learn to speak Troll?" "Well that's easy. If your character were ever to enter reality, he could speak to the Republicans fluently!" The GM states with a straight face....
