DURHAM, N.C.—The Fourth Circuit Court of Appeals struck down key portions of North Carolina’s strict 2013 voting law on Friday, delivering a stern rebuke to the state’s Republican General Assembly and Governor Pat McCrory. The three-judge panel in Richmond, Virginia, unanimously concluded that the law was racially discriminatory, and it blocked a requirement that voters show photo identification to vote and restored same-day voter registration, a week of early voting, pre-registration for teenagers, and out-of-precinct voting.

July 29 (Reuters) - A federal judge on Friday struck down a string of Wisconsin voting restrictions passed by the Republican-led legislature and ordered the state to revamp its voter identification rules, finding that they disenfranchised minority voters.

U.S. District Judge James Peterson, ruling in a legal challenge to the laws by two liberal groups, said he could not overturn the entire voter ID law because a federal appeals court had already found such restrictions to be constitutional.

But Peterson, in his 119-page ruling, said the requirements that Wisconsin voters show either a photo identification or go through a special petition process had unfairly burdened minorities and needed to be reformed or replaced before the November presidential election.



Kansas
Kansas judge rules 17,500 suspended voters can cast ballots in all races

A Shawnee County judge has ruled that 17,500 voters can have their votes counted in state and local races as well as federal ones in Tuesday’s Kansas primary election.

“Losing one’s vote is an irreparable harm in my opinion,” Judge Larry Hendricks said in his ruling Friday.

A state board approved a rule earlier this month to allow people to vote only in federal elections – not state and local ones – if they registered at DMV offices but failed to provide proof of citizenship as required by Kansas law.

Well, if you don't have ID you can't have a car. You can't have a bank account which meas you cannot hire Uber to take you to the polls. You know they are not all in walking distance fro alot of people. I can barely walk a mile these days, and I would be beat.

So let's go the extra mile and send taxis out to bring voters to the polls. Free of course, which means the taxpayer pays for it.

I seriously was reading this and I cannot understand a single thing that is going on.

How can you possibly vote without an ID? That concept is alien!

Over here, there is a list of your identity numbers, and you gotta show your ID and they tick you off and verify against their list, before you are allowed to step into the voting booth to vote.

I mean, how else can you stop non-citizens from voting? Does this mean, then, even a tourist like me can just happily go vote in the US? Since there is no verification?

Because I think it's definitely a national security issue to have a system in place to prevent non-citizens to control who your government is.

Same way you do everywhere that allows that: you give them the poll card that's posted to you, they check the electoral register to make sure that nobody has already voted claiming to be you, then they cross you off the list and give you a voting slip. It isn't exactly rocket science.

You're interested to hear how he's worked out that every negro in the projects is an illegal? (That tends to be the minority who the various Republican id blocks have been aimed at historically.) Are they still pissing and moaning about Barack Obama not being a citizen, and are now extending that one to every other black in the country?

Do you pro-voter ID people even TRY to educate yourselves as to why it is such a pernicious idea? Or do you prefer to bury your head in the sand and let yourself be scammed because your side just "coincidentally" happens to be the one that benefits from minorities, poor people, students and other supposedly liberal-leaning groups being denied their constitutional right to vote?

Google Vote ID as I did, and you come up with a plethora of sites that will tell you why these laws should be abolished. At least then you can claim mendacity and not stupidity as the reason why you take the position you do.

That is not only mendacious, it is not constitutional. Note the prohibitions in the 24th amendment that do not exist in the 2nd.

Why do you think it's such a bad idea to make those that voters are actually legally allowed to vote?

Voter ID (of some sort) is a good idea - unless you have something to hide.

Today, a federal court struck down North Carolina's voter-ID law, one of the strictest in the nation. In addition to requiring residents to show identification before they can cast a ballot, the law also eliminated same-day voter registration, eliminated seven days of early voting and put an end to out-of-precinct voting. The federal court ruling reinstates these provisions, for now.

Supporters of the law, like North Carolina Gov. Pat McCrory, have long maintained that requirements like these were necessary to prevent voter fraud. But time and time again, scholars and legal experts have found that the type of fraud these laws are meant to combat is largely nonexistent.

One of the most comprehensive studies on the subject found only 31 individual cases of voter impersonation out of more than 1 billion votes cast in the United States since the year 2000. Researchers have found that reports of voter fraud are roughly as common as reports of alien abduction.

The federal court in Richmond found that the primary purpose of North Carolina's wasn't to stop voter fraud, but rather to disenfranchise minority voters. The judges found that the provisions "target African Americans with almost surgical precision."

In particular, the court found that North Carolina lawmakers requested data on racial differences in voting behaviors in the state. "This data showed that African Americans disproportionately lacked the most common kind of photo ID, those issued by the Department of Motor Vehicles (DMV)," the judges wrote.

So the legislators made it so that the only acceptable forms of voter identification were the ones disproportionately used by white people. "With race data in hand, the legislature amended the bill to exclude many of the alternative photo IDs used by African Americans," the judges wrote. "The bill retained only the kinds of IDs that white North Carolinians were more likely to possess."

The data also showed that black voters were more likely to make use of early voting — particularly the first seven days out of North Carolina's 17-day voting period. So lawmakers eliminated these seven days of voting. "After receipt of this racial data, the General Assembly amended the bill to eliminate the first week of early voting, shortening the total early voting period from seventeen to ten days," the court found.

Most strikingly, the judges point to a "smoking gun" in North Carolina's justification for the law, proving discriminatory intent. The state argued in court that "counties with Sunday voting in 2014 were disproportionately black" and "disproportionately Democratic," and said it did away with Sunday voting as a result.

"Thus, in what comes as close to a smoking gun as we are likely to see in modern times, the State’s very justification for a challenged statute hinges explicitly on race — specifically its concern that African Americans, who had overwhelmingly voted for Democrats, had too much access to the franchise," the judges write in their decision.

This is about as clear-cut an indictment of the discriminatory underpinnings of voter-ID laws as you'll find anywhere. Studies have already shown a significant link between support for voter ID and racial discrimination, among both lawmakers and white voters in general.
